신용카드 부정사용의 문제점과 대책 - 사기죄 성립구조를 중심으로 - (The point and a measure against the Illegal Use of Credit Card - centering around the completion structure of fraud -)

초록

최근 신용카드의 대중화추세로 신용도 적용과 관계없이 카드를 발급하고 있어 사기범죄 유발 등 재산범죄를 부추기고 있는 실정이다. 또한 카드회사 상호간에 신용정보교환의 부족으로 카드를 이용한 부정행위의 발생빈도도 그만큼 증가하고 있다.
특히 신용카드의 사용이 일상화되면서 카드빚으로 인한 신용불량자가 급증하고 이로 인한 개인파산이나 동반자살 및 강도살인 등 반인륜적인 범죄를 저지르고 있는 등 사회적 문제로 대두되고 있다.
이러한 현상은 신용카드 발급상의 문제여파로 보고 부정사용에 따른 대처방안을 강구하고자 하였다. 카드회원 수를 늘리기 위해 신용카드를 남발하는 것은 곧바로 신용카드 연체의 증가로 이어져 부실채권의 축적을 방치하게 된다. 이에 사기죄의 성립구조 및 신용카드 사기죄 입법례를 비교함에 있어 판례를 원용하였다. 나아가 신용카드 사기범죄의 유형과 판례의 동향을 살펴보고 실질적인 대책을 제시하였다. 신용카드회사의 경우 1개월 이상 연체 시 카드사용을 중단시키고 연체상황을 고지하는 등으로 추가적인 연체의 부담으로 인한 범죄 유발을 방지하여야 한다. 신용조사 부실로 발급된 신용카드의 책임을 고객에게 돌려 형사처벌하는 식의 법제화는 개선되어야 한다.
예로서 신용카드 대금 등의 단기채무를 상환할 수 있는 제도의 운영주체는 신용회복위원회로 새로 도입한 제도이다. 이러한 신용회복지원제도는 일시적인 것으로 당장 폐지되어야 한다. 신용카드회사는 1개월 이상의 연체이자를 청구할 이유가 없다.
신용조사 강화를 위해서는 향후 자격기본법에 의한 형사중재인 자격을 제도화하여 이들이 신용조사에 적극 참여할 수 있도록 관련제도를 신설할 필요도 있다.

The credit card is comprised of the contract with card issuer and card holder. The card holder for purchases and offered to service in the merchant. It is composed of prepaid card, debit card, credit card on the settlement time-point. For the present, the credit card markets are driving according to VISA, Master Card, American Express, Diners Club, JCB.
Nowadays, credit card is considered an instrument of the payment or a token money with the EFTS(Electronic Fund Transfer System). And credit card is based on sound trading principles of a face to face transaction. KCCA(korea credit card association) was established for the advancement of the control of an association, but at present, it is incorporated into KCFA(korea credit finance association). The card issuer incites an offense of credit cards without reference to an application of credit rating. The number of Americans late in making their credit card payments jumped sharply. Americans continue to use their credit cards for purchases and cash advances at record levels. They established consolidation of theft crimes according to the latest government figures as well.
Finance crime is acted as the object of finance company, but investigation on finance fraud has to rely on investigating authorities like general crime.
For most credit card issuers, bankruptcy filings are written off as uncollectable within 60 days to comply with regulatory guidelines and a measure of regulation of card issuers. This study aims at dealing with the problem of fraud provision. First, whether the withdrawal of cash through ATM machine by using stolen or robbed credit card constitutes 'computer fraud' or 'theft'. and believe me, card issuers wrote off substantially more bad loans, the debt rating company. the measure of credit card fraud, Another top scam used to reel in victims, phishing. At the end of the transaction, refresh or reload the web page and clear the memory and disk caches to remove credit card information from your computer and browser.
