초록

60년 전인 1957년 6․25전쟁의 상처가 아물지 않은 어려운 여건 하에서 훌륭한 선배 학자들에 의해 한국형사법학회가 창립되어 오늘에 이르기까지, 형사법학회에 소속된 회원들은 우리나라 형법의 입법과 판결에 많은 기여를 하였다. 형사법학회 창립 이후 60년 동안 이룩된 일반법․기본법인 형법은 물론 특별형법의 제․개정과 대법원 판결의 발전은 선배와 동료 그리고 후배들의 땀의 결과라고 생각한다.
지난 60년의 전반 30년은 정부수립과 전쟁을 거치면서 사회의 안정과 발전이라는 국가적 목표를 달성하기 위해 형법의 보장적 기능보다는 보호적 기능․사회보전적 기능을 우선시한 측면이 있다. 특별형법의 범람은 바로 이러한 사실의 반증이며, 판례도 그 예외는 아니었다고 생각한다. 이후의 30년은 전반 30년에 대한 반성적 고려(?)에서 현대 형법의 가장 중요한 기능인 보장적 기능의 회복을 위해 노력해 왔다고 평가할 수 있다.
형법이 국가형벌권의 발동근거와 범위를 명확히 함으로써 국민의 자유를 보장하고 법익을 보호하며, 이를 통해 공동체 구성원들의 공존을 가능하게 하려면 지난 60년 동안 형사법학자들이 쏟아왔던 것 이상의 노력이 필요할 것이다. 개인적 법익에 대한 죄와 관련하여, 다음의 점을 언급하고자 한다.
첫째, 가치관의 변화와 과학․의료기술 등의 발전에 따른 형법의 대응전략에 대한 고민이 필요하다. 주지하는 바와 같이 인공지능(AI)이 눈부시게 발전하면서 개인적 법익에 대한 새로운 유형의 침해행위, 즉 로봇․자율주행자동차에 의한 인명사고, 드론․GPS에 의한 사생활과 개인정보의 침해가 이미 나타나고 있다. 또한 카톡․페이스북 등 사회관계망 서비스(SNS)가 폭발적으로 보급되면서 사이버공간에서의 명예훼손(모욕)․협박․강요․따돌림 등은 이미 현실세계에서의 피해를 능가하고 있다. 이에 대하여 효과적인 형법적 대처방법이 시급하게 강구되어야 한다.
둘째, 특별형법의 일반형법화를 실현하기 위한 연구와 노력이 더욱 요구된다. 이것은 형법학자들이 지속적으로 주장하여 왔으나 여전히 실현되지 않고 있다. 다만 폭력행위 등 처벌에 관한 법률의 일부 규정을 정비하고 동시에 일부 범죄를 형법에 편입하여, 처벌의 공백을 방지하면서 형벌체계상의 정당성과 균형을 갖추도록 한 2016.1.6.의 형법개정(특수상해죄(제258조의2), 특수강요죄(제324조 제2항) 및 특수공갈죄(제350조의2)의 신설)이 그 가능성을 보여준다는 점은 고무적이다.
셋째, 형법은 형벌이라는 가장 강력한 수단을 사용한다는 점에서 제한적으로 해석되어야 할 당위성을 갖지만, 최후수단인 점에서 당벌적 행위를 형법의 그물에서 놓쳐서는 안 될 것이다. 즉 인간의 존엄과 가치에 근거한 개인의 자유와 권리를 최대한 보장하면서도 개인의 법익을 보호하고 사회의 공존을 유지할 수 있는 현명한 입법과 해석 및 적용은 아무리 강조하여도 지나치지 않다.

영어초록

The Korean Criminal Law Association was founded in 1957, in difficulties even before the scars of Korean war was recovered. From time the Association started by the great seniors to this day, members of the Korean Criminal Law Association have contributed toward legislations and judgements in many ways. The result of everyone’s hard work shows big improvement not only in criminal law: general and basic law, and special criminal law in legislations and amendments but also in judgements by the supreme court.




In the first half 30 years of past 60 years, protection function and preservation function have been on top of guarantee function to achieve the national goal; the stabilizing and developing our society after the long war and establishment of the government afterwards. Too many special criminal law regulations and also cases reflected this social atmosphere. On reflection of those years, for the latter 30 years, it is prioritized to normalize the guarantee function which is currently the most important function in criminal law.




Criminal law should protect people’s freedom and benefit by performing its role as legal basis of exercising national punishment and by clarifying its limit. Through the system it would be possible for members of our society to coexist and make harmony. To accomplish this it would be needed to put even further effort more than those scholars have contributed to criminal law for the last 60 years. I want to mention issues below regarding to crime of individual benefit and protection of the law.




First of all, it should be considered how the criminal law respond to those rapidly changing common values and also to development of science and medical technology. As we could easily recognize, artificial intelligence(AI) brought us into new emerging problem. New types of violation to individual benefit and protection of the law, for example, traffic accidents by robots, autonomous(land) vehicles, and invasion of privacy using drone and GPS device, became social issues. Moreover, numerous number of people in social network services(SNS) suffer from slander, libel, threat, coercion, bullying in cyber space and the damages far surpass those in real life. Effective countermeasures on the aspect of criminal law need to be urgently established.




Secondly, consistent efforts to gradually integrate special criminal law into general criminal law is strongly required. Scholars in Criminal Law have argued it for a long period of time but it still have long way to go. In recent years, some of articles including Special Bodily Injury(§258-2), Special Coercion(§324 ②), and Special Extortion(§350-2) in Punishment of Violences, etc. Act was amended and integrated into general criminal law in January 6, 2016. It is now possible to have justice and make balance in penalty system without a gap in punishment. It is inspiring that this progressive change shows potential for development.




Last but not the least, criminal law should be restrictively applied as it use punishment which is the strongest method to suppress crime, however, it is also important not to leave proper object for punishment without paying any penalty. The importance of proper legislations and applying to judgement cannot be emphasized enough not only to ensure individual’s right and freedom based on the dignity of human being but also to protect individual benefit and to keep coexistence of members of the community.
