초록

현재 전 세계적으로 지방정부의 역할은 지속적으로 증대하고 있다. 이러한 현상의반영으로 각급 지방정부는 다양한 국제화 관련업무를 활발히 추진하고 있다. 특히최근 각급 지방자치단체가 적극 추진 중인 다양한 국제활동을 목도하고 있는 우리나라에서 이러한 새로운 추세는 주목할 만하다. 동시에 지방정부의 역할 확대와 국제사회로의 진출은 아울러 새로운 과제를 우리에게 제시하고 있다. 특히 강력한 중앙정부를 전제로 하여 발전하여 온 기존의 국제법 규범은 지방정부는 특별한 고려대상으로 삼지 않는 입장을 그간 견지하여 왔고 중앙정부만이 국제법상 모든 권리와의무의 주체가 된다는 시각에 터 잡고 있다. 지방정부의 적극적인 등장과 국제사회에서 이들의 역할 강화는 이제 일부 영역에서는 이러한 기존의 규범이 현실과 부조화를 보이는 상황도 확인되고 있다. 이러한 문제점을 해소하거나 경감하기 위하여최소한 현재 규범의 기본틀 내에서도 다양한 방안을 모색할 수 있을 것이다. 이러한구조적인 문제를 단시일에 해결할 수는 없을 것이나 일단 이러한 문제의식을 갖고앞으로 국제법이 어떠한 방향으로 발전하여 나가야 하는지에 대한 의미있는 논의를시작하는 것이 필요한 시점이다.

영어초록

Local governments have been expanding their roles in a variety of aspects in many countries. One of the new roles taken up by local governments is to participate in international affairs or deal with issues of international or global concern.
At the same time, the measures taken by local governments within their own jurisdiction also affect foreigners and foreign entities, both domestic and abroad.
Local governments have thus become an important player in the international arena and implementation of various treaties. The new phenomenon thus raises not only diplomatic implications but also legal implications since some of the actions of local governments do carry the potential of leading to possible violation of international law (treaties or customary international law) in many respects.
Despite the advent of the new phenomenon, international law has traditionally taken a rather ‘simplistic’ approach so far, based on the notion that only a state (i.e., central government) is to be visible in the eyes of international law and that only the state can be held liable for state responsibility. Even if a situation or dispute has arisen from the action of local governments, in principle it is only the central government that is visible in the eyes of international law and is held liable for any treaty violation. The invisibility of local governments and the (presumed) ‘singular’ omnipotence of central governments sometimes present a widening gap considering the new realities that many states are encountering at the moment where local governments do preserve a significant level of independence and a wide latitude of authority, sometimes independent of the central governments.
From the systemic point of view, it is time to consider how to narrow the obvious gap between the traditional norms and the new reality. Even within the existing framework of international law norms, new ideas and suggestions can be explored and tested to address the problem. It may take a long time and involve a difficult process to find a workable solution, but necessary studies and discussions should preferably be initiated sooner rather than later.
