신제도주의 관점에서 본 경찰조직 변화 분석: 역사적 제도주의 통합적 관점 적용 (Analyses of Changes in Police Organizations from the New Institutional Perspective)

초록

우리나라 경찰조직의 변화를 살펴보기 위해 역사적 제도주의 통합적 관점에서 구조 맥락, 제도 맥락, 행위자 맥락으로 구분하여 제도 변화에 영향을 미친요소를 분석하였다. ‘경찰의 날’ 제정을 기준으로 미군정기 경무국에서 자치경찰제도가 시행되는 현재 경찰청까지를 분석 대상으로 하였다. 1945년부터1948년까지 3년이라는 단기간에 미군정기 경무국에서 경무부로 변화하였고, 정부 수립 이후 치안국으로 경찰조직이 변화하였다. 일제강점기 이후 혼란스러운 시대 상황이 반영된 결과로 볼 수 있으며, 이 시기 경찰조직의 변화는 남한의빠른 안정과 회복을 원하는 미군정의 정책과 이념이 반영된 결과라 할 수 있다.
이후 1974년 치안본부로 변화하기 전까지 치안국의 변화가 시도되었으나 좌절되었다. 경무국에서 치안국까지 경찰조직의 변화는 정치적 이데올로기, 반공주의, 경제적 요인, 전쟁 등 구조 맥락과 제도 맥락의 영향이 강한 것으로 나타났다.
치안국에서 치안본부로 변화한 것은 1974년 저격 사건이 역사적 변곡점으로작용한 것이며, 군사정권이라는 정치적 요소가 지속되었고 반공 이데올로기에경제개발을 강조하여 실질적인 제도 변화를 이끌어내지는 못하였다. 1991년치안본부에서 경찰청으로 변화하였고 경찰위원회가 설치된 것은 1987년 민주화 운동이 역사적 변곡점이 되었다. 이러한 조직 변화 요인에서 주목할 점은민주적인 경찰제도의 변화와 경찰중립화를 원하는 행위자들의 영향이 존재하였다는 것이다. 경찰청 조직을 유지한 가운데 2021년 자치경찰제도가 시행되었다. 자치경찰제도 변화의 역사적 변곡점은 검찰 등 권력기관의 개혁이었으며, 제도 맥락의 지방자치 및 지방분권의 민주주의 이념과 행위자 맥락의 요소가제도 변화에 영향을 미치지 못한 것이다. 경무국 이후 경찰조직의 변화는 구조맥락의 정치적 요소가 강하게 작용한 것을 알 수 있었다. 향후 자치경찰제도 발전 등 경찰조직의 변화에 민주주의 이념 등 제도 맥락과 시민과 일선 경찰관등 행위자 맥락이 반영되어야 할 것이다.

영어초록

In order to examine the change of the police organization in Korea, we analyzed the factors that influenced the change of the system by dividing it into the structural context, the institutional context, and the actor context from the historical institutionalist integrated perspective. Based on the rapid enactment of the police, the analysis was conducted from the U.S.
Military Government Department of Police Affairs to the current National Police Agency where the autonomous police system is being implemented.
From 1945 to 1948, in a short period of three years, it changed from the US Military Government Department of Police Affairs to the Ministry of Police Affairs, and after the establishment of the government, the police organization changed to the Security Bureau. It can be seen as a result of reflecting the chaotic situation of the times after the Japanese colonial period, and the change of the police organization in this period is a result of reflecting the policies and ideologies of the US military government that wants South Korea's rapid stability and recovery. The change of the police organization from the police station to the police station was influenced by the structural context and institutional context such as political ideology, anti-communism, economic factors, and war. The change from the Security Bureau to the Security Headquarters was a historical inflection point in 1974, and the political element of the military regime continued and the anti-communist ideology emphasized economic development and did not lead to substantial institutional change. In 1991, the security headquarters changed to the National Police Agency, and the police committee was established in 1987 when the democratization movement became a historical inflection point. It is noteworthy that there was a change in the democratic police system and the influence of actors who wanted to neutralize the police. The autonomous police system was implemented in 2021 while maintaining the organization of the police agency. The historical inflection point of the change of the autonomous police system was the reform of the power institutions such as the prosecution, and the democratic ideology of the local autonomy and decentralization in the institutional context and the elements of the actor context did not affect the institutional change. The change of the police organization after the police bureau was found to be strongly influenced by the political elements of the structural context. In the future, the change of the police organization, such as the development of the autonomous police system, should reflect the institutional context such as the democratic ideology and the context of the actors such as citizens and frontline police officers.
