국회 정보위원회의 운영과 입법방향에 대한 고찰 - 미국 상·하 정보위원회의 교훈을 중심으로 - (A Study on the Operation and Legislative Right Way of the National Assembly Intelligence Committee: Focusing on the Lessons from the U.S Intelligence Committee)

초록

본고는 속성적으로 비밀조직인 정보공동체에 대한 업무감독에 있어서, 민주성과 개방성을 확보하여 정보의 본질을 직시하고 가장 모범적인 모습으로 평가받는, 미국 상원과 하원 정보위원회의 법규범적인 모습을 심층적으로 고찰했다. 그를 통해서 향후 대한민국 국회정보위원회의 올바른 방향성에대한 입법론적 교훈을 얻고자 함을 목적으로 한 연구이다. 이러한 연구는 2013년 12월 31일 국회 주도로 국가정보원법 개정을 도출한 이후 향후 국회 정보위원회의 전임화에 있어서도 국가정보의 비밀성은 유지하면서도 업무감독에는 차질이 없도록 하는 올바른 길에 대한 안내자로 삼고자 한다. 이를위해 먼저 국가정보의 법철학적인 이념을 숙고함으로써 국가정보활동이 비밀성 ․ 밀행성 ․ 침습성으로인해서 인권 침해적이라는 막연한 예단을 배제하고 그 진정한 가치를 이해하도록 하는데 기여하고자한다. 또한 행정부와 입법부의 견제와 균형이라고 하는 요청에 터 잡은 올바른 국회 정보위원회의 하드웨어와 소프트웨어 쟁점을 고찰함으로서 정보의 정치화를 예방하는데도 기여할 수 있으리라고 사료된다. 한편 국회정보위원회의 부침을 미국의 역사적 경과를 통해 살펴봄으로써, 그것은 고정적인모습이 아니라 유동적이고 가변적이라는 것에 대한 결론도 도출한다.

영어초록

This paper examines closely an intelligence oversight system by National Assemblythrough the lessons from that of U.S.A Congress experience. For that purpose I review thelegal ideology of national security and national intelligence considering changing globalsecurity environments in the 21st century and their implications to the reshaping thegovernment system. However while the protection of legitimate government secrets isessential, the shield of secrecy should not be used to hide unlawful government activities,or to immunize government officials against accountability for the unlawful breach ofhuman rights.
Although the Constitution gives the executive branch preeminence in dealing withintelligence matters, nevertheless provides National Assembly with an important oversightrole. However congressional oversight into intelligence issues is a complex task, requiringa sophisticated understanding of the issues. Congress’s most important source of leverage isthe power to authorize programs and appropriate funds.
In our case, the National Assembly of the Republic of Korea passed the amendingNational Intelligence Service Act for the purpose of prohibition of political intervention.
And agreed full time intelligence committee. Therefor at this time, it's really important toconsider and make a deep sense the tension between national security through secrecy andfair oversight by intelligence committee.
For that purpose this study mainly dealt with the national security issues and legal toolsfor appropriate policy measures of the National Intelligence Committee by theunderstanding that of U.S Congress system. This article also reviews what our intelligenceand security Agencies want to do with the revising and making the so called nationalsecurity relating laws. At any rate, despite of all hot debates about the various legality andhuman rights issues derived from the intelligence service, the national security should besecured. Finally, this paper suggests that one of the most important and immediate step is to understanding the legal ideology of national security and national intelligence.
