현행 헌법개정절차의 문제점과 개선방안에 관한 소고 (A Study on the Problems and Improvement Measures of the Current Constitutional Amendment Procedure)

초록

헌법은 국가와 사회를 장기적･지속적으로 향도하는 가치질서에 대한 국민적 합의이므로 헌법의 제정 및 개정은 국민주권이념이 실현되는 대표적인 정치상황이다. 따라서 헌법은 그 의미와 기능에 부합하도록 안정적･항구적이어야 하므로 헌법개정절차는 일반법률에 비해 엄격하여 쉽게 헌법을 고칠 수 없게 하여야 하지만, 헌법 역시 공동체의 사회･경제적 변화 요구를 외면하지 않고 수용하여야 하며, 이를 통해 공동체의 변화와 발전을 때로는 견인하고, 때로는 추진할 수 있어야 한다. 헌법은 공동체의 근본적 가치질서로서 규범적 안정성과 시대의 변화를 반영하는 규범적 역동성 사이에서 동일성을 유지하면서 헌법개정절차를 통해 살아 있는 헌법으로 기능할 수 있다.
우리 헌정사에서 헌법개정의 중요한 계기가 헌법에 내재한 문제의 개선이라기보다는 헌법 외부의 정치적 사건과 이해관계, 그리고 정권유지에 목적이 있었고, 그 과정에서도 헌법이 정한 개정절차나 요건을 위반하여 일방적･강압적으로 개헌이 이루어졌음을 확인할 수 있다. 또한 헌법개정의 헌법적 의미와 민주주의원리에 비추어 특별히 헌법개정절차에서 국민의 의견수렴과 절차참여가 실질적으로 보장되어야 함에도 불구하고, 현행헌법에는 그와 같은 절차와 과정이 전혀 없다는 점을 확인할 수 있다. 이로써 헌법개정절차의 지나친 경직성･엄격성으로 인해 개헌이 어렵거나 불가능하다는 지적과 비판은 설득력이 부족하다.
역동적으로 살아있는 헌법을 위해 헌법개정의 가능성을 높이려면, 헌법개정절차의 경직성 완화보다는 개헌과정에 국민의 의사수렴과 참여기회를 확대함으로써 국민주권이념 및 민주주의원리를 실현하는 관점에서 접근하는 것이 더욱 적절하다고 보인다. 이로써 헌법개정을 제안하기 위한 정치권의 합의와 타협을 유도하고, 국민의 의사와 참여를 명분으로 개헌안에 대한 국회의결을 촉진할 수 있을 것이다. 따라서 헌법상 헌법개정절차를 구체화하고 국민의 의사수렴과 참여의 절차를 확대하려는 입법적 노력이 필요하다.
이러한 의미에서 최근 국회에서 발의된 헌법개정절차에 관한 법률안들은 국회 내 헌법개정논의를 활성화하고 그 과정에서 국민의 의견수렴 및 절차참여를 확대하는 데 목적이 있는 것으로, 국회 스스로 헌법개정에 관한 권한의 범위 내에서 국민의 의견을 수렴하고 참여를 확대하기 위한 조직 및 절차의 법적 근거를 분명히 하고, 국회의 개정안 발의 및 발의된 개정안의 의결 과정에서 국회 및 국회의원의 권한행사에 신중을 기하고 국민의사를 수렴･반영하는 통로의 마련과 참여의 절차를 제도화하고 있으므로 바람직하다고 평가할 수 있다.

영어초록

The Constitution represents a national consensus on the value system that guides the state and society in a long-term and sustainable manner. Therefore, the enactment and amendment of the Constitution are representative political processes that embody the principle of national sovereignty. While the Constitution must remain stable and enduring to fulfill its meaning and function, its amendment procedure should be stricter than that of ordinary laws, making it difficult to change. However, the Constitution must also accommodate the socio-economic changes and demands of the community, thereby sometimes leading and sometimes facilitating the transformation and development of society. As the fundamental value system of the community, the Constitution maintains its identity by balancing normative stability and normative dynamism, ensuring that it functions as a living constitution through the amendment process.
In Korean constitutional history, major constitutional amendments were often driven not by the need to improve inherent constitutional issues but by external political events, vested interests, and the desire to maintain political power. Moreover, these amendments were frequently carried out in a unilateral and coercive manner, violating the amendment procedures and requirements prescribed by the Constitution. Additionally, despite the constitutional significance of amendments and the principles of democracy, the current Constitution does not include any procedures to ensure substantive public participation and opinion-gathering in the amendment process. This challenges the argument that excessive rigidity and strictness in the amendment procedure make constitutional revision difficult or impossible, as such claims lack sufficient persuasiveness.
To ensure a dynamic and living Constitution, rather than merely relaxing the rigidity of the amendment procedure, it is more appropriate to enhance the possibility of constitutional revision by expanding opportunities for public participation and opinion-gathering. This approach better aligns with the principles of national sovereignty and democracy. By doing so, political consensus and compromise necessary for proposing constitutional amendments can be facilitated, and public participation can serve as a legitimate basis to promote parliamentary approval of amendment proposals. Therefore, legislative efforts are needed to concretize the constitutional amendment procedure and expand the processes for gathering public opinion and participation.
