헌법 제119조 경제질서와 경제민주화에 관한 법적 쟁점 (Legal Issue on Economic Order and Economic Democratization Provided for in Article 119 of Constitution of the Republic of Korea)

초록

이 논문은 헌법 제119조의 경제질서와 경제민주화에 관한 법적 논의를 해석론적 관점과 입 법론적 관점에서 분석한 것이다. 주지하는 바와 같이 경제란 모든 사람의 필요를 충족할 수 없 는 한정된 자원을 어떻게 배분할 것인가의 문제이다. 자원배분의 주된 역할을 국가가 할 것인 가 아니면 시장이 할 것인가에 따라 이념적 스펙트럼의 양끝에는 자본주의 경제체제와 사회주 의 경제체제가 위치하게 된다. 우리 헌법의 경제질서를 둘러싸고 그동안 우리 헌법학계에서 사 회시장적 경제질서, 혼합경제질서, 경제질서의 중립성론으로 구분하여 활발히 논의하여 왔다. 같은 맥락에서 헌법 제119조 제1항과 제2항과의 관계를 둘러싸고 다양한 논의가 있다. 여기서 는 우리 헌법은 자유시장경제에 주안점을 두고 예외적‧보충적으로 이를 수정․보완하는 혼합 적 경제질서를 취하고 있다는 관점에서 우리의 경제헌법조항을 파악하고 있으며, 헌법 제119 조 제1항이 근간이 되는 조항(體)이고, 동조 제2항이 이를 보완하는 조항(用)으로 체용관계에 서 양자의 관계를 파악하다. 한편, 경제민주화가 내포하고 있는 법적 의미와 한계를 분석하다. 아울러 헌법 제119조 제 2항의 경제민주화는 여러 요소 중의 하나이고 헌법 제119조 제2항 전체가 경제민주화 조항으 로 파악하는 것은 곤란하다. 경제민주화를 둘러싼 헌법재판소와 대법원의 판례를 비판적으로 분석하고, 끝으로 헌법상 경제조항을 둘러싼 국회 헌법개정특별위원회 자문위원회의 개정 안에 대하여 비판적 관점에서 분석하다.

영어초록

This paper analyzes the legal discussion on economic order and economic democratization provided for in Article 119 of the Constitution of the Republic of Korea in terms of analytical and legislative viewpoints. As we all know, the economy is a matter of how to allocate limited resources that can not satisfy the needs of everyone. Depending on whether the state or the market will play a major role in allocating resources, both the capitalist and socialist economic systems will be located respectively at both ends of the ideological spectrum. The Korean Constitutional Academy has been actively discussing the economic order of the Constitution in terms of socio-market economic order, mixed economic order and neutrality of economic order. In this context, there are various discussions on the relationship between Paragraphs (1) and (2) of Article 119 of the Constitution. This paper understands our economic constitutional provisions in the light of the fact that our Constitution adopts a mixed economic order that basically focuses on the free market economy and exceptionally and supplementarily modifies and supplements it. Furthermore, this paper understands the relationship between the two paragraphs in the viewpoint that Paragraph 1 of Article 119 of the Constitution is the thing and Paragraph 2 is its functions. On the other hand, this paper also analyzes the legal meanings and limitations of economic democratization. In addition, this paper argues that the economic democratization provided for in Paragraph 2 of Article 119 of the Constitution is one of several factors and Paragraph 2 of Article 119 is not the whole of economic democratization. This paper also criticizes the precedents of the Constitutional Court and the Supreme Court over economic democratization, and finally analyzes the revision bill proposed by the Advisory Committee of the Constitutional Amendment Special Committee of the National Assembly on economic clauses of the Constitution from a critical point of view.
