TEU 제50조에 따른 회원국의 EU 탈퇴에 관한 법적 쟁점 (Legal Issues Concerning the Withdrawal of EU Member States under Article 50 TEU)

2016년 6월 23일, 영국의 유럽연합(EU: European Union) 탈퇴에 관한 국민투표(Brexit=Britain+Exit)에서 영국민들은 브렉시트에 찬성했다. 이 결과에 따라 2020년 1월 31일 마침내 영국은 EU에서 공식 탈퇴하였으며, 기본조약상의 근거는 유럽연합조약(TEU) 제50조 2항이다. 동조에 따르면, 회원국 정부가 EU 탈퇴에 관한 의사를 유럽이사회에 공식적으로 통보한 날로부터 탈퇴 절차가 개시된다.
그런데 영국의 EU 탈퇴과정에서 주목해야 할 사항 중의 하나가 있는데, 바로 ‘유럽의회의 동의절차’이다. 영국과 EU 양측 간에 브렉시트에 관한 협상이 타결되고, 최종협정이 채택되기 위해서는 반드시 유럽의회의 동의절차를 거쳐야 한다. 유럽의회의 동의절차는 유럽이사회가 탈퇴협정을 최종적으로 체결하기 위한 전제조건인 셈이다.
브렉시트 과정에서 TEU 제50조 2항의 해석과 적용을 둘러싸고 적잖은 논의가 야기되었다. 동조는 탈퇴절차의 기본요소에 대해서만 정하고 있을 뿐 탈퇴협정의 성격이 무엇인가에 대해서는 아무런 명확한 규정을 두고 있지 않기 때문이다.
TEU 제50조 1항에 의하면, EU로부터 탈퇴를 원하는 모든 회원국은 “그 헌법상의 요건에 따라” 탈퇴 여부를 결정할 수 있다. 동조의 해석과 관련하여 EU 탈퇴는 회원국의 ‘일방적’ 행위인가 여부를 둘러싸고 많은 논란이 제기되었다. 탈퇴협정도 국제협정인 이상 유럽연합기능조약(TEEU) 제218조 3항에 따라 교섭되고, 체결되어야 하며, 유럽의회의 동의절차를 거쳐야 한다. 하지만 유럽의회 동의권의 대상과 범위는 어디까지인가를 둘러싸고 EU당국과 영국 정부의 이견이 표출되었다. 브렉시트는 EU 초유의 사태이므로 이에 관한 법리가 확립되지 않고 있다. 따라서 본고에서는 TEU 제50조에서 정하고 있는 유럽의회의 동의권의 법적 성격과 주요 쟁점에 대해 분석하고자 한다.

영어초록

On 23 June 2016, the British people voted in favor of Brexit in a referendum on Britain's exit from the European Union. According to this result, on January 31, 2020, the UK finally left the EU, and the basis for the Basic Treaty is Article 50 Paragraph 2 of the European Union Treaty (TEU). Based on this Article, the withdrawal procedure begins on the day the Member State government officially informs the European Council of its intention to leave the EU.
However, there is one thing that should be noted in the process of Britain leaving the EU, and that is the ‘consent procedure of the European Parliament(EP)’. In order for the negotiations on Brexit to be concluded between the UK and the EU and the final agreement to be adopted, it must go through the process of consent of the EP. The consent procedure of the EP is a prerequisite for the European Council to finally conclude the withdrawal agreement.
During the Brexit process, considerable debate arose over the interpretation and application of Article 50 Paragraph 2 of the TEU. This Article only sets out the basic elements of the withdrawal procedure and does not provide any clear provisions on the nature of the withdrawal agreement.
According to Article 50(1) of the TEU, any Member State wishing to withdraw from the EU may decide to withdraw from the EU “in accordance with its own constitutional requirements”. Concerning the interpretation of this Article, many controversies have been raised as to whether the EU withdrawal is a 'unilateral' act of member states. As long as the withdrawal agreement is an international agreement, it must be negotiated and concluded in accordance with Article 218 (3) of the Treaty on the Functions of the European Union(TFEU), and must go through the process of consent of the EP. However, differences between the EU authorities and the British government were expressed over the subject and scope of the EP's right to consent. Since Brexit is a unique event in the EU, there has been no established legal framework for it. Therefore, this paper intends to analyze the legal nature and major issues of the EP's right to consent under Article 50 of the TEU.
