초록

소위 상품형태 모방금지 규정(자목)은 1993년 일본이 입안한 것을 우리가 일본법을참고해 2004년 입법화한 규정으로 특별한 개정 없이 유지되고 있다. 대응 규정으로 EU 에는 미등록디자인 보호규정이 있다. 최근 형태모방이 특허청의 특별사법경찰권에 의한행정조사의 대상이 되면서 특허청의 가이드라인도 등장하는 등 그 중요성이 재부각되고있다. 그러나 여전히 본 규정의 위상이나 본질에 대한 이해가 부족하고 판단방법이나 기준도 확립된 것으로 볼 수 없다. 최근 일련의 대법원 판결이 등장하면서 이제 합리적 해석을 통하여 우리 고유의 법리형성을 시도할 단계에 와 있다. 동시에 입법론적인 과제도안고 있는 조항이어서 해석의 기준을 잡을 수 있는 본질에 대한 고찰도 필요하다. 이에본 연구는 먼저 인접 규정과 타 입법례와 비교를 통해 (미등록) 상품디자인 보호에 있어<자목>의 성격과 위상 등 규정 본질에 관한 사항을 먼저 짚어 보면서 이를 토대로 그 적용요건과 판단방법 전반의 체계를 다시 한번 점검해 보기 위해 3개의 대법원 판례와 국내 하급심 판례를 중심으로 규정해석 전반을 고찰해 본 것이다. 동시에 본호의 적용요건을 청구주체, 보호대상의 범위나 범주와 관련된 상품형태성의 적극적 요건과 소극적 요건(통상가지는 형태, 보호기간 제한)으로 나누어 고찰하되 논란이 되어온 세부적 쟁점을가급적 종합적으로 논의해 보았다. 마지막으로 타 입법례와의 비교를 통해 입법론적 문제점과 개정의 방향성도 제시해 보았다.

영어초록

The so-called ‘product configuration Imitation prohibition regulation’ (Item ZA) is a regulation enacted by Japan in 1993 with reference to Japanese law and legislated by Korea in 2004, and is maintained without any special amendments. As a corresponding regulation, the EU has an unregistered design protection regulation.
Recently, as product configuration imitation became the subject of administrative investigation by the special judicial police authority of the Korean Intellectual Property Office, the Korean Intellectual Property Office's guidelines also appeared, and its importance is being emphasized again. However, the understanding of the status or essence of this regulation is still insufficient, and the judgment method or standard cannot be regarded as established one. With the recent appearance of a series of Supreme Court rulings, we are now at the stage of trying to form our own jurisprudence through rational interpretation. At the same time, it is a provision that also has legislative issues, so it is necessary to consider the nature of the provision to set the standard for interpretation. Therefore, in this study, first, by comparing adjacent regulations and other legislative cases, we first look at matters concerning the nature and status of <Item ZA> in the protection of (unregistered) product designs, etc. In order to review the rules once again, the overall interpretation of the regulations was reviewed, focusing on the three Supreme Court precedents and the domestic lower court precedents. At the same time, the application requirements of this subparagraph were divided into active and passive requirements ; the later such as normal form, limited period of protection, and the former such as related to the subject of claim and the scope or category of the object of protection.
Finally, by comparing with other legislative cases, the problems of legislative theory and the direction of the revision were presented.
