주민참여가 제한된 자치경찰제의 문제점과 개선방안 (Problems and improvement plans of the autonomous police system with limited resident participation)

초록

2006년 7월에 제주특별자치도에 한하여 자치경찰제도가 시행되어 온지 15년만에 전국에 자치경찰제도가 시행되게 되었다. 자치경찰제도는 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」(약칭:경찰법)에 의해 광역지방자치단체에 대하여 자치경찰기관을 두어 전국적으로 시행해 오고 있다.
자치경찰제도는 지역의 치안을 주민 참여를 통하여 지역 내에서 지방자치단체가 스스로 자주적으로 처리하는 것이다. 자치경찰은 지역 내의 치안수요에 대응하여 지역민의 의사를 통하여 지역의 안전을 확보하는데 그 목적이 있다. 지역의 안전은 지역에서 지역민이 자주적인 의사에 따라 스스로 처리하는 것이 자치경찰제도의 존재의의이다.
지역의 치안을 확립하고 안전한 지역사회를 확립하기 위해서는 자치경찰기관과 자치경찰사무에 대한 지방자치화가 필요하다. 경찰법은 자치경찰제도를 시행하고 있으나 자치경찰기관으로 시‧도자치경찰위원회만을 설치하여 운영하고 있다. 자치경찰제도 중 유일하게 자치경찰기관인 시‧도자치경찰위원회의 구성과 사무에 주민참여를 통하여 지방자치를 실현하여야 한다. 그러나 현행 법률에서는 자치경찰기관에 대하여 주민참여를 규정하지 않고 있어 시‧도자치경찰위원회의 자치성 달성 곤란과 위원의 정당성 확보가 어려운 한계를 가지고 있다.
자치경찰제도는 지방자치를 구현하기 위한 제도 중의 하나로 지역주민의 의사가 반영되어야 한다. 지역주민의 의사가 자치경찰제도에 제대로 반영될 경우 민주성확립과 정당성이 확보될 수 있다.
따라서 자치경찰제도가 지방자치의 본연의 취지를 살려 지역치안 확립을 위해서는 지역 주민의 참여를 통하여 자치경찰기관이 구성되고 운영되어야 한다. 따라서 본 연구는 주민참여를 통한 자치경찰제도의 실현을 위해 주민의 사전참여와 사후통제라는 범위에서 자치경찰제도의 문제점과 개선방안을 제시하였다. 향후 경찰법 개정을 통하여 지방자치 실현에 부합할 수 있는 자치경찰제도 확립이 실현되어야 한다.

영어초록

The autonomous police system was implemented nationwide for the first time in 15 years since July in 2006 when the autonomous police system was implemented only in Jeju Special Self-Governing Province. In accordance with the 「Act on the Organization and Operation of National Police and Autonomous Police」 (abbreviation: Police Act), the autonomous police system has been implemented nationwide by establishing autonomous police agencies in metropolitan regional governments.
In the self-governing police system, local governments autonomously handle local security through the participation of residents. The purpose of the self-governing police is to secure the safety of the area through the will of the local people in response to the demand for security in the area. The significance of the existence of the autonomous police system is that the local residents in the region are autonomously managing the safety of the region.
In order to establish local security and a safe community, local autonomy of autonomous police agencies and autonomous police affairs is necessary. The Police Act implements the autonomous police system, but only the city and provincial autonomous police committees are established and operated as autonomous police agencies. Local autonomy should be realized through the participation of residents in the composition and affairs of the City/Provincial Autonomous Police Committee, which is the only autonomous police agency among the autonomous police system. However, as the current law does not stipulate the participation of residents in autonomous police agencies, it is difficult not only to achieve autonomy of city and provincial autonomous police committees, but also to secure the legitimacy of its members.
The autonomous police system is one of the systems of pursuing local autonomy, and the will of local residents must be reflected. If the opinions of local residents are properly reflected in the autonomous police system, democracy and legitimacy can be secured.
Therefore, in order for the autonomous police system to take advantage of the original purpose of local autonomy and to establish local security, an autonomous police agency must be organized and operated through the participation of local residents. Therefore, this study presented problems and improvement plans for the autonomous police system within the scope of residents' pre-participation and follow-up control in order to carry out the autonomous police system through resident participation. The establishment of a self-governing police system that can meet the goals of local autonomy should be achieved through the revision of the Police Act in the future.
