공익사업에 따른 이주대책제도의 문제점 및 개선방안 (Issues & Improvements in the Migration Measure System of Public Works in Korea)

초록

본 연구는 공익사업에 따른 이주대책제도의 문제점을 법령ㆍ헌법재판소결정례ㆍ판례를 중심으로 도출한 후 이를 토대로 하여 개선방안을 모색함으로써 국민의 재산권 및 생활권을 충실히 보호하고 공익사업을 효율적으로 추진하는 데에 기여함에 목적이 있다.
이를 위하여 우선적으로 공익사업에 따른 이주대책의 법리를 해석하기 위하여 법이론적 접근을 시도하였고, 다음으로 이주대책의 실태를 분석하기 위하여 실시사례분석, 분쟁사례분석, 판례분석 등을 실시하였으며, 마지막으로 법리해석과 실태분석을 종합하여 이주대책제도의 문제점을 도출한 후 이를 토대로 하여 개선방안을 모색하였다.
공익사업에 따른 이주대책에 관하여 이주대책의 형평성 측면과 공익사업의 원활성 측면을 중심으로 법제도적인 문제점을 도출하고 개선방안을 모색한 결과 다음과 같은 개선방안이 강구되었다.
첫째로, 공익사업의 종류 및 사업시행자의 종류에 따라 이주대책의 수립ㆍ실시여부 및 이주대책의 내용이 상이함으로써 발생되는 분쟁을 해결하기 위해서는 개별 공익사업 관련 법률상 이주대책 수립ㆍ실시 관련 규정의 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」으로의 통일적 정비, 사업시행자에게의 택지ㆍ주택 특별공급 알선노력의무의 부과, 공동이주대책제도의 도입 등이 필요하다.
둘째로, 이주대책대상자의 형평성과 공익사업의 원활성을 확보하기 위해서는 택지조성ㆍ주택건설이 수반되는 택지개발사업ㆍ도시개발사업 등의 대규모 공익사업에 한하여 세입자 이주대책의 수립ㆍ실시를 의무화하여야 하며, 주거용 건축물에의 포함여부에 대한 분쟁을 해소하기 위해서는 주거용 건축물의 범위를 명확히 하여야 한다.
셋째로, 이주정착금의 지급과 이주정착지의 조성 사이에 형평성이 유지되기 위해서는 이주정착금의 금액이 이주정착지의 조성에 소요되는 통상적인 수준의 생활기본시설의 설치비용 수준으로 상향 조정되어야 한다.

영어초록

This study was intended to contribute to the faithful protection of people's property right and living right and the efficient promotion of public works by eliciting the problems of the migration measure system of public works with a focus on the legislations and precedents and then finding out its improvements based on it.
For this purpose, an attempt was made to make a jurisprudential approach to interpret the legal principles of the migration measure of public works. Next, this study conducted the case analysis of the implementation, the case analysis of the dispute, precedent analysis and the like in order to analyze the realities of the migration measure of public works. Finally, it attempted to elicit the problems of the migration measure system of public works by synthesizing the interpretation of legal principles and the analysis of the realities and then find out their improvements based on it.
It attempted to elicit the legal and institutional problems of the migration measure of public works with a focus on the equity of the migration measure and the smoothness of public works and find out their improvements. As a result, the following improvements were found out: First, it is necessary to resolve the dispute arising from whether to establish and implement the migration measure according to the kind of public works and the kinds of project developers and a difference in the content of the migration measure. To do this, it is necessary to reorganize the provisions related to the establishment and implementation of the legal migration measure related to individual public works into 「Act on the Acquisition and Compensation of Land etc. for Public Works」, impose the duty to make efforts to offer the special supply of housing site and housing on the project developer and introduce the joint migration measure system.
Second, to secure the equity of those are subject to the migration measure and the smoothness of public works, it is necessary to obligate large-scale public works such as the housing site development project and urban development project accompanied with housing site making and housing building to establish and implement the migration measure for tenants. And it is necessary to make clear the scope of residential building in order to resolve the dispute as to whether to include residential building in it.
Third, there should be the equity between the payment of migration resettlement fund and the making of migration resettlement place. For this purpose, it is necessary to adjust the amount of migration resettlement fund upward to the level of the construction cost of living basic facilities which is the common level required to make the migration resettlement place.
