정규직 노조의 비정규직 조직화 경험 사례연구 - 성공과 실패 요인 분석을 중심으로 - (Case Study on the Experience of Organizing Non-regular Workers by Trade Unions of Regular Workers : Focusing on the Key Success and Failure Factors)

초록

본 논문은 중소기업 정규직 노조의 비정규직에 대한 조직화 성공요인과 실패요인을 분석하고자 하였다. 이를 위해 본 논문에서는 정규직 주도로 진행된 직접고용 비정규직의 정규직 전환제도를 통한 조직화 경험을 살펴보았다. 본 논문에서 사용한 자료는 한국노총 중앙연구원에서 2017년 5∼6월에 조사한 각 노조의 간부와 조합원의 심층 면접자료, 금속 안산지역대표자모임과의 간담회, 한국노총 금속노련 안산지역 사업장 조사 자료 등이다.
비정규직 조직화의 성공요인과 실패요인은 노조 요인, 작업장 요인을 중심으로 분석했는데, 그 결과는 다음과 같다. 노조 요인을 보면, 성공 사례에서는 정규직 노조의 비정규직 보호와 조직화를 위한 노동조합의 방침과 대표자의 의지, 교육/선전활동/투쟁과정을 통한 내부 동의 확보, 비정규직의 권익보호 활동, 노조와 조합원 간의 신뢰관계를 볼 수 있다. 반면에 실패 사례에서는 정규직 노조의 비정규직 조직화 중단, 비정규직 보호 활동 미약, 노조의 정규직 조합원에 대한 책임감 등으로 나타나고 있다. 작업장 요인을 보면, 성공사례의 특징은 양호한 회사 경영사정, 동일라인 동일작업으로 인한 정규직과 비정규직 간의 친밀한 인간관계 형성, 정규직과 비정규직 간의 크지 않은 노동조건 등이다. 반면 실패사례의 특징은 경영위기에 따른 두 번의 구조조정, 노조의 조합원 고용보장에 대한 책임감, 정규직과 비정규직 간의 노동조건 차이 등이다. 이외 비정규직의 정규직 전환을 통한 조직화에 성공한 사례에서는 지역연대활동을 활발히 하고 있는 사업장인 반면 실패 사업장의 경우 내부활동에 집중하고 있었다.

영어초록

This study aimed to investigate the key success and failure factors in organizing non-regular workers led by trade unions of regular workers in small and medium-sized enterprisies. For this purpose, this study examined regular worker unions’ experience of organizing non-regular workers which was established by the institutionalization of the practice on the conversion of non-regular workers into regular ones. The data used were as follows ; indepth interviews of trade union officials and union members in four workplaces in Ansan conducted from May to June 2017, a round-table discussion of workplace union representatives affiliated to the Federation of Korean Metalworkers’ Trade Unions (FKMTU), and the survey on FKMTU’ workplaces under the Federation of Korean Trade Unions (FKTU), etc.
Key success and failure factors were analyzed focusing on the trade union factor and workplace factor. The findings are as follows; According to the trade union factor, success cases were characterized by regular worker unions’ policy and union leaders’ strong will with regard to the protection and organizing of contingent workers, internal consensus among union members achieved by education, propaganda and protest activities for contingent workers, activities for contingent workers’ rights and interest, and union members’ trust in trade unions. On the other hand, the features of failure cases were summarized as the abandonment of organizing contingent workers by regular worker unions, inactive protection of contingent workers, and union’s responsibilities for regular workers. According to the trade union factor, the characteristics of success cases were sound financial status of the companies, well-developed interpersonal relationships between regular and non-regular workers resulting from conducting the same types of job on the same production lines, minor differences in working conditions between regular and non-regular workers, etc. On the other hand, failure factors were featured by two times of company restructuring resulting from financial crises, union’s responsibilities on job security for its members, and discrimination in working conditions against contingent workers. In addition, success cases were found among unions which were actively engaged in solidarity activities at regional level while failure cases were dominant in unions which concentrated on internal activities.
