버스準公營制에서의 運送費用과 運送收入金의 法的 性質 (The Legal Nature of Bus Transportation Expenses and Incomes under the Semi-Public System)

초록

버스 준공영제가 2004년 서울시에서 도입된 이래 광역시와 대부분의 대도시에 도입되어 시행된 지 5년의 세월이 흘러가고 있다. 따라서 지금이 그 동안의 준공영제의 공과를 점검해 보고 보다 내실있는 운영을 위한 제도적인 보완작업을 진행해야 할 적절한 시기라고 생각된다. 특히 버스 준공영제는 시민의 편의와 안전을 담보하기 위해 노선권을 실질적으로 환수하는 등 공공성을 강화하는 반면 총 운송비용을 총 운송수입액으로 충당하지 못하는 부족액은 시민의 세금으로 재정지원하는 구조이기 때문에 과거의 민영제에서 보다는 버스의 경영에서 버스운송사업자의 윤리적 수준이 한층 강화될 것을 요구하고 있다.
이러한 시점에서 준공영제의 보완방향을 제시하기 방편의 일환으로서 준공영제에서 진행된 운송비용과 운송수입금에 대한 판례를 분석하여 그 법적 성질을 규명하는 것은 의미가 있다고 할 것이다. 운송비용과 관련된 판례를 통하여 운송비용은 보조금으로서의 법적 성질을 지니고 있고, 이를 지정된 용도에 사용하지 않을 경우에는 행정당국에서 환수할 수 있으며, 또한 업무상 횡령행위로 형벌도 부과될 수 있다는 점을 살펴보았다. 운송수입금과 관련된 판례에서는 운송수입금은 버스운송사업자들의 공동소유에 속하는 것으로 자신들이 설립하여 운영하는 서울버스운송사업조합의 관리 아래 있으므로, 교통카드수입금뿐만 아니라 현금수입금까지도 버스운송사업자가 이를 탈루시켜 임의적 용도로 사용하는 것은 횡령행위를 구성하여 이를 환수할 수 있고, 업무상 횡령행위로 형사적 처벌이 가능하다고 분석하였다. 그러나 그 동안의 형사사건에서 검찰은 법원의 판례와 달리 재물의 타인성이 인정되지 않는다는 입장으로 불기소결정을 내린 바가 있으므로 이에 대한 시정작업이 필요하며, 탈루액의 100배를 과징금으로 부과할 수 있도록 규정한 자체의 과징금 규정도 위약벌의 법리에 부합되지 않는 부분이 존재한다는 법원의 판례가 나왔으므로 이에 따라 이를 보완할 필요가 있다는 점을 지적하였다.
본 논문에서 규명한 준공영제에서의 운송비용 및 운송수입금의 법적 성질은 준공영제 운영의 본질적인 요소인 만큼 법원의 판례를 토대로 하여 준공영제의 제도적 보완작업에 진행될 필요가 있다. 특히 준공영제에서는 버스운송사업자들에게 높은 수준의 도덕성과 윤리적 행태를 요구하는 제도이므로 행정당국, 버스운송사업자 그리고 이해당사자들은 판례에서 나타난 법적 성질을 철저히 숙지하여 제도적인 보완작업을 시행하고, 시민들의 요구수준에 부합하는 윤리성이 담보될 수 있도록 관리 및 운영행태를 개선해야 할 것이다.

영어초록

It has been 5 years since the bus semi-public system was introduced and carried out in metropolitan cities and most major cities. Therefore, the time is ripe to examine the strengths and weaknesses of the semi-public system and systematically supplement it for more efficient operations. In particular, while the bus semi-public system has strengthened its public nature in order to guarantee citizens’ convenience and safety by taking measures such as substantially redeeming bus route rights, bus transportation operators need to strengthen their ethical standards in regards to the management of buses because the current structure requires the deficit created by the total transportation expenses being greater than total transportation earnings to be financially supported by taxes paid by citizens.
However, as the semi-public system is an unfamiliar system that differs from the pre-existing private system, it is true that there have been many mistakes in the course of implementing this system. There have been many instances of bus transportation operators handling and managing transportation expenses and earnings as they did under the private system and having the evaded sums redeemed and being criminally prosecuted for embezzlement as well as civic organizations’ criticism of the waste of taxpayers’ precious money. In this regards, the demand for supplementing the semi-public system is currently growing.
It is meaningful to analyze transportation expenses and earnings precedents and examine their legal nature as one way of proposing a supplementary direction for the semi-public system. We have examined that through transportation expenses precedents, transportation expenses have a legal nature as subsidies, and they can be redeemed by the authorities as well as be the grounds for being penalized for embezzlement, if they are not used for specified purposes. According to transportation earnings precedents, it was determined that transportation earnings are jointly owned by bus transportation operators, and are under the management of the bus operators’ union that was established and operated by operators. Therefore, if bus transportation operators commit fraud with transportation card earnings and cash earnings and arbitrarily use them, it can be redeemed as embezzled funds and can be criminally prosecuted as embezzlement.
Nevertheless, unlike court precedents until now, prosecutors have stated that the borrowed nature of property cannot be recognized and was not prosecuted in the past. In addition, there have been court precedents that determine that surcharge regulations that state that 100 times the amount of fraud must levied as surcharge are not entirely in agreement with breach of contract legal principles, and must be supplemented.
As examined in this paper, the legal nature of transportation expenses and incomes under the semi-public system needs to be systematically supplemented according to the precedents of the court, as it is a basic factor in operating the semi-public system. In particular, the semi-public system is a system that demands a high standard of moral and ethical behavior, thus, authorities, bus transportation operators, and stakeholders must be fully aware of the legal nature in precedents and reform management and operational behavior to secure a level of ethics that meets citizens’ demands. I hope that the semi-public system experiment will be successfully completed so that Korean bus management can obtain a worldwide reputation.
