초록

자연재난과 사회재난의 발생 빈도가 늘고 피해 규모가 커지면서 세계 각국은 ‘재난의 일상화’를 경험하고 있다. 재난대응을 위한 개인정보 활용은 점점 많아지고 있고 이에 따라 개인정보 보호의 필요성도 함께 증가하고 있다. 그러나 개인정보의 활용과 보호에 대한 각국의 제도적 대응은 동일하지 않고 국민 개개인의 인식 또한 같지 않다. 이 연구는 개인정보의 보호와 활용간의 균형에 대한 사회적 인식의 차이가 만들어지는 요인을 밝히고, 이를 토대로 개인정보의 보호와 활용이 균형을 이루도록 하기 위하여 어떠한 정책적 방안들이 필요한가를 살펴보았다.
연구 결과, 개인정보의 보호와 활용 간에 존재하는 상호의존적 관계 이외에도, 재난에 대한 경험, 문화적 가치, 기술 발전 등의 다양한 요인들이 개인정보 활용과 보호에 대한 개인과 사회의 반응을 결정짓는 것으로 보인다. 우리나라의 경우 공동체의 목적이 개인 권리보다 중요하게 인식되고 있으며, 그에 따라 우리나라의 법률들은 개인정보 보호를 위한 제도화 수준이 매우 높으면서도 동시에 개인정보의 적극적 활용을 가능하게 하는 다양한 예외규정들이 개별법에 존재하는 상황이라고 볼 수 있다. 이 연구는 전문가 대상의 계층분석방법(AHP) 조사를 수행하여 개인정보 활용과 보호라는 두 개의 가치가 균형적으로 발전할 수 있는 다양한 정책대안들을 도출하고자 하였다.

영어초록

The escalating frequency and magnitude of both natural and societal disasters, exacerbated by the climate crisis, have led most countries to undergo the 'normalization of disasters.' Consequently, there is an increased emphasis on governments’ responsibility for proactive prevention and preparedness for disasters, as well as the post-event management of recovery and response. Moreover, the pervasive trend of utilizing personal information throughout the entire disaster management process, coupled with the advancements in information and communication technology, is globally observable. The advent of the COVID-19 pandemic has further catalyzed the explosive expansion of digital device utilization in the context of the contactless environment. However, within the global phenomena of the COVID-19 pandemic as a common infectious disease disaster, there exists substantial variation amongst countries regarding the utilization and protection of personal information, as well as the safeguarding of the rights of information subjects.

This study aims to systematize an explanation of the differences in attitudes and perceptions regarding personal information in the disaster management process. Specifically, beyond the interdependent relationship between these two values(i.e. privacy protection vs. public safety), various factors such as individual experiences with disasters, cultural value orientations, disaster management utilizing ICTs, and the processing of personal information could determine the responses of nations, societies, and individuals to the degree of personal information utilization. In addition, an examination of the legislation in South Korea governing the management of disasters and personal information seems to be undertaken to understand how the utilization and protection of personal information are stipulated and whether conflicts and tensions exist among these laws. The study further investigates the challenges faced by frontline disaster officials due to these regulations.
