헌법 제11조와 공무 공무원 여비규정의 차별적 내용에 대한 연구 (A Study on the Discriminatory Contents of Article 11 of the Constitution and the Travel Expense Regulations for Public Officials)

초록

대한민국헌법 제11조에는 모든 국민은 법 앞에 평등하며 정치・경제・사회・문화 등 모든 영역에서 차별을 받지 않도록 규정하고 있다. 국가에서는 공무원의 원활한 공무 수행을 위하여 공무원 여비에 관한 사항을 대통령령으로 규정하고 있다. 그러나 대통령령으로 제정된 공무 공무원 여비규정에는 공무원의 구분에 따라 여비 지급을 차별하여 실시하고 있다.
개인의 기본적인 욕구인 의・식・주 중 먹고 자는 식・주에서 국가공무원의 구분에 따라 국외 여비계산 규정에서 현격한 차이를 두고 여비를 지급하고 있다. 국가를 위한 공무원의 공무임에도 불구하고 대통령령으로 제정된 여비규정에서 차별을 받고있는 부분에 대한 개정이 필요할 것으로 사료 된다. 여비규정의 개정이 필요한 사항으로는, 첫째, 공무원 여비규정 제3조 여비의 지급 구분의 별표1에서 공무원의 구분을 제1호와 제2호로 구분 되어 있는 것을 삭제하고, 모든 공무원의 구분을 하나로 통일하는 방안이다. 공무원 여비규정의 여비 지급 구분표상의 공무원 구분은 제1호에서 가, 나, 다, 라 구분과 제2호로 총 5단계로 구분하고 공무원 여비를 차등 지급하고 있다. 그러나 공무원은 지위나 직책에 따라 봉급과 수당을 이미 차등 지급하고 있으며, 공무원의 공무는 국가를 위한 일이며, 국민에게 봉사하는 업무로서 여비규정은 공무원의 구분을 하나로 통일하는 것이 바람직하다고 본다.
둘째, 공무원 여비 규정 중 국외 여비 지급표 상의 일비, 숙박비, 식비 지급을 공무원 구분에 따라 금액의 차이를 크게하여 차등 지급하고 있는 것을 삭제하고, 금액의 차이를 비슷하게 지급하는 방안이다. 국외 여비는 미국의 달러로 지급하고 있으며, 공무원의 구분에서 제2호에 해당하는 공무원은 국외에서 사용되는 비용이 때로는 여비규정에서 정하고 있는 금액보다 많이 나올 수 있는 요소가 발생할 수 있기 때문에 제1호의 가목에 있는 공무원과 차이를 비슷하게 하여 지급하는 방안을 제시 한다.
셋째, 해외에서의 국내인에 대한 인질납치 등 국가적으로 중요하게 이슈가 되는 상황에서의 공무원의 공무 수행에 대한 특별 여비규정이 공무원에게 신설되어야 한다. 위와 같은 경우에는 공무원 여비규정의 제1호와 제2호 공무원이 같이 출동하는 것이 일반적이며, 같은 업무를 수행하게 되는데 추후 여비를 지급받는 경우에는 큰 차이가 발생하고, 또한 공무를 수행하는 공무원이 실제 사용한 금액보다 적게 지급 받는 경우도 있어 공무임에도 불구하고 개인의 비용이 사용되는 경우가 발생할 수 있어 이에 따른 여비규정의 신설이 필요하다.
대한민국 국민이 되는 것은 법률로 정해지고, 공무원은 봉사자이며, 국민을 책임지고 있는 만큼, 국가에서는 공무원의 구분에 따라 차등 지급하는 여비규정을 삭제・수정하여, 공무원이 공무를 수행하고 실제 사용된 비용에 대해서는 모두 지급하는 것이 인간이자 공무원으로서 가치를 가지며 행복을 추구할 권리가 되는 것이다.

영어초록

Article 11 of the Constitution of the Republic of Korea stipulates that all citizens are equal before the law and that they are not discriminated against in all areas including politics, economy, society, and culture. In order for public officials to perform their official duties smoothly, the State stipulates matters related to travel expenses of public officials by Presidential Decree. However, in the travel expenses regulations enacted by the Presidential Decree, travel expenses are paid differently according to the classification of public officials.
According to the classification of national officials from the basic needs of individuals, such as clothing, food, and meals, meals and weeks, travel expenses are paid with a marked difference in the rules for calculating overseas travel expenses. It is considered necessary to revise the part that is discriminated against in the travel expenses regulations enacted by the Presidential Decree, despite the fact that it is a public service for the state.


The matters requiring revision of the travel expenses regulations include:

First, it is a plan to unify the classification of all civil servants by deleting the classification of civil servants as No. 1 and No. 2 in Attached Table 1 of the classification of travel expenses in Article 3 of the Travel Expense Regulations for Public Officials. In the travel expenses payment classification table of the Travel Expenses Regulations, the civil servants are divided into 5 stages in subparagraph 1 to A, B, C, D, and subparagraph 2, and the travel expenses for civil servants are differentially paid. However, civil servants are already paying different salaries and allowances according to their position or position, and it is desirable to unify the classification of public officials in the travel expense regulations as their official duties are for the state and serve the people.


Second, it is a plan to remove the difference in payment of daily expenses, lodging expenses, and meals in the overseas travel expense payment table by increasing the difference in the amount according to the classification of public officials, and pay the difference in the same amount. Overseas travel expenses are paid in U.S. dollars, and for public officials who fall under subparagraph 2 in the classification of public officials, the expenses used abroad may sometimes occur more than the amount stipulated in the travel expenses regulations. Third, special travel expenses regulations should be newly established for public officials to perform official duties in situations of national importance, such as the abduction of domestic citizens abroad. In the above case, it is common for public officials No. 1 and No. 2 of the Travel Expense Regulations of Public Officials to go together and perform the same work, but there is a big difference in the case of receiving travel expenses in the future. In some cases, the amount paid is less than the amount actually used, so personal expenses may be used even though it is a public service, so a new travel expense regulation is needed.


As it is stipulated by law to become a citizen of the Republic of Korea, public officials are volunteers, and public officials are responsible for the people, the government has deleted or amended the travel expenses regulations that differentially paid according to the classification of public officials, so that public officials perform official duties and are actually used. Paying all of them is the right to pursue happiness with value as a human being and a public official.
