조부모의 면접교섭권 (Grandparent visitation rights)

초록

맞벌이 가정의 증가로 조부모가 손자ㆍ손녀를 양육하는 사례가 점점 늘어나고 있어 이혼이나 부모의 사망 등으로 가정의 해체가 일어나는 경우 자녀의 복리를 위해서라도 조부모와 자녀 사이의 면접교섭을 인정할 필요성이 높아지고 있다.
프랑스, 미국, 영국 등지에서는 꽤 오래전부터 조부모의 면접교섭이 인정되어 왔는데, 그 인정근거 및 허용요건에 대하여 각국의 입장이 일치되지는 않지만, 자녀의 최선의 이익에 부합한다면 양육권자인 부모의 반대가 있더라도 자녀와 조부모 사이의 면접교섭을 인정하는 것이 현재의 일반적인 추세이다.
우리나라의 현행 법규정은 ‘자를 직접 양육하지 아니하는 부모의 일방과 자는 상호 면접교섭할 수 있는 권리를 가진다.’라고 정하고 있어 면접교섭의 당사자를 자와 비양육친에 한정하고 있다. 조부모의 면접교섭을 법 이전의 권리라고 본다면 현행법하에서도 이를 인정할 수도 있겠지만, 여러 가지 현실적인 문제를 고려하여 볼 때 조부모의 면접교섭을 인정하는 명문 규정을 도입하는 것이 필요하다.
조부모의 독자적인 면접교섭의 인정 여부가 문제될 수 있는 상황은 많겠지만, 부모의 자녀에 대한 보호, 교양, 양육권과의 조화나 자녀의 최선의 이익이라는 면접교섭의 궁극적 목적을 생각해 볼 때, 부모 중 일방이 사망한 경우 그 사망한 측의 조부모에게 독자적인 면접교섭을 인정하는 게 가장 일반적인 경우라 할 것이다.
조부모의 면접교섭을 허용하기 위한 요건이 되는 것이 ‘자녀의 최선의 이익’인데, 면접교섭이 자녀의 최선의 이익에 부합하는지 판단하는데 있어 중요한 고려요소는 자녀의 의사, 연령 등 자녀에 관한 사항, 조부모의 적격성, 조부모와 자녀의 관계, 조부모와 자녀의 양육친과의 관계, 면접교섭이 양육친과 자녀의 관계에 미치는 영향 등이다.
면접교섭이 자녀의 최선의 이익에 부합하는지에 대한 입증책임은 조부모에게 있는데, 조부모의 면접교섭의 부재가 자녀에게 정서적으로나 육체적으로 위해가 된다는 정도까지 입증할 필요는 없을 것이다.
자녀와 조부모 사이의 면접교섭은 조부모와 부모가 그 면접교섭이 자녀의 복리를 위하여 필요하다는 공통된 인식하에 서로 협력할 때 비로소 원활하게 이루어지고 제대로 기능 할 것인데, 이를 위해서는 면접교섭 관련자들에 대한 교육프로그램을 도입하고 면접교섭의 시행관찰을 통하여 그 경과를 확인하고 구체적 사안에 맞는 적절한 면접교섭 형태 및 방법을 정하는 것이 선행되어야 할 것이다.

영어초록

With growing the number of dual-income families, the cases of grandparents’ grandchildren care are getting increased, and therefore when the family is dissolved due to parents’ death or divorce, the need of visitation rights between grandparents and children for children’s welfare is increasingly important.
Grandparents visitation have been long acknowledged in France, America, and England. Although each country has different standards regarding recognition foundations and requirements, it is now general to accept visitation rights between grandparents and children despite the opposition of parents with custody of the children in the best interest of the child.
Korean current regulations limit the persons with visitation rights to the children and non-nurturing parents, stating that ‘one parent who doesn’t nurture children and children have the right of contacting each other’. If grandparents’ visitation rights are considered as the right ahead of law, the current law may stipulate the visitation right. Therefore it is necessary to adopt substantive enactment to acknowledge grandparents’ visitation rights considering various realistic problems.
There may be many questionable situations of grandparents’ independent visitation, but considering the ultimate goals of visitation right that is the best interest of the child, harmony with parents’ rights of care, education, custody for children, it is general to grant the parents of the deceased the visitation right when one of the parents is deceased.
The requirement of granting grandparent visitation is ‘the best interest of the child’, and the important considerations in deciding if a grandparent visitation is suitable to the best interest of the child are the matters about children such as children’s intention and age, grandparents’ eligibility, the relationship between grandparents and children, the relationship between grandparents and the nurturing parent of children, and the effects of visitation on the nurturing parent and children.
Burden of proof regarding the visitation suitable to the best interest of the child is given to grandparents, but it doesn’t need to prove that the absence of grandparent visitation damages children physically and mentally.
Grandparent visitation is actively granted and functioned when grandparents and parents understand the need of visitation for children’s well-fare. To this end, the educational programs regarding people who have visitation rights should be introduced, and proper types and methods of visitation suitable to the specific proposals should be determined in advance by checking and reviewing its process through the observation of visitation.
