초록

이 논문의 목적은 조중조약의 전문(preamble)과 제1조를 중심으로, 조중조약의 성격과 의미, 그리고 현재적 함의를 명확히 파악하는데 있다. 우선, 이 논문은 전문(前文)과 제1조 및 ‘자동개입’(Automatic intervention) 조항을 중심으로, 조중조약과 중소조약(The Sino-Soviet Treaty of Friendship, Alliance and Mutual Assistance), 중몽조약(Sino-Mongolia mutual aid and friendship treaty), 그리고 조소조약(Soviet-North Korean mutual aid and cooperation friendship treaty) 등과의 비교를 시도했다. 다음으로, 이 논문은 조중조약이 체결된 상황적 맥락인 중소분쟁에 주목했다. 특히, 중소분쟁 와중에 공산주의 정당들이 잠정 합의한 1957년 『모스크바선언』(Moscow Declaration of 1957)과 1960년 『모스크바성명』(Moscow Statement of 1960)의 내용과 이것이 조중조약에 어떻게 반영되었는지를 확인했다.
결과적으로, 조중조약의 전문에서는 조중관계를 수직적인 당제관계(inter-party relation)를 우선시 한 조소조약의 전문과 달리 수평적 관계로 규정했고, 조중조약의 제1조는 대미 데탕트와 진영간 ‘평화적 공존’을 전제로 한 조소조약과는 차별화된 미국에 대한 위협인식을 공유하는 내용으로 구성되었다. 즉 조선은 중소분쟁을 활용해 국가안보의 보장과 더불어, 중국과의 수평적 관계를 법적으로 명문화시켰다. 이러한 경험은 현재 중미간 협력과 갈등이 교차하는 현실에서 조선이 비교적 유연하게 대처할 수 있는 가장 큰 자산이며, 조중조약의 전문과 제1조에 대한 재조명이 주는 현재적 함의로 볼 수 있다.

영어초록

This paper aims at analyzing the nature, meaning and current implication of the Sino-North Korean mutual aid and cooperation friendship treaty with its preamble and the first article. This paper tries to compare ‘the Sino-North Korean mutual aid and cooperation freindship treaty’ with ‘the Sino-Soviet Treaty of Friendship, Alliance and Mutual Assistance’, ‘the Sino-Mongolia mutual aid and friendship treaty’ and ‘the Soviet-North Korean mutual aid and cooperation friendship treaty.’ And then this takes note on the ‘Sino-Soviet split’ which was the situational context concluded a treaty(Sino-North Korea). Especially, This paper analyzes how the ‘Moscow Declaration of 1957’ and the ‘Moscow Statement of 1960’ made by the communist parties in the vortex of the ‘Sino-Soviet split’ reflected them in the ‘Sino-North treaty.’ As the final result, the preamble of the ‘Sino-North treaty’ defined the ‘Sino-North Korean relations’ as the horizontal one, which was differentiated with that of the ‘Soviet-North Korean treaty’ defined the relations between Soviet and North Korea as the vertical one focused on the inter-party relation. Also, the first article of ‘Sino-North treaty’ shared anti-imperialism against the USA, which was also differed from that of the ‘Soviet-North Korean treaty.’ Finally, North Korea made a stipulation the horizontal relations with the China legally as well as getting the national security. This experiences are the important assets for North Korea in the cross the cooperations and the conflicts between USA and China. North Korea can deal with them in flexible. This is the current implication given by re-analyzing the preamble and the first article of the ‘Sino-North Korean mutual aid and cooperation friendship treaty.
