초록

미국에서 유전자편집기술이 개발되면서 유전자의 해석에만 머물렀던 연구가 유전자를 편집 즉 변형시킬 수 있는 수준으로 발전하였다. 유전자편집기술 연구･개발에 있어 선도국인 미국은 유전자편집기술을 이용해 병충해에 강한 작물, 생산성이 높은 곡물 등을 개발하고 대량으로 생산･수출함으로써 자국의 농업･축산업 등 발전을 도모해왔다. 또한 미국은 유전자편집기술을 이용해 약학 분야와 의학 분야에서 신약개발･신종장기 등 새로운 연구･개발에도 집중하고 있다.
이러한 상황에서 국제사회는 유전자편집기술의 위험성을 경고하고 있으며, 특히 유전자편집곡물･유전자편집가축 등과 같은 유전자가 조작된 유전자편집생명체들로 인하여 혹시 발생할 수 있는 예상치 못한 위험성에 대한 안전성이 필수적으로 담보되어야 할 필요성이 있다고 경고했다. 무엇보다 유전자편집기술의 이용과 규제에 대한 논란이 점증하는 상황에서 유전자편집선도국인 미국이 유전자편집기술 연구･개발 등과 관련된 법제도적 측면에서 취하고 있는 입법적 동향은 우리나라에서 유전자편집기술의 이용과 규제에도 시사하는 바가 크다.
따라서 유전자편집기술을 선도하고 있는 미국이 국제사회에서 요구하는 유전자편집기술의 안전성을 확보하기 위하여 어떻게 대응하고 있는지에 대한 현황과 법제도적 장치와 관련된 입법동향을 구체적으로 분석･검토할 필요가 있다.
이를 위하여 본 연구에서는 유전자편집기술에 관한 미국의 입법동향과 우리나라 입법실태와 문제점을 살펴보고 우리나라에서 앞으로 유전자편집기술을 이용 또는 규제하는데 있어 고려해야할 사항을 살펴보겠다. 이를 통해 앞으로 우리나라에서 유전자편집기술이 적절하게 법제도적으로 규제됨으로써 유전자편집기술이 이용돼 연구･개발된 생산물에 대한 안전성이 담보되고 인간존엄성･생명권･환경권 등 헌법적 가치가 침해되지 않는 바람직한 방향을 검토하고자 한다.

In the United States, genetic editing technology has been developed, and studies that only stayed on the interpretation of genes have developed to the point where they can edit or transform genes. The United States, a leading country in the research and development of gene editing technology, has been developing its agricultural and livestock industries by developing and mass-producing and exporting crops with high pesticide-resistance and high productivity using gene editing technology. The United States also focuses on the research and development of new drugs in the fields of medicine and medicine using gene editing technology.
In this situation, the international community warns of the danger of genetic editing technology. Especially, it is essential to secure the unexpected risks that may arise due to genetically modified organisms, such as genetically modified grains, And that there is a need to do so. Most of all, there is a growing controversy over the use and regulation of gene editing technology, and the legislative trends in the legal aspects related to the research and development of gene editing technology in the United States suggest that the use and regulation of genetic editing technology Big.
Therefore, it is necessary to analyze the current state of how the US, which is leading the gene editing technology, is responding to securing the safety of genetic editing technology required by the international society, and legislative trends related to the legal system. For this purpose, this study will examine the legislative trends in the United States and the legislative realities and problems in Korea, and consider the points to consider in using or regulating gene editing technology in Korea.
In the future, we will examine the desirable direction of institutional devices that can guarantee the safety of consumers and the trust of consumers in products that have been researched and developed using genetic editing technology in Korea in the future by safe and continuous use or regulation of gene editing technology.
