헌법합치적 법률해석과 형벌법규 — 형법상 모욕죄의 해석ㆍ적용을 중심으로 — (The Principle of Constitutional Interpretation of Criminal Statutes)

초록

헌법합치적 법률해석은 법문의 범주 내에서 위헌적 해석과 합헌적 해석이 가능하다면 합헌적 결과에 이르는 해석방법을 채택해야 한다는 해석원칙이다. 기본권침해의 정도가 큰 형벌법규에 관하여 주로 논의된다. 재판소원이 명시적으로 인정되지 않은 우리 헌법재판제도에서 헌법재판소는 형벌법규의 해석에 개입하는 것을 주저하고, 법원에서는 보호법익을 지킨다는 취지에서 확대해석을 하는 경향이어서 헌법합치적 법률해석을 받아들이는데 소극적이다.
헌법재판소와 법원의 판례분석을 통하여 다음의 두 가지를 확인할 수 있다. 첫째, ‘죄형법정주의의 명확성 원칙’이라는 위헌심사기준과 법원의 ‘엄격해석원칙’의 관계에서 알 수 있듯이 헌법재판소의 위헌법률심사기준과 법원의 헌법합치적 법률해석은 밀접한 관계가 있다. 둘째, 기본권제한의 과잉금지원칙은 개별사안에서 형벌법규의 해석이 헌법상 기본권을 침해하는 경우에는 그 적용을 배제하는 방식으로 전환되는데 규범적 유형화를 통하여 하위원칙으로 정립될 수 있다.
헌법합치적 법률해석의 원칙에 따라 형법상 모욕죄를 해석하면, 형사법의 실무에서 모욕죄의 구성요건이 지나치게 넓게 확장해석되고 있음이 확인된다. 또한 모욕죄 성립의 한계와 관련하여, 공적 인물이론과 같은 표현의 자유와 관련된 헌법이론이 모욕죄 성립의 배제사유로 유형화될 수 있다.
헌법합치적 법률해석의 본격적 논의를 통하여, 헌법의 가치가 반영된 형법학(‘헌법적 형법학’이라고 부를 수 있겠다)이 새롭게 자리잡고, 헌법학과 형법학의 상호교류과정에서 관련 법리들이 정립되기를 기대한다.

영어초록

The principle of constitutional interpretation is a doctrine of interpretation that constitutional interpretation should be adopted, if it is possible to constitute unconstitutional or constitutional interpretation within the scope of the law. It is mainly discussed about criminal statutes that could violate fundamental rights seriously. In our Constitutional Court system, where the Constitutional complaint on judgement of the Court is not explicitly authorized, the Constitutional Court is hesitant to intervene in the interpretation of criminal statutes. On the other hand, the Court takes on a passive attitude in accepting the constitutional interpretation of the law because it tends to stretch the law in the name of protecting the legal interests.
Two points can be found through the analysis of cases of the Constitutional Court and the Court. First, as can be seen from the fact that ‘the clarity principle of nullum crimen sine lege (no crime without law)’, which is applicable to the standard of Constitutional Review is transformed to the Court’s ‘doctrine of strict interpretation’, the Consitutional Court’s Standard of Constitutional Review on statutes and the principle of constitutional interpretation of statutes of the Court has an inextricable connection. Secondly, the principle of the proportionality for the restriction of fundamental rights is converted into a way to exclude its application if the interpretation of criminal statutes violates fundamental rights in individual cases. It also can be established as a sub-principle through normative categorization.
According to the principle of constitutional interpretation of statutes, elements of insult law are too broadly interpreted in law practice. Besides, in relation to the limitation of insult law, constitutional theories on the freedom of expression, such as ‘public figure theory’ can be categorized into exclusionary factors of insult law.
Through the discussion of the constitutional interpretation of the law, I look forward to new development of criminal law studies by reflecting the value of the Constitution(which can be called ‘constitutional criminal law study’) and to the establishment of related theories by the mutual exchange between constitutional and criminal law studies.
