초록

공인중개사법의 탄생이후, 부동산중개계약제도의 논의를 거쳐 오늘날 중개계약은 활발히 논의되고 있는 주제 중에 하나인 것이다. 부동산 중개계약은 부동산이 지니는 고정성과개별성이라는 특수성으로부터 부동산시장을 추상화시킴으로써 부동산거래에서 중개업자의 조력을 필요로 하게 된다. 부동산거래의 출발점은 바로 중개계약에 있다. 이는 부동산중개계약에 대한 그 동안의 논의가 계약의 의의, 종류, 법적 지위에 관한 다양한 법적 성격에 따라 다양한 측면에서 이루어져 왔음을 의미한다. 비교법적으로 미국ㆍ독일ㆍ영국ㆍ뉴질랜드는 중개계약에 대한 기존의 시스템에 변화를 주고 있으며 이는 우리의 법제에 많은시사점을 준다. 이에 부동산 중개계약에 대한 법정책적 고려라는 측면에서 중개계약에 대한 지금까지의 논의를 간략히 정리함으로써 현행법 체계내에서 중개계약 법제를 진단하고문제점을 발견한 뒤, 외국의 입법례를 참고하여 대안을 제시하였다.
사실 중개계약이라는 문제는 법적으로 중개계약을 어떻게 바라보는가에 따라 차이를 보이고 있다. 그런데 부동산 중개계약 사고시 법적책임 문제나 중개 대상물에 대한 의무 등에관하여 법과 현실의 일정한 한계를 보이고 있다. 이와 같이 중개업자가 반드시 거래시 필요하다고 바라보는 시각에서 있어 법과 현실의 괴리가 늘어가는 시점에서 근본적으로 부동산 거래의 활성화와 공정한 중개계약의 선진화라는 측면에서 중개계약을 새로운 시각에서 재조명해가는 노력이 필요하다.

영어초록

After the enactment of the Certified Real Estate Brokers Act, today’s listing contract has become one of the actively discussed subjects through discussions about the real estate brokerage contract system. The real estate brokerage contract comes to be in need of a broker’s assistance in real estate transactions by abstracting the real estate market from specificity of fixed nature and individuality of real estate. The starting point of real estate transactions lies in the very listing contract. This means that the hitherto discussions of real estate brokerage contracts have been made from various aspects according to various legal character traits in relation to the significance, sorts and legal status of a listing contract.
In case of the USA, Germany, Great Britain, and New Zealand, they are giving variety to the existing system of listing contracts based on comparative law, which gives many implications to our legislative system. Hereupon, this study proposed an alternative by referring to the examples of legislation of foreign countries after diagnosing the legislative system of listing contract within the system of the current law, and finding out problems by briefly arranging the hitherto discussions about listing contract from the perspective of law-strategy-based consideration of real estate brokerage contract.
Virtually, the issue of listing contract is showing a difference according to how to look at the listing contract legally. Nevertheless, there exist certain limitations of law and reality with regard to legal responsibility problems, or accountability for brokerage objects, etc. in case of the accident in the real estate brokerage contract. Like this, at the time point when a gap between law and reality becomes wider amid a broker’s viewpoint that listing contract is definitely necessary for real estate transactions, this study thinks that it’s necessary to make efforts to shed new light on listing contract from a new perspective basically for the cause of revitalization of real estate transactions, and advancement of fair listing contract.
