결혼 이주여성의 인권 실태와 한국 법제도 현황에 대한 검토 (A Study on The Situation of Marital Migrant Women's Rights and the Related Laws and Institutions in Korea)

초록

국내 전체 결혼에서 국제결혼이 차지하는 비중은 2000년 3.7%, 2003년 8.4%, 2005년 13.6%로 급증하고 있다. 결혼 이주여성의 출신국가별 통계를 보면 베트남 여성과의 결혼이 2001년 1.3%, 2003년 7.3%, 2005년 18.7%, 2006년 33.5%로 눈에 띄게 증가했다는 특징을 갖는다. 베트남 여성과의 국제결혼이 비약적으로 증가한 이유로 “국제결혼 중개업체의 활약”과 지방자치단체가 주도하는 “농어민 국제결혼 비용 지원 사업”의 활약”을 들 수 있다. 2005년 보건복지가족부의 실태조사 결과 결혼 이주여성 10명 중 한명은 남편으로부터 구타당하거나 성행위를 강요받은 경험이 있으나 약 30% 국제결혼 이주여성이 “그냥 참고 산다.”고 응답한 것으로 나타났다. 결혼 이주여성은 한국 국적취득 전까지는 ‘외국인’의 신분으로 국적 취득 전에 이혼을 하면 본국으로 귀국해야하거나 불법 체류자로 전락할 불안정한 신분 상태에 놓여있다. 법적 지위가 안정적으로 보장되지 않는 한 결혼이주여성은 가정폭력 피해를 말할 수 없는 것이다. 국제결혼 중개는 최대 이윤의 추구라는 자본주의의 논리에 의해 작동 되고 있다. 중개 구조 안에서 이주여성은 통제와 강요, 협박, 부채예속, 착취에 노출될 위험을 지니고 있다. 게다가 손쉬운 이윤창출이 가능한 시장으로 인식되면서 국제결혼 중개업체의 수는 기하급수적으로 늘어나고 있다. 국제결혼 중개업체에 대한 정부의 개입이 촉구됨에 따라 「결혼중개업의 관리에 관한 법」이 제정되어 2008년 6월부터 시행되기 시작하였다. 그러나 이 법은 ‘상대방에 대한 정확한 정보 제공’을 어떻게 담보할 것인지에 대하여 침묵하고 있다. 또한 결혼이주여성의 입증책임을 완화하거나, 결혼중개업자에게 정확한 정보를 제공하였음을 입증하도록 입증책임을 전환하는 규정이 보완되지 않는다면 결혼중개업체로부터 피해를 입은 결혼이주여성이 국내 법적 절차를 통해 피해를 구제받기란 요원할 것으로 보인다. 또한 인신매매적 국제결혼을 뿌리 뽑고 이주여성의 인권을 보호하기 위해서는 보다 근본적인 대책 마련이 필요할 것이다. 국제결혼 중개업자에게 ‘합법’이라는 날개를 달아 문제적 국제결혼 중개행위를 더욱 조장한다는 오명에서 벗어나기 위해서는 시급한 법개정이 필요할 것이다. 2007. 6. 기준 전국 기초자치단체 중 약 25%가 “농어민 국제결혼비용 지원 관련 정책”을 추진하고 있는 것으로 드러났다. ‘농어민 국제결혼 비용지원 사업’은 국제결혼 중개업체에 의한 국제결혼이 상대방에 대한 부정확한 정보제공과 여성을 상품화하는 진행방식으로 인권침해가 심각한데도 지방정부가 규제는커녕 오히려 앞장서서 한국의 남성들을 “인신매매”적인 국제결혼으로 내몰고 있다는 점에서 문제적이다. 한 사회의 인권지수가 그 나라에서 가장 차별받는 계층의 인권실태로 가름할 수 있다고 한다면 국제결혼 이주여성이야말로 ‘이주민’으로, ‘여성’으로, ‘빈곤층’으로 겹겹으로 차별받는 계층이라는 점에서 우리사회의 인권잣대라 할 것이다. 2007년 유엔 여성차별철폐위원회와 인종차별철폐위원회의 권고를 받아 안아 국제결혼의 성립과 정착의 전 진행과정이 국제 사회의 인권의 기준에 부합하도록 법·제도를 정비해나가야 할 것이다.

영어초록

The statistical data demonstrates a rapid increment in the portion of
international marriage in Korea since 2000. International marriages of foreign
women with Korean men take absolutely large portion of whole cases of
international marriage (the feminization of marital migration), and especially
the number of Vietnamese brides has evidently increased. A swift
augmentation of international marriage with Vietnamese women attributes to
the "International marriage subsidy program for farmers and fishermen
(hereafter, the Program)" led by local governments and the role of
international marriage brokerage system. In order to induce as many Korean
men as possible, brokers employ a variety of media, both online and offline,
such as banners, newspaper advertisements, internet web site and so forth.
In this process, sexually and racially discriminatory advertisements are
prevalent. No information on husband is provided to a foreign bride until the
moment that she is finally selected by a Korean husband. Even though a
brief profile of husband is provided after a bride has been selected, in many
cases, such information is not correct. During the meeting, one Korean man
chooses one woman among about 100 to 200 candidates, which is very much
like a beauty contest. Current process of international marriage brokerage
holds "human-trafficking"character as being defined in international law. The
brokering process is composed of recruiting, accommodating, managing and
controlling women and transferring them through an organized network. As
a result, in many cases, women are compelled to marry the partner against
their own will. As of June 2007, the Program is currently in operation in 3
metropolitan cities and 60 cities and counties. Especially, 24% of 246 local
governments nationwide are implementing this policy. Among 59 cities and
counties, 54 local governments have allocated much more budget, for a
certain case as 38 times more at most, on the subsidy for international
marriage than on the supplementary living allowance for settlement support
of marital migrant woman and her family. The Program results in
guaranteeing profits to brokers. The violation of human rights of migrant
women at this moment is in a grave situation due to the provision of
incorrect information on partner and the commercialization of women.
Nevertheless, local governments are rather encouraging international
marriage that takes on a human trafficking character than regulating
brokering agencies that infringe human rights. The government shall devise
a strong criminal punishment law against human rights-violative practices
performed by international marriage brokerage in order to regulate, prosecute
and punish such practices occurring on the border of human trafficking and
migration. By imposing a heavy punishment, it is possible to develop a
transparent and human rights-friendly procedure of international marriage
brokerage. A more fundamental countermeasure shall be prepared to
eradicate the human trafficking-like international marriage and to protect the
human rights of migrant women. As the fundamental measure, the Protocol
shall be firstly ratified, and the ratified Protocol should provide a legal base
for making a domestic law to prevent human trafficking.
