제5공화국기 대통령선거인단의 구성과 성격 (Composition and Characteristics of The Fifth Republic's Presidential Electoral College)

초록

본 논문은 1981년 2월 10일 실시된 대통령선거인선거의 선거인단의구성과 경력을 분석하여 전두환 정권의 정치적 동원의 매커니즘과 특징을 살펴보고자 한다. 신군부는 정부가 추진하고 있는 유신헌법 개정작업과는 별도로 국가보위비상대책위원회에서 헌법시안을 준비한다. 정부 헌법개정안은 신군부의 뜻대로 조정되었고, 1980년 9월 29일 국무회의에서 헌법개정안을의결‧공포하였다. 이상의 헌법개정안은 공고된 지 24일 만인 1980년 10 월 22일 헌법개정안의 찬반을 묻는 국민투표를 실시하여 찬성 91.6%라는 사상 가장 높은 득표율로 확정되어 발효되었다. 새 헌법 확정에 따라 통일주체국민회의‧국회‧정당은 해산되고, 1980년10월 29일 입법회의가 설치되어 정치풍토 쇄신을 위한 특별조치법, 정당법, 선거법, 언론기본법 등 일련의 정치관계법을 제정 및 개정하여 집권을 위한 환경을 조성하였다. 개정 헌법에 의해 전두환은 1981년 2월 25일 제12대 대통령 선거에서당선됨으로써 제5공화국이 출범하였다. 제12대 대통령 선거는 2월 11일선거인 선거에서 국민들의 직접선거로 선출된 선거인단이 4명의 대통령후보 중 한 명을 선출하는 2단계를 거쳤다. 그러나 선거인단은 입후보 과정에서 자신들이 지지하는 정당을 기입할 수 있었고, 대다수가 민정당을 지지하고 있었다. 이 선거는 전두환이 대통령이 될 수밖에 없는 결과가정해져있는 선거였다. 선거인단 각각은 자신의 경제적‧정치적 이익을 위해 입후보하였지만, 이들은 전두환 정권의 필요에 의해 호명된 정치적 동원의 대상에 불구하였다. 또한 선거인단은 제4공화국 박정희 정권에 의해 육성된 통일주체국민회의 대의원, 3대 관변단체, 직능단체 등에서 활동하는 이들로써 오랜 세월 권위주의 정권의 지지자로 활동해온 이들이었다. 신군부는 지역내 조직력과 영향력을 갖춘 그들을 정권의 정당성과 체제의 유지를 위한수단으로 삼은 것이다.

This paper aims to examine the mechanism and characteristics of the political mobilization of the Chun Doo-hwan administration by analyzing the composition and career of the electoral college of the presidential election held on February 10, 1981.
Apart from the government's revision of the Yushin Constitution, the new military will prepare a constitutional proposal at the National Security Emergency Response Committee. The government's constitutional amendment bill was adjusted according to the will of the new military, and on September 29, 1980, the constitutional amendment bill was resolved and promulgated at the State Council. On October 22, 1980, 24 days after the announcement, the above constitutional amendment was confirmed and took effect with the highest vote in history of 91.6% in favor.
Following the new constitution, the National Assembly, and political parties were dissolved, and on October 29, 1980, a legislative meeting was established to establish and revise a series of political laws, including the Special Measures Act, the Political Party Act, the Election Act, and the Framework Act on Media.
Under the revised Constitution, Chun Doo-hwan was elected in the 12th presidential election on February 25, 1981, and the 5th Republic was launched. The 12th presidential election went through the second phase of the February 11 election in which a group of electors elected by direct public elections chose one of the four presidential candidates. However, the electors were able to list the political parties they supported during the election process, and the majority were supporting the Democratic Party. The election was a fixed outcome for Chun Doo-hwan to become president.
Each of the electors ran for their own economic and political interests, but they were not subject to political mobilization called by the needs of the Chun Doo-hwan regime. In addition, the electors were representatives of the National Assembly of Unification Subjects fostered by the Park Chung-hee administration of the 4th Republic, three major government organizations, and functional organizations, and have long been supporters of the authoritarian regime. The new military has used them with organizational power and influence in the region as a means to maintain the legitimacy and system of the regime.
