정신병원과 시설 내 격리･강박의 문제점과 제도개선방안 (Reforming the Legal System of Seclusion and Restraint in Psychiatric Hospitals and Facilities)

초록

정신병원과 일부 시설 내에서 합법적으로 또는 사실적으로 이루어지는 입원환자나 입소자에 대한 격리･강박은 우리 사회에서 이제 당연하거나 익숙해지는 일이 되었다. 그러나 그러한 합법적 또는 묵시적 폭력의 상황이 가능해지는 정신병원과 시설에 대한 혐오와 두려움도 동시에 공존한다. 치료와 돌봄의 공간이어야 할 정신병원과 시설이 격리･강박을 통하여 어떻게 비인격적 공간으로 전환되는지, 그리고 격리･강박을 허용하는 우리의 제도와 관행은 어떤 뿌리에서 연원하여 익숙해진 것인지 생각해 볼 필요가 있다.
사람을 가두고 묶는 것은 동물적 취급의 시작이고, 그 과정에서 사람은 비인격화된다. 교정시설에서의 격리와 강박은 집단적 질서를 유지하기 위한 징벌적 성격을 띤다면, 정신병원에서의 격리와 강박은 개인과 타인의 안전을 유지하기 위한 치료적 성격을 띤다. 그러나 그 둘의 경계는 모호하며, 치료가 징벌로 전환될 위험은 늘 상존한다. 그래서 법의 역할은 치료가 징벌로, 돌봄 자체가 폭력으로 넘어가는 상황을 막기 위한 상징으로서 존재해야 하는데 정신건강복지법에 명문화된 우리의 격리･강박규정은 현실에서 그러한 통제력을 상실한지 오래다.
본 논문은 격리･강박의 근거가 되는 법령규정을 검토해 보고, 현대적 정신의료가 그 공간을 다스리게 될 수 있는 이유 중의 하나인 정신과 약물이 가진 의미를 검토해 본다. 아울러 최초의 폭력이라 할 수 있는 민간의 불법적 강제호송이 가진 문제점을 지적하고, 격리･강박의 구체적 개선방안으로 ⅰ) 강박 개념과 요건 및 절차의 명확화, ⅱ) 화학적 강박의 사용기준 마련, ⅲ) 강박 집행인력의 자격과 교육 근거 마련을 제시해 본다.

영어초록

Seclusion and restraint of inpatients or inmates within mental hospitals and some facilities has become natural or familiar in our society. However, there is also a simultaneous hatred and fear for mental hospitals and facilities in which violence becomes possible. We need to find the origin of how mental hospitals and facilities, which should be spaces for treatment and care, are converted into inhuman spaces through seclusion and restraint, and our systems and practices that allow seclusion and restraint comes from what roots.
Confinement and binding of people is the beginning of animal treatment, and in the process people are depersonalized. While seclusion and restraint in correctional facilities are punitive to maintain order, seclusion and restraint in mental hospitals are therapeutic to maintain the safety of individuals and others. However, the boundaries between individual safety and collective order are ambiguous, and there is always a risk that treatment will be converted into punishment. Therefore, the role of the law should exist as a symbol to prevent treatment from turning into punishment and care itself into violence, but our seclusion and restraint regulations, which are provided in the Mental Health and Welfare Act, have long lost such control in reality.
This paper looks back in time for institutions that are the basis for seclusion and restraint, and examines the role of drugs in psychiatry, one of the reasons why modern psychiatry can govern the mentally ill. In addition, it will point out the problems of illegal forced transportation by the private sector, which can be called the first violence, and suggest specific measures to reform seclusion and restraint system. Specific improvement measures for seclusion and restraint include clarification of restrain concepts, requirements and procedures, establishment of standards for use of chemical restraint, and regulation of qualification and education for restrain enforcement personnel.
