학교용지확보특례법에 대한 헌법재판소결정의 문제점 (Problems of the Constitutional Court's Decisions on the Schoolsite Special Act)

초록

헌법재판소는 2008. 9. 25.까지 “학교용지 확보 등에 관한 특례법(이하 특례법)”과 관련하여 의미가 있는 3회의 결정을 내렸다. 처음으로 결정이 이루어졌던 것은 2005. 3. 31.에 있었던 2003헌가20결정이었고 그리고 2008. 9. 25. 같은 날 내려진 2007헌바1결정과 2007헌가9결정이 그것들이다. 그리고 이들 결정에서 헌법재판소는 수분양자를 학교용지확보 부담금 납부대상자로 규정한 법률의 위헌성 심사에서는 심판의 기준으로 헌법 제31조 제3항의 의무교육의 무상성과 헌법 제11조 평등권 그리고 헌법 제23조 제1항의 재산권을 적용하였다. 그리고 이후의 두 결정에서는 특히 이 결정이 있기 이전에 학교용지확보등에관한특례법이 개정되어 부담금의 납부대상자가 “분양하는 자”로 된 법률에 대해서는 헌법 제31조 제3항의 의무교육 무상성의 원칙은 적용되지 않는다고 하면서 헌법 제23조 제1항과 제11조 제1항을 심판의 기준으로 논증하였다. 그러나 학교용지확보 부담금 납부의무자를 공동주택을 분양하는 자로 규정하고 있는 현행 특례법은 “분양하는 행위”가 특히 공동주택 분양의 경우 100채 이상의 공동주택 분양행위임으로 반복적ㆍ지속적으로 행하는 삶의 기본적 수요를 확보하는 행위에 해당됨으로 헌법 제15조 직업의 자유가 심판의 기준이 되어야 하며 여기에 헌법 제11조의 평등원칙이 적용되어야 했다.

영어초록

The Constitutional Court decided till 9. 25. 2008 three times on the Schoolsite special Act, which took effect on 12. 29. 1995. The first decision was held on 3. 31. 2005. with the number of decision 2003hunga20 and the other two ones on 9. 25. 2008. with 2007hunba1 and 2007hunga9. Originally the Schoolsite Act had provisions that those who purchased apartments in the development-works area must pay the so-colled schoolsite charge, which were heard in the first decision. In the reason for the first decision the Court held that the provisoins are unconstitutional because they violate the constitutional principle of the free compulsory education in Art. 31. clause 3 Korean Constitution. In addition the provisions infringe on the equal right in Art. 11. clause 1 and the right of property in Art. 23 clause 1 Korean Constitution. During the first decision was being heard on the Constitutional Court the Korea Assembly amended the provisions, which were dealt in the two other decisions of the Court. With the Amendment those who build and sell apartments in the development-works area burden the amount of the schoolsite charge. The Korean Constitutional Court declares that the newly amended provisions are constitutional with the reasons that the free compulsory education principle shall not be applied in this case and that although the equal right and the right of property are intervened but these interventions are constitutionally justified.
Fundamentally I disagree with the conclusions of the Court on the cases for some reasons. Specifically the newly amended Act imposes the schoolsite charge to sellers who build and transfers the apartments to purchasers. They usually build and transfer apartments as their business, commercial pursuits. Originally they themselves are professionals. The Act imposes the schoolsite charge to them only due to the professional activities, building and selling apartments. For this reason the schoolsite Act intervenes only on the freedom of occupation in Art. 15 Korea Constitution. Additionally this case can be reviewed with the equal right in Art. 11 clause 1 Korea Constitution.
