사립대학 감사체제의 구조와 문제점에 대한 개선방안 (A Study on the Structure, Problems and Solutions of the Private Universities Audit System)

초록

사립대학 감사체제는 사립대학 운영의 투명성과 공정성이 담보되도록 하여, 사립대학의 자율성이 보장될 수 있는 선순환 구조를 형성하는 수단으로서 의의가 있다. 사립대학 내부감사에는 학교법인의 임원인 감사에 의한 감사가 대표적이다. 현행법은 입학정원 500인 이상의 대학에는 감사 중 1인을 공인회계사 자격이 있는 자로 임명하고, 또 1인은 개방이사추천위원회의 추천으로 선임하도록 하고 있다. 학교법인이 아닌 대학 내에 자체 감사조직을 통한 감사의 중요성을 강조하는 견해도 제기되고 있으나, 활성화되고 있지는 않다. 외부감사에는 감사원이나 교육부 등의 감독관청에 의한 감사, 외부회계감사, 회계감리 제도 등이 있다. 감독관청에 의한 감사의 경우 감사의 범위, 주기 등과 관련하여 문제 제기가 있다. 외부회계감사의 경우 아직 완비된 감사기준이 없다는 점과 감사의 범위, 감사보수 등에 문제가 제기되고 있다. 회계감리의 경우에는 상근조직이 아닌 또 다른 회계법인에 의한 감리가 이루어지고 있다는 점, 감리대상의 수가 적다는 점, 결과가 제대로 공표되지 않는다는 점 등이 문제가 되고 있다.
더 중요한 것은 사립대학 감사체제가 구조적 문제를 가지고 있다는 것이다. 수십 년에 걸쳐 문제가 있을 때마다 임기응변식으로 추가된 현재의 감사제도는 비체계성, 비효과성, 비효율성이라는 치명적 문제를 안고 있다. 사립대학 전반에 대한 국민적 신뢰를 확보하고 그를 통해 국가의 재정지원을 확대하는 것이 시급하다. 이를 위해서 사립대학의 투명성을 담보할 감사체제의 강화는 불가피하다. 사립대학 감사의 전반적 개선 방향은 선택과 집중, 공공성 강화, 독립성 및 공신력 강화라는 세 가지 키워드로 요약될 수 있다. 현재의 산만한 감사제도를 대폭 정비하여 유효한 제도는 더 강화하고 그렇지 않은 제도는 폐지하거나 범위를 한정하는 등의 노력이 필요하다. 관련된 법적 근거의 정비도 시급하다. 감사인의 선임이나 비용부담을 대폭 공적 영역으로 이관하는 발상의 전환이 필요하며, 여기에 투자되는 행정력이나 재정은 고등교육 신뢰확보의 비용으로서 가치가 충분하다. 각종 감사 주체의 독립성을 확보하기 위해서는 사립대학의 지배구조가 합리화되고 교육관청의 독립성이 강화되는 등의 노력이 선행되어야 한다.

The private university audit system ensures transparency and fairness in the operation of private universities, and forms a virtuous cycle to guarantee the autonomy of private universities. The head of an internal audit of a private university is an auditor, an executive of a school corporation. Universities with a quota of 500 or more are required to appoint one of the auditors as qualified certified public accountants, and another by the Open Director Recommendation Committee. Some opinions emphasize the importance of auditing through self-audit organizations in universities, but they are not being activated. External audits include audits by supervisory authorities, external accounting audits, and accounting supervision. In the case of an audit by the supervisory authority, there is a problem with the scope and frequency of the audit.In the case of external accounting audits, problems are being raised in audit standards, audit scope and audit compensation. In the case of accounting supervision, problems include the lack of a full-time organization for supervision, the small number of supervision targets, and the lack of proper publication of supervision results
More importantly, the private university audit system has structural problems. The current audit system, which has evolved over the decades into an ad hoc basis, has the problems of being unsystematic, ineffective and inefficient. It is urgent to secure public trust in private universities as a whole and expand the nation's financial support based on it. Therefore, it is inevitable to strengthen the audit system to ensure transparency in private universities. The overall direction of improvement can be summarized into three keywords: selection and concentration, strengthening public character, independence and strengthening public confidence. By overhauling the distracting audit system, efforts are needed to further strengthen the effective system and reduce the invalid one. It is also urgent to overhaul related legal grounds. It is necessary for public institutions to take charge of the appointment and cost burden of auditors. The administrative power or finances invested here are well worth the cost of securing trust in higher education. In order to ensure independence of the audit body, rationalization of the governance structure of private universities is necessary. Efforts to strengthen the independence of educational-related government organization should also be preceded.
