보호대상아동 최선의 이익 관점에서 보호출산제 문제점 검토 (Reviewing Anonymous Birth System from Protected Child’s Best Interests Perspective)

초록

본 연구는 보호대상아동의 최선의 이익 관점에서 보호출산제를 검토하여 제도개선을 제안하기 위해 수행하였다. 보호대상아동에게 최선의 이익으로써 입양, 보호출산제도의 배경과 쟁점 등을 살펴본 후 보호대상아동의 입장에서 출생 시, 입양대상아동 결정 과정, 성장 이후 시점에 따라 보호출산제도의 문제점을 살펴보았다. 검토결과, 아동 출생 시 아동복지법과 입양특례법과의 부조화로 인한 아동보호체계 이탈과 제도의 성인중심적 관점으로 인해 최선의 이익을 보장받지 못하는 문제, 입양아동 결정과정에서는 친생부모가 아동 출생 전 입양을 결정함으로써 태어난 후 양육에 대한 실질적 가능성에 대해 고려하지 못하는 문제, 상담기관의 전문성 부족으로 장애아동의 최선의 이익 미보장과 차별받지 않을 권리의 침해 문제, 성장 이후에는 출생증서(기록)의 신뢰성 부족으로 친생부모와 스스로에 대해 알 권리에서 최선의 이익을 보장받지 못하는 문제 등이 드러났다. 검토결과에 따라 보호출산제도의 전면재개정, 위기임신과 아동권리에 관한 세부적·전문적 상담·지원기능 강화, 아동의 출생정보 접근성 개선, 아동복지영역 실무자들의 적극적인 관심과 실천적 노력의 촉구를 제안하였다.

영어초록

This study was conducted to examine the anonymous birth system from the perspective of the best interests of the protected child and to propose improvement measures. After examining the background and issues of adoption and the anonymous birth system in the best interest of the protected child, the study examined the problems of the anonymous birth system from the perspective of the protected child at birth, during the adoption process, and later in life. The review examined the following issues: children’s best interests are not guaranteed at birth due to the inconsistency between the Child Welfare Act and the Adoption Act and the application of an adult-centered viewpoint system; in the process of determining children for adoption, biological parents do not consider the realistic possibility of raising children after birth by deciding to adopt before child birth; children with disabilities’ best interests are not guaranteed due to the lack of expertise of designated agencies and violation of their right to non-discrimination; and children’s best interests are not guaranteed in terms of their right to know their biological parents and themselves due to the unreliability of records after they grow up. Based on the results of the review, researcher propose completely revising the anonymous birth system, strengthening detailed and specialized counseling and support functions for crisis pregnancies and children’s rights, improving access to children’s birth information, and drawing attention and taking practical efforts from practitioners in the child welfare fields.
