성폭력처벌법 제14조를 기반으로 한 디지털성범죄의 합리적 대응방안 연구 (A Study of Rational Countermeasures against Digital Sex Crimes: Focus on Article 14 of Act on Special Cases concerning the Punishment, Etc. of Sexual Crimes)

초록

최근 ‘조주빈 n번방 사건’의 문제가 젠더폭력의 문제임을 사회적으로 각인시켰다. 현재 문재인 정부는 디지털성범죄 관련 대응방안이 범정부 차원에서 이루어지고, 규제의 공백을 메우기 위한 입법과 방안들이 마련되고 있다. 기술의 발전과 그에 따른 신종 범죄를 처벌하기 위한 입법의 마련과 대응방안은 디지털성범죄가 여성에 대한 폭력이자 범죄라는 점을 상기시키기 위해 반드시 필요한 과정이다. 또한 대응방안의 불비와 범죄자에 대한 처벌의 경미는 법 제도의 미비뿐 아니라 법 집행 과정의 문제, 사회 전반의 문화적 문제이기도 하다. 본고는 디지털성범죄 중 「성폭력처벌법」 ‘제14조(카메라 등을 이용한 촬영)’의 분석대상을 중심으로 하여, 불법 촬영 및 불법 촬영물 등의 유포에 대한 범죄수사, 정보삭제의 대응정책에 관한 객관적 문제점과 이에 대한 합리적 대응방안에 대해 모색해 보았다. 따라서 불법 촬영물 등의 유포방지를 위한 범죄수사 및 정보삭제의 합리적 대응방안을 제시하면 다음과 같다. 첫째, 불법 촬영물 등을 온라인상에 유포한 자에 대하여 「성폭력처벌법」의 엄격한 적용, 초동수사 강화, 해외 웹사이트를 통한 유포자에 대한 적극적 수사가 필요하며, 「성폭력처벌법」의 적용대상을 확대하는 입법방안의 마련이 필요하다. 둘째, 불법 촬영물 등에 대한 심의 절차를 축소하고, 불법 해외 웹사이트에 대한 접속차단 기술을 개선할 필요가 있으며, 불법 촬영물 등의 유포를 차단하기 위해 「성폭력처벌법」 상에 국내ㆍ외 플랫폼 사업자의 책임을 강화하는 입법방안을 마련할 필요가 있다. 나아가, 이에 불법 촬영물 등의 유포방지를 위한 범죄수사 및 정보삭제의 합리적 입법방안을 제시하면 다음과 같다. 첫째, 본인이 자신의 신체를 촬영한 촬영물의 유포를 성폭력으로 처벌할 필요가 있고, 스마트폰 등 휴대용 단말기 또는 컴퓨터로 다운로드받은 자도 처벌하도록 하여 불법 촬영물 등의 유포를 원천적으로 방지할 필요가 있다. 둘째, 온라인서비스제공자에게 불법 촬영물 등을 발견하고 삭제하거나 전송을 방지ㆍ중단할 의무를 부과하고, 이를 해태한 경우에 책임을 물어, 불법 촬영물 등의 유포를 원천적으로 차단할 필요가 있다. 셋째, 「성폭력처벌법」 제14조에서 정한 형에 해당하는 범죄를 목적으로 하는 단체 또는 집단을 조직하거나 이에 가입 또는 그 구성원으로 활동한 사람을 그 목적한 죄에 정한 형으로 처벌하도록 하여, 불법 촬영물 등의 유포를 원천적으로 대응할 필요가 있다.

영어초록

Recently Cho Jubin’s ‘the Nth Room’ incident has socially imprinted the gender violence problem. The Moon Jae-in government is currently preparing countermeasures against digital sexual crimes at the government level, and is developing legislations to fill the gaps of the regulations. Advances in technology and the establishment of legislation and countermeasures to punish such new crimes are a necessary process to recognize that digital sex crimes are both violent and crimes against women. In addition, insufficient preparation of countermeasures and lenient punishment against criminals indicates not only a lack of the legal system, but also a problem in the process of law enforcement and cultural issues in society as a whole. The current study examines the subject of analysis in Article 14 (Shooting using cameras, etc.) of the Act on Special Cases Concerning the Punishment, ETC of Sexual Crimes (“the Act”) among digital sexual crimes in order to find out rational and objective countermeasures against illegal shooting and distribution of such illegal photographs and deletion of information, and so on. Therefore, the rational countermeasures of crime investigation and information deletion to prevent the distribution of illegal photographs are presented as follows. First, it is necessary to strictly apply the Act to those who have distributed illegal photographs in the online, and reinforce the initial investigation and an active investigation against the distributor who distributed such illegal photographs throughout overseeing websites, and a legislation to expand the subjects of the Act is required. Second, a legislation is required to reduce the process of reviewing illegal recordings, improve the technology to block access to illegal oversee websites, and strengthen the responsibility of platform operators at home and abroad under the Act to prevent spread of illegal recordings. Furthermore, this study presents the rational legislation of crime investigation and information deletion to prevent the distribution of illegal photographs as follows. First, it is necessary to punish the person who has taken his or her own body for the purpose of distribution as sexual violence, and it is also necessary to punish the person who downloaded such illegal files by a portable terminal such as Smart phone or computers in order to fundamentally prevent the spread of illegal photographs, and so on. Second, it is necessary to impose an obligation to prevent and stop the transmission or detection of illegal recordings to the online service providers, and in the event of negligence, it is necessary to hold them responsible to fundamentally block the distribution of illegal recordings. Third, it is also necessary to punish those who organized a group for the purpose of crime or subscribe such group to act as a member by the punishment as set for such crime to prevent distribution of such illegal recordings fundamentally.
