중국 민법전 중 녹색원칙에 관한 소고 (Study on the Green Principles in the Civil Code)

초록

생태문명건설은 국민의 행복한 생활과 밀접한 관계가 있다. 생태환경 보호 및 자원의 합리적 이용이라는 이념과 민법을 적절히 결합해 많은 사람이 자발적으로 생태환경 보호에 동참할 것을 호소하는 것은 바람직하고 미래지향적인 선택이다. 녹색원칙의 해당 기본원칙은 “녹색의 이념”을 민법에 도입하여 모든 민사활동 준수와 사법 판단의 준칙이 되게 함으로써 민법 가치 체계의 발전에 중대한 영향을 미쳐 중국 민법의 사회화·생태화 추세가 더욱 두드러지고 있다. 녹색원칙은 새로운 원칙으로서 기타 기본원칙과 서로 의존하면서 국민의 환경보호의식을 녹색화하고 경제발전을 녹색화하는 기능을 지니고 있다. 또한 중국 민법전은 녹색원칙과 잘 연계할 필요가 있으며, 녹색원칙이 민법전 각 편제에 충분히 구현되고, 민법전 각 편제에 실제로 법에 의거할 수 있도록 실현해야 한다. 녹색원칙의 의의는 부정할 수 없지만, 그것은 사법적 실무에 적용하는데 아직도 많은 도전에 직면하고 있다. 현재 녹색원칙의 내용이 비교적 모호하여 적용과정에서 관련 규칙이 없어 실행하기 어렵고, 사법 적용과정에서 명확한 기준이 없으며, 동시에 구체적인 법규 간에도 균형과 조율이 어렵다. 그러므로 녹색원칙이 직면한 어려움을 타개하기 위하여 입법은 그 내포를 명확히 하는 데로부터 시작하고, 사법 실무에서 법관의 자유재량권을 적절히 제한하고 사례지도를 강화하는 방향으로 보완해야 하며, 동시에 관련 적용기준을 세분화하고 공익소송제도를 보완하여 절차제도의 보장을 제공하고 통일되고 조화된 법률체계를 구축할 필요가 있다.

The construction of ecological civilization is closely related to people's happiness. It is undoubtedly a wise and forward-looking choice to combine the concepts of ecological protection and rational use of resources with civil law, so as to call for more people to spontaneously participate in the protection of the ecological environment. The birth of this basic principle, referred to as the Green Principle, has introduced the concept of "green" into civil law, making it a guideline for all civil activities and private law judgments, and has had a significant impact on the development of the value system of civil law, making the trend of socialization and ecology of Chinese civil law more and more prominent. As a newborn principle, the green principle is interdependent with other basic principles and has the function of making citizens' awareness of environmental protection green and economic development green. It is also necessary for each sub-part of the Civil Code to be connected with the "green principles" and to fully reflect the "green principles" in each sub-part of the Civil Code, so that they can be effectively realized in each sub-part of the Civil Code. The significance of the green principle is undeniable, but its application in judicial practice there are still many challenges. At present, there is no clear and unified definition of green principles in China, the connotation is vague, and the lack of supporting rules for the implementation of green principles in the process of application is difficult. In order to break through the dilemma faced by the green principle, the legislation should start from clarifying its connotation, and improve the judicial practice in the direction of moderately limiting the discretion of judges and strengthening case guidance, as well as refining the relevant application standards, improving the public interest litigation system to provide procedural system protection, and striving to establish a unified and coordinated legal system.
