초록

이 논문은 식민지시기 가족법에 내재된 불평등한 여성의 지위가 관습 왜곡이라는 측면보다는 젠더 질서 확립 과정의 결과였다는 점에 초점을 맞춘 연구이다. 젠더의 작동을 역사적으로 추적하는 것은 남성과 여성이라는 범주가 특정한 역사적 국면 안에서 정치적으로 구성되는 것임을 알려준다. 본 연구가 식민지 조선의 젠더 질서의 구축이라는 점에 초점을 맞추어 가족과 관련된 관행들이 법제화 되어 가는 과정과 그 내용을 추적하려는 이유도 여기에 있다. 이를 위해 일본인 사법관료가 조사한 조선의 가족 관련 관습은 무엇이며, 그것은 가족법에 어떻게 반영되었는가. 또한 유교와 일본 가족법은 조선의 가족법에 어떤 작용을 했을까 등이 검토되었다. 이러한 과정을 통해 일본인 법률가들이 가지고 있던 지식, 즉 일본의 가족법과 유교가 조선의 관습을 파악하는 주요한 인식틀로 작용하였다는 점, 그러나 이 양자는 분리된 것이기 보다는 오히려 일본 민법에 내재된 젠더 질서를 구축하는 기제로 유교의 젠더 규범이 이용되었다는 점, 가족과 관련된 조선의 관행들이 법으로 제도화된다는 것은 젠더 질서가 재구축되는 과정 그 자체였다는 점을 확인할 수 있었다.

영어초록

The present study starts from the presupposition that the unfair status of women found in the colonial family law had more relevance with the establishment of gender regime than the thwart of Korean traditional customs. To trace historically the process in which gender regime came into play demonstrates how it brought about the constitution of the category of man and woman in a given phase of the time. From this understanding, the present study focuses on the construction of gender regime in the colonial period of Korea. It analyzes the processes in which customs related to family matters had been legalized and subsequently what sort of outcome the process had resulted in. It studies which sort of family customs judicial colonial officials from Japan took interests and acted out to research; in turn how those research outcomes had been reflected back into the establishment of the Korean family law: especially how Confucianism and the Japanese family law had affected the legislation of the relevant laws of colonial Korea.
In conclusion, the paper shows that the Japanese legalist conceptions, mainly based upon the Japanese family law and Confucius teachings, had worked as a conceptual framework when they dealt with the customs in colonial Korea. The two key factors were closely entangled with each other. Confucius gender norms had been adopted and employed for the construction of gender regime in Japanese civil law. Afterwards, the same process is observed to have set in motion in Korea as well. The development of family-related customs had been legalized. This means that the construction of gender regime had started and had come into play, likewise, in Korea.
