이른바 준연동형 비례대표제에 관한 헌법적 검토- 국회 정개특위 선거제도 개편안을 중심으로 - (A Constitutional Review on a so-called 'Quasi Mixed-Member Proportional Representation')

초록

정개특위에서 제시한 선거제도 개편안은 현행 선거제도에 비하여 대표의 비례성을 늘리고, 각 정당 취약지역에서도 의원 선출이 가능하도록 함으로써 다당제의 기반을 마련한 것이라 할 수 있다. 그런데 국회의원 정수를 300석으로 고정한 상태에서, 정당간 타협으로 의석배분의 연동율을 50%로 정함으로써 의석배분방식이 매우 복잡하게 되었다. 그 결과, 혼합형 비례대표제의 원래 취지를 제대로 살리지 못하게 될 것이다. 그런 점에서 정개특위가 제시한 이른바 준연동형 비례대표제는 본래 의미의 (혼합형) 비례대표제가 아니다.
정개특위의 선거제도 개편안은 대통령중심의 통치구조와 결합함으로써 한국 정당정치 및 의회정치에 새로운 발전과 혼란의 계기를 동시에 줄 가능성이 매우 크다. 무엇보다도, 복수의 지역구 낙선자 중에서 ‘가장 아쉬운 낙선자’를 비례대표의원으로 당선시키는 석패율제는 사실상 비례대표제의 취지를 훼손하는 결과를 가져올 것이다.
총체적으로 볼 때, 정개특위의 개편안이 다당제의 제도화를 가져올 것은 분명하나, 한국 정당정치와 의회정치 나아가 통치구조의 작동이 더욱 발전적인 방향으로 나아갈 지는 상당히 불분명하다. 따라서 현재의 정당정치 내지 한국정치의 수준에서 다당제의 제도화가 어떠한 결과를 가져올 것인가를 세세하게 검토할 필요가 있다.
현행 국회의원선거제도의 대안으로서 혼합형 비례대표제인 독일식 선거제도, 즉 원래 의미의 연동형 비례대표제가 가장 이상적인 것은 사실이나, 지금까지 정당정치의 수준을 고려한다면, 먼저 지역구의석수와 비례대표의석수의 비율을 최소한 3:1로 한 혼합형 다수대표제로 하되, 후보자를 민주적·합리적으로 추천하고, 선거권자는 선호투표를 통하여 명부상 후보자를 선택할 수 있는 가변명부식의 경험을 축적하는 것이 더 시급하다고 본다.

영어초록

The reform plan for the Parliamentary electoral system proposed by the Special Committee for Political Reform on April 2019 aims to increase the proportionality of the current electoral system and to allow assemblymen to be elected in the wastelands of political parties. This is expected to lay the foundation of multi-party system in Korea. However, under the limitation of the number of assemblymen(three hundreds), setting the seat linkage ratio at 50% by the compromise between parties has made the seat allocation formula very complicated. As a result, the original purpose of introducing a mixed-member proportional representation system, in which parliamentary seats are tied to the percentage of voters' support for different parties, can not be realized fully. While the Proposal of the Committee may be called a quasi mixed-member proportional system), it is actually not a true (mixed-member) proportional representation.
Combined with the president-centered governing structure, it might be simultaneously a trigger of a new development and the confusion in Korean party politics and parliamentary politics. Particularly, the best loser system which enables the best loser in the districts to be elected as a proportional member again will result in the impairment of the purpose of proportional representation.
All in all, it is clear that the reorganizing plan will bring about the institutionalization of multi-party system, but it is rather unclear that Korea's party politics, parliamentary politics and the function of the governing structure will be really further developed. Therefore, it is necessary to consider carefully what kind of results multi-party institutionalization will bring about at the current level of Korean politics.
Although, as an alternative to the current parliamentary electoral system, the mixed-member proportional representation system of German Bundestag is the best model, more practicable and recommendable is the mixed-member majoritarian system in which the ratio of seats between nominal tier and list tier is at least 3: 1. Also it is urgently needed to recommend the candidates democratically and rationally, and to accumulate the experience of the open list which allows voters to express their own preferences for candidates.
