미국 캘리포니아 주의 토지 이용계획 규제시스템에 관한 법적 고찰 (A Study on the Land Use Planning and Control in California)

초록

본고는 미국의 도시계획을 이해하기 위한 하나의 단서로서 캘리포니아 주의 토지 이용계획 및 규제시스템을 고찰하는 바, 샌 프란시스코 도시계획법(planning code)을 통해서 검토한 것이다. 우리나라의 도시계획이 1962년 도시계획법(현행 국토의 계획 및 이용에 관한 법률) 제정을 포함하여 오로지 도구의 도입에 주력하고, 시스템의 개선을 하지 않아 거품경제 하의 도시문제에 제대로 대응하지 못했다. 이러한 문제의식에서 출발하여 특히 토지 이용계획 및 규제시스템의 파악에 주력하여 우리나라의 도시계획 시스템의 상대화를 밝혀보고자 본 연구를 계획하였다.
본문에서는 미국에 있어서 도시계획 권한과 관련법의 구성 등 기초적 사항을 정리한 후, 도시계획의 시스템을 뒷받침하는 두개의 주요 기둥, 토지 이용계획 및 규제의 구성과 그것들의 결정 절차에 대해서 검토했다. 이상의 검토로부터 우리나라 제도와의 대비를 염두에 두면서, 캘리포니아의 토지 이용계획 및 규제시스템을 최대한 단순하게 정리하였다. 즉, (1) 지방정부에 경찰권(police power)에 기초하여 광범위한 토지이용의 규제권한이 존재한다. (2) 규제와 사업으로부터 자립한 강력한 계획이 존재한다. (3) 용도지역을 중심으로 세부적이고 강력한 규제가 존재한다. (4) 지역설정 계획 등 사전 확정적 규제의 획일성을 넘는 채널이 제공된다. 그 경우의 법적 근거는 도시계획에서 요구한다. (5) 재량적 판단이 많이 사용되고 있다. 그래서 도시개발 절차에서는 청문회를 중심에 둔 시스템을 채택하고 있다. (6) 계획과 규제를 결정하는 입법부문, 그것을 현실에 적용하는 실행부문, 판결을 통해서 도시계획의 구체적 기준을 만드는 사법부문이라는 명확한 삼권분립에 의한 상호간의 체크를 시도하고 있다. 이는 ‘상세하고 냉엄하지만 탄력적인’ 토지 이용계획 및 규제라고 표현할 수 있다.
우리나라의 도시계획은 완만하고 경직적이다. 그 차이의 배경은 우리의 도시계획이 토지소유권에 대한 국가의 제한이라는 형태로 전개하여 왔지만, 미국에서는 풍요로운 생활환경을 구축하기 위해서 소유권 상호의 분쟁을 조정하는 규범으로 전개되어 왔다는 점에 있다. 그러나 지방분권, 지자체 자체의 토지 이용계획 및 규제의 진전이라는 트렌드의 아래, 사전 확정형의 토지 이용계획 및 규제에서 다양한 이해관계자들의 협의형으로의 이행이 이루어지고 있다. 그러므로 이러한 상황을 모두 고려한 종합계획(master plan)의 창설 등에 나선 우리나라의 도시계획에 있어서 미국의 토지 이용계획 및 규제시스템은 지금보다 진지한 조사와 검토의 대상이 되지 않으면 안 된다. 본고에서의 조사와 설명이 우리나라의 도시계획 정책 및 부동산법의 발전에 기여할 수 있다고 사료된다.

영어초록

The objects of this article is to grasp the system of land use planning and control in California State through the State Government Code and Planning Code of San Francisco as clue to recognize American land use planning. Under the critical mind that the Korean urban planning act could not deal with the urban problem causing overheated economy of 1980s because it does not improve the system itself but only add new tools after another, intend to grasp the American planning system and estimate the Korean one relatively.
In the body of the article, after reviewing the basic subjects like the planning power and the composition of relative laws, discussed two points. 1. the framework of land use planning and control, 2. the process of adoption. As a result the characteristics of the Californian land use planning and control system should be summarized comparing with Japanese system as follows. local governments have extensive power of land use planning and control on the basis of police power, 2. A powerful planning exists being independent of control and public works, 3. the control power of zoning is very detailed and strong, 4. there are another channel by which the rigidity of zoning controls is avoided. In such a case the general plan is to be the basis of permission. 5. Discretionary acts aroused in many cases, and through the process public hearing is essential, 6. Legislative branch, ministerial branch and judicial branch are checked by each other.
We may sum up the Californian system to be detailed/strict but elastic, and Korean system ambiguous/loose and rigid. The background may be regarded as follows. in America the land use planning and control have been developed as rules justify the dispute between inhabitants aiming the better environment, where as in Japan town planning have been developed as regulations to the right of land owner by nation. However under the trend of enhancing the local power and developing their own planning system, the American and use planning and control system should be studied more seriously.
The difference between the United States and Korea is, in other words, the problem that results from the difference of the democratic way, and the difference between the two is very large. However, under the trend of decentralization and the progress of the land use planning and regulation of the local government itself, from the pre-determined land use planning and regulation to the implementation of the consultative town development and the creation of the comprehensive plan, now, the American system can not be viewed as simply a matter of observation in a different country with a different cultural or social climate. US land use planning and regulatory systems must be subject to more serious investigation and review. I expect that this work will be the guide for the further study.
