초록

이 글은 지능정보기술을 바탕으로 한 지능정보사회의 의의와 특징적 양상을 이전의 정보사회와 비교하고, 그러한 특징적 양상이 개인과 국가에 미치는 영향력을 살펴보며, 발전을 거듭하고 있는 지능정보사회에 대한 헌법적 접근-기본권적, 국가작용적, 그리고 헌법정책적 접근-을 시도하려는 것이다.
먼저, 지능정보사회의 의의와 특징적 양상에서, (1) 지능정보사회란 그 토대가 되는 지능정보기술-인간의 인지, 학습, 추론 등 고차원적 정보 처리 활동을 ICT 기반으로 구현하는 기술로서 인공지능(AI)에 데이터 활용 기술인 사물 인터넷(IoT), 빅데이터(Big data), 클라우드(Cloud), 모바일(Mobile)이 결합되어 AI+IBCM으로 표현되는 기술-이 경제, 사회, 삶 모든 분야에 보편적으로 활용됨으로써 새로운 가치가 창출되고 발전하는 사회로 보고, (2) 그러한 사회의 특징적 양상을 인공지능(AI)의 발전, 데이터 기반사회, 초연결사회로 파악하였다.
다음으로, 지능정보사회에 대한 헌법적 접근에서는, (1) 기본권적 접근으로서 지능정보기술의 주축인 인공지능의 발전에 따른 기본권의 경합과 충돌. 국가의 기본권 보호의무, 인공지능의 기본권 주체성 등 기본권 총론적 접근과 함께 관련된 개별 기본권들에 대한 각론적 접근을 하였다. (2) 국가작용적 접근으로서는 국가작용을 입법ㆍ행정ㆍ사법ㆍ작용으로 나누어 1) 인공지능의 발전이 국가작용에 미치는 영향의 측면과 2) 국가작용의 주체가 지능정보사회에 대처하는 측면으로 접근하였다. 구체적으로는 입법작용에서 입법정보와 자료에 대한 인공지능의 활용과 선제적 입법 대응, 행정작용에서는 변화하는 행정현실에 대응해야 할 과제-생명ㆍ신체의 안전, 고용ㆍ노동, 복지 등에서의 해결과제- 등, 그리고 사법작용에서는 인공지능 법관의 대체가능성 등에 대하여 헌법적으로 접근을 하였다.
그리고 (3) 헌법정책적 접근에 대하여는 이 글에서는 1) 헌법재판 심사기준의 해석ㆍ적용의 측면과 2) 헌법개정의 측면으로 나누어 접근의 방향성을 언급하였으나 구체적인 검토는 생략하였다.

영어초록

This study is to compare the meaning and the distinct aspects of the intelligent information society, which is based on intelligent information technology, against former information society, and to examine the impact such aspects may have on individual and the nation. The purpose of this research also includes an attempt to constitutional approach-approach to fundamental rights, national action, and constitutional policy-on progressing AI.
In terms of the meaning and the distinctive aspects of intelligent information society (1) intelligent information society is defined as a community that produces and develops new values by commonly utilizing the intelligent information technology-this is an ICT based technology which realizes high level information processing activities such as human cognition, learning ability, reasoning, etc. It combines Artificial Intelligence(AI) with IoT, Big data, Cloud, and Mobile and is expressed as AI+IBC-fundamentally in economics, society, and every aspect of life, (2) and such features are recognized as AI development, data based society, and hyper-connected society.
As for the constitutional approach to AI, this study, first of all, attempts to approach to fundamental rights, the general theory of fundamental rights that includes contention and collision of fundamental rights according to the advancement of AI, duty of the nation to protect fundamental rights, subjectivity of fundamental rights as well as particular theories of fundamental rights.
Second, for the approach to nation's action, it is divided into legislation, administration, and jurisdiction to go into 1) the effect of AI development on nation’s action, 2) the management of the nation’s action towards intelligent information society as a main agent.
More specifically, the study shows constitutional approach on the preemptive legislative reaction and the utilization of AI on legislative information data when it comes to legislation, changing administrative realities that need to be solved–unfinished tasks on life, safety of the body, employment, labor, and welfare-and lastly, the possibility of the AI judiciary in the area of jurisdiction.
And finally, the research only briefly mentions and does not go deepr into constitutional policy approach by dividing the perspective into 1) the interpretation standards and application of the constitutional trial 2) the amendment of the Constitution.
