초록

극단주의 테러조직 이슬람국가(IS)를 찬양하는 활동을 하며 단체 가입을 선동한 혐의로 기소된 시리아인에게 무죄를 선고한 원심이 대법원에서 파기됐다.
대법원에서는 자신이 운영하는 인터넷 페이스북 계정에 이슬람국가(Islamic State, 이하 ‘IS’라 한다) 및 그 계열 테러단체를 찬양하는 등의 게시물을 게재하고, 그 게시물을 보고 IS에 호감을 가지는 사람들이 곧바로 IS 대원과 1:1 대화를 할 수 있는 텔레그램 대화방 링크를 게재하는 방법으로 다수의 사람들이 IS에 가입하도록 선동하기로 마음먹고, 페이스북에 국제연합(UN)이 지정한 테러단체인 IS의 사상을 찬양하는 글과 동영상을 올리고, 불상의 IS 대원과 직접 대화할 수 있는 링크를 게시하는 방법으로 불특정 다수로 하여금 IS에 가입할 수 있도록 선동했다는 공소사실로 기소된 사안에서, 피고인이 게시한 글과 영상은 정치적 목표 또는 이념을 선전, 홍보하는 대상이 테러단체 IS로 특정되어 있을 뿐만 아니라, IS 또는 IS 대원들을 보호하고 승리하게 해 달라는 기도 글, IS의 특정한 기념일을 들어 그들의 투쟁심과단결심을 강화하는 효과를 도모하는 것으로 볼 여지가 있고, 더욱이 피고인은 IS의 선전매체인 아으마끄 통신(Amaq Agency) 명의 계정의 텔레그램 링크를 게시하였는데, 이러한 피고인의 글과 영상 및 선전매체 명의 계정의 텔레그램을 링크하는 행위는, 테러 또는 테러단체의 활동에 대한 단순한 지지, 찬양, 동조를 넘어 특정 테러단체인 IS에 가담·동참하는 행위를 고무하는 취지로 이해될 가능성이 있음에도, 피고인이 테러단체 가입을 선동했다는 공소사실을 무죄로 본 원심판단에 법리오해 등의 잘못이 있다고 판시하였다.
우리나라에도 테러가 발생할 수 있다는 내용을 암시하는 판결이라고 볼 수 있다. 이미 2022년 국가정보원의 자료에 따르면 국내 체류 일부 무슬림들이 테러자금 모금, 극단주의 사이버 선전에 동조 행위가 지속적으로 늘어나고 있으며, 정부는 테러단체에 자금을 지원한 러시아･중앙아시아인(5명)을 구속 기소하고, 테러단체 추종･자금 지원 혐의자를 강제 퇴거 하는 등 테러 단체 사이버 공간 선전 활동 단속을 강화하고 적발 건수도 증가하고 있는 추세이다.
2023년부터 현재까지 북한의 오물풍선과 사이버해킹･기간 시설 공격 등 주체 은폐형 테러 가능성이 지속적으로 늘어나고 있으며 특히 군사도발 및 대북 비방과 연계한 사이버 공격 대북제재 장기화로 인한 자금난 해소를 위한 가상 자산 거래소 해킹, 유명 탈북민과 대북 활동가를 겨냥한 테러, 무인기와 드론을 이용해 정보 획득과 테러위헙은 지속적으로 증가하고 있다. 이는 향후 우리도 북한의 지속적인 테러공격에 대응책을 마련하여야 하고 특히 IS의 테러에도 대비하여야 한다.
이에 따라 대법원은 5년 넘게 이번 사건을 심리한 후 ‘테러단체 가입 선동 부분’에 대해 파기환송을 했다. 따라서 향후「국민보호와 공공안전을 위한 테러방지법(약칭:테러방지법)」과 관련하여 지속적인 연구와 판례의 분석이 필요하다.

영어초록

The Supreme Court overturned the lower court's acquittal of Syrians accused of inciting membership of the extremist terrorist group Islamic State (IS). The Supreme Court decided to instigate a large number of people to join IS by posting posts such as praising the Islamic State (hereinafter referred to as "IS") and its affiliated terrorist groups on its Internet Facebook account, and posting a link to a Telegram chat room where people who like IS can immediately have a 1:1 conversation with IS members after seeing the posts, and posting articles and videos praising the idea of IS, a terrorist group designated by the United Nations, on Facebook and posting links to directly talk to IS members of the Buddha statue. In the case of prosecution, the articles and videos posted by the accused are not only specific to the terrorist group IS, but also to promote and promote political goals or ideologies, as well as to protect and win IS or its members, and to strengthen their fighting spirit and unity, including certain anniversaries of IS. Moreover, the accused posted a Telegram link to the account under the name of Amaq Agency, a propaganda medium of IS, which posted the accused's writings and videos and the Telegram of the account under the name of the propaganda medium Although the act of linking is likely to be understood to encourage participation and participation in IS, a specific terrorist group, beyond mere support, praise, and sympathy for terrorism or terrorist group activities, it was judged that the lower court's judgment, which found the defendant not guilty of inciting the defendant to join a terrorist group, was guilty of misunderstanding of the law. It can be seen as a ruling suggesting that terrorism can occur in Korea. According to data from the National Intelligence Service in 2022, some Muslims staying in Korea are continuously increasing their activities to raise funds and sympathize with extremist cyber propaganda, and the government is strengthening its crackdown on cyber space propaganda activities by arresting and prosecuting five Russians and Central Asians who provided funds to terrorist groups, and forcibly evicting those suspected of following and funding terrorist groups. From 2023 to the present, the possibility of self-concealing terrorism, such as North Korea's filth balloons, cyber hacking, and key facility attacks, is constantly increasing. In particular, virtual asset exchange hacking to resolve financial difficulties caused by prolonged cyberattacks related to military provocations and slander against North Korea, terrorism targeting famous North Korean defectors and activists, and information acquisition and terrorism using drones and drones are constantly increasing. In the future, we must prepare countermeasures against North Korea's continuous terrorist attacks and, in particular, prepare for terrorist attacks by IS.
Accordingly, after hearing the case for more than five years, the Supreme Court reversed and returned the 'incitement to join a terrorist group'. Therefore, continuous research and analysis of precedents are needed in the future regarding the Anti-Terrorism Act for the Protection of the People and Public Safety (abbreviated as the Anti-Terrorism Act).
