유엔 인권 메커니즘에서 논의된 한국의 노동권 이슈와 시사점 (Korea’s Labour Rights Issues and their Implications Discussed in UN Human Rights Mechanism)

초록

국제사회에서 노동권 이슈는 국제노동기구(ILO)의 국제노동기준을 중심으로 한 이행감독 메커니즘에서 주로 논의된다고 알려져 왔다. 그러나 유엔 인권 메커니즘도 회원국의 노동권 사안을 다루고 관련 국제규범을 채택한다. 본 논문은 유엔에서 논의된한국의 노동권 이슈를 살펴보면서, 유엔 인권 메커니즘 작동의 시사점과 이를 매개로한 노동권 개선 방향에 대해 모색해보고자 한다. 이를 위해 먼저 국제인권조약기구가발표한 일반논평(General Comments)을 토대로 국제인권규범이 규정하는 노동권의 내용을 이해한다. 다음으로 국제인권조약기구에서 가장 최근 시행된 한국의 국가보고(State Reporting) 심의와 개인통보(Individual Communications) 제도를 이용한 노동권사안을 살펴본다.
국제사회가 조명한 한국의 노동권 현황의 검토를 바탕으로, 이 글은 한국의 노동 현실 개선을 위해 다양한 방식으로 유엔 인권 메커니즘이 활용될 수 있기를 기대한다. 유엔 인권 메커니즘은 한국의 노동권 현황을 국제인권기준에 부합하도록 국내법과 정책의 개선에 영향을 끼치고 있다. 나아가 당사국의 국제인권규범의 준수를 위한 미래방향을 제시한다. 오는 2023년 10월 제5차 자유권규약 국가보고 심의에서는 자유권규약 제22조(결사의 자유) 철회 여부에 대해 질의할 것으로 밝혀, 한국 정부의 국제규범준수 의무 강화를 위한 자유권규약위원회의 후속적 견인이 예상된다. 그러나 한편으로는 이행 주체들의 한정된 역량과 자원, 유엔 인권 메커니즘에 내재한 운영방식의 비효율성으로 인해 규범 이행력이 저하되는 점 또한 알 수 있다. 이러한 제한 요인들을 고려하면서, 우리의 입법, 행정, 사법의 기능이 유엔 인권 메커니즘을 적절히 활용할 수있도록 인식제고와 교육훈련, 이해관계자와의 협력 대화의 장이 더욱 확대되어야 한다. 이를 토대로 여성, 장애인, 아동 등 권리 주체와 그들이 처한 세부적인 이슈들을교차하는 방식으로 유엔 인권 메커니즘이 적극적으로 활용될 수 있기를 바란다.

영어초록

It is widely recognized that discussions on labour rights in the international community take place primarily within the framework of the mechanisms for monitoring the implementation of ILO’s Labour Standards. However, the UN Human Rights Mechanisms also address labour rights issues in the international community and adopt relevant standards. This article examines labour rights issues in South Korea, which have been extensively discussed at the United Nations, and explores the impact of UN Human Rights Mechanisms and ways in which they can be used to promote labour rights. To this end, the article first examines the content of the right to work under International Human Rights Law, with particular reference to the General Comments of international human rights treaty bodies. It then analyses the labour rights issues raised in recent State Reporting procedures and Individual Communications of human rights treaty bodies.
Drawing upon the comprehensive review of labour rights issues in Korea that have been highlighted by the international community, this article looks forward to the various ways in which UN Human Rights Mechanisms can be used to improve labour conditions in Korea.
UN Human Rights Mechanisms have been influential in improving domestic laws and policies to bring the labour rights situation in line with International Human Rights Standards. They also furnish invaluable guidance for States parties' compliance with international human rights norms. The UN Human Rights Committee's fifth periodic review in October 2023 is expected to ask whether the Korean government should withdraw Article 22 (freedom of association) of the ICCPR, which could lead to further pressure from the Committee to strengthen the State party's obligations to comply with international standards.
However, it is imperative to acknowledge that the limited resources and capabilities of the government, coupled with inefficiencies in the operationalization of UN Human Rights Mechanisms, serve as impediments to the implementation of these norms. Consequently, while taking into account the structural limitations of the UN Human Rights System, awareness raising, training, and collaborative dialogue with stakeholders should be further expanded to ensure that our legislative, executive, and judicial functions can properly utilize the UN Human Rights Mechanisms. On this basis, it is foreseen that the UN Human Rights Mechanisms can achieve greater effectiveness by addressing an array of issues intersecting with rights holders, including women, persons with disabilities, and children.
