부패와 신이중혁명 (corruption and the new dual revolution)

초록

대의민주제와 시장경제는 지난 250여 년 인권의 신장과 부의 폭발적 창출을 견인해 온 혁신적 제도였다. 이 두 제도가 인류의 발전에 기여한 공헌은 명확하다. 그러나 완벽한 제도란 없다. 이들 역시 그렇다. 그동안의 기여에도 불구하고 이 두 제도는 심각한 결함을 드러내고 있다.
대의민주제는 삼권분립, 법치, 다수결을 원칙으로 한다. 삼권분립은 절대 권력을 방지하기 위한 원칙이다. 법치는 공정한 사회를 위한 것이다. 다수결은 최대다수의 권리를 보장하려는 것이다. 선거는 이 제도를 운영하는 체계이다. 시장은 치열하고 공정한 경쟁을 통해 부를 창출하는 데 정당성이 있다.
삼권분립은 삼권을 명확하게 분리하기 어려운 점, 입법부의 전문성 부족, 행정부와 협업, 이익집단 및 시장과 유착, 사법부에 대한 대통령의 인사권 등으로 절대 권력을 방지하는 데 실패했다. 대통령은 임기 중에는 절대 권력에 버금가는 권한을 행사한다. 이는 부패로 이어졌다. 법치는 법을 살 수 있는 가능성 때문에 공정성을 유지하는 데 실패했다. 단순 다수제에 따른 선거 제도와 이익집단의 효율적인 활동으로 다수결의 원칙 역시 크게 훼손되었다. 선거 제도는 운영체계로서 기능하기 보다는 시장과 유착하는 명분과 당내 권력 투쟁으로 그 성격이 변질되었다. 이로써 대의민주제는 실패했다.
시장경제는 치열하고 공정한 경쟁을 통해 부를 창출하는 데에서 정당성을 찾을 수 있다. 그러나 내재된 여러 이유와 운영 과정에서 정치와 유착하고 행정과 협업하여 지대 추구와 부의 이전에 더욱 치중했다. 부를 창출하는 데에는 실패한 것이다.
대의민주제와 시장의 실패는 부패로 이어졌고 이는 부와 소득의 불평등을 초래했다. 점차 심화되는 경제불평등은 부패가 보다 큰 원인이라는 점에서 정당성을 담보하기 어렵다. 새로운 이중혁명이 필요한 이유이다. 이에 더해 진행 중인 4차 산업혁명을 추동하는 새로운 기술은 기존 정치와 경제 제도로 수용하기 어려울 뿐 아니라 이들 제도를 혁신하기 위한 기반 기술이기도 하다.

영어초록

Representative democracy and market economy were the two most innovative system which have generated ever high protection of human rights as well as an explosive increase of wealth during the past 250 years. It is manifest their contribution to the great advancement in the human history. However, there is no system that is perfect. They, too, are not. In spite of their brilliant input, the defects of them have been revealed. Or, their malfunctions have been cumulated.
Representative democracy is based on the principles of separation of powers, rule of law and majority rule. The paramount goal of the principle of separation of powers is to prevent from arising an absolute power. The purpose of the principle of the rule of law is to maintain fairness in the society. Majority rule aims to protect the rights of the many. Election system is the operation system of the representative democracy. Market economy rests its legitimacy on the creation of wealth through fierce as well as fair competition.
Unfortunately, however, the principle of the separation of powers have failed due to following reasons: the difficulties of clearly devide the businesses of three branches; members of legislation branch usually lacks in knowledge and experiences to perform their role; collaboration of legislative branch with administrative branch; a back-scratching alliance of government and market; president’s appointing authority over justices. As a result, president can perform a power that is analogous to an absolute power during his or her official tenure. So, the principle of the separation of powers has failed to prevent from arising an absolute power. And it invites corruption. Rule of law failed to maintain fairness because of the possibility of buying laws. Majority rule, also, impaired by the rule of the first-past –the-post in elections and vigorous as well efficient actions of interest groups. Instead of function as the operation system of representative democracy, the election system utilized as the justification of the back-scratching alliance of government and market and the nature of it spoiled due to intraparty power struggle. Based on the reasoning so far, it can safely be said that the representative democracy has failed.
Market economy can only be justified by the creation of wealth through a fierce as well fair competition. In the contrary, it focused on both rent-seeking and the transfer of wealth. It fails to creation of wealth.
The failure of both systems caused corruption which is legal. It, then, caused ever increasing inequalities in wealth ans income among people. Corruption driven inequalities in wealth and income can hardly win justification. This is the reason a new dual revolution is necessary. In addition, new technologies that give impetus to the 4th industrial revolution cannot be expropriated by the current political and economic systems, rather, they can be the background technologies to innovate them.
