동일본 대지진 당시 일본 경찰의 역할과 정책적 시사점 (The Role of Japanese Police during the Great East Japan Earthquake and Policy Implications)

초록

우리나라는 더 이상 지진 등 대규모 재난의 안전국가가 아니다. 실제로 소규모 지진이 지속적으로 발생하고 있고, 태풍과 해일 등 자연재해의 강도가 점차 강해지고 있으며, 끊임 없이 발생하는 인재(人災)가 그것을 뒷받침하고 있다.
그런데, 우리 경찰은 재난 대응 활동이 본질적 직무영역에 포함되는가에 대한 비판적 논의와 관련 법령의 미비, 그리고 이에 따른 소극적 개입으로 인해 재난에 대한 효과적 대응태세를 갖추지 못하고 있다.
이러한 상황에서 우리 경찰은 지난 2011년 발생한 일본의 동일본 대지진(東日本 大地震)에서 일본 경찰이 수행한 역할과 활동을 연구할 필요가 있다. 당시 일본 정부와 관계기관이 부실한 대응으로 인해 중대한 국민적 비판에 직면했음에도 일본경찰은 사태 발생 초기부터 인명구조, 재해 복구 등에 있어 상당한 성과를 나타냈고, 사태 이후에도 관련 법령을 보완하고 제도와 체계를 개선하는 등 지속적인 노력을 전개하고 있어 중요한 시사점을 제시하고 있다.
따라서 이 연구에서는 동일본대지진 당시 중요한 역할을 수행한 일본경찰의 사례를 살펴봄으로써 과연 한국경찰이 어떠한 재난 대응체계를 구축해야 하는지, 그리고 관련 법령은 어떠한 방향으로 변화해야 하는지를 모색해보고자 하였다.
연구결과, 한국 경찰은 첫째, 「재난및안전관리기본법」을 개정하여 일본과 마찬가지로 경찰의 지위와 역할을 보다 명확히 규정하고, 재난 대응에 있어 그 지위를 격상시켜 활동 및 역할과 그 지위가 상호 부합되도록 해야 할 것으로 나타났다. 또한 「경찰재난관리규칙」 역시 일본과 같이 재난의 유형을 상세화하고 그에 대한 대책을 보다 구체적으로 명시할 필요가 있을 것으로 보인다. 둘째, 재난에 대한 보다 신속한 대응을 위해 각 지방경찰청을 단위로 광역적 지원부대를 편성하고 지역경찰관 등 타 분야의 경력을 동원할 수 있는 방안도 구체적으로 마련되어야 할 것으로 나타났다. 셋째, 일본 경찰과 같이 교육훈련의 시간을 대폭 확충하여 현재의 법정 교육훈련 시간을 2배 이상 확대하고, 각 교육훈련의 내용을 명확히 적시하여 내실 있는 교육이 이루어질 수 있도록 하며, 간부급 경비 경찰에 대해서는 전문화 교육을 확대해야 할 것으로 보인다. 넷째, 재난 발생 이전부터 종료시까지 경찰이 대응해야할 사항과 구체적 대응 방법 등을 상세히 매뉴얼화하고 이에 따른 상세한 대응 지침을 마련해야 할 것으로 나타났다.

영어초록

Our country is no longer a safe country against major disasters such as earthquake. In fact, small scale earthquakes are continuously occurring, and intensity of natural disaster such as typhoon and tidal wave is gradually intensifying, which is supported by endlessly occurring man-made disasters.
However, our police has not prepared effective response readiness against disaster due to lack of critical discussion on if disaster response activity should be included in the essential job function, as well as lack of related legislation and passive intervention.
In the midst of such situation, our police needs to study the role and activities of the Japanese police in the Great East Japan Earthquake occurred in 2011. In spite of facing critical national criticism at the time due to insufficient response by the Japanese government and related organizations, the Japanese police showed significant results in life rescue, disaster recovery, etc. from the initial stage of the situation, and made continuous efforts even after the situation ended such as supplementing related legislation and improving policy and system, which presents important implications.
Accordingly, the purpose of this study was to examine the case of Japanese police that played an important role during the Great East Japan Earthquake to examine the desirable type of disaster response system that should be established by the Korean police, as well as the desirable direction of change in related legislation.
The study result revealed that, first, the Korean police should revised the 'Disaster & Safety Management Basic Act' to more clearly define the status and role of the police, as in the case of Japan, and elevate the status of disaster response according to the related activity and role. In addition, there is a need to specify the type of disaster in the 'Policy Disaster Management Regulation', as in the case of Japan, and more specifically state according measures. Second, it was also found that for more swift response against disaster, regional support units should be organized for each local police agency, as well as specifically preparing a plan to mobilize police force in other areas such as local policemen. Third, it would be necessary to extensively increase education & training time, as in the case of the Japanese policy, to increase the current legal education & training time by twofold and clearly state the contents of each education & training to allow substantial education, while expanding expert education for executive level security policy. Fourth, it was found that the items and specific response methods of policy should be made into manual in specific from the occurrence and end of disaster, as well as prepare according response guideline in specific.
