공간정보 법제의 문제점과 개선방안에 관한 연구 (A Study on Problems of the Legal System for Spatial Data and Improvement Measures)

초록

공간은 모든 인간이 생활하는 터전이며 인간의 의식은 필연적으로 공간에 근거한다. 공간은 시간과 더불어 모든 현상이 드러나는 장이므로 여러 가지 학문적 이론은 불가피하게 공간에서 출발한다. 이러한 공간이 자연적이든 인공적이든 인간에게 공간은 삶의 기본적 터전이다. 이러한 삶의 기본 터전에 대한 관심은 공간에 대한 새로운 정보의 요구로 이어지고 있다고 할 수 있겠다. 즉 미세먼지, 오존층 파괴 등 대기, 토양, 수질 등 환경오염의 증가와 각종 재난･재해, 식량과 자원의 부족 등 인류의 생존과 국가 안전을 위협하는 많은 요인들 앞에 직면해 있다. 이러한 문제를 해결하기 위해서는 공간의 객관적 정보를 바탕으로 정확한 의사결정이 요구된다. 또한 정보와 함께 인문･경제･사회현상에 대한 다양한 데이터와 결합하여 새로운 부가가치를 창출하는 등 공간정보의 새로운 영역이 부상하고 있다.
공간정보란 지상･지하･수상･수중 등 공간상에 존재하는 자연적 또는 인공적인 객체에 대한 위치정보 및 이와 관련된 공간적 인지 및 의사결정에 필요한 정보를 말한다(국가공간정보기본법 제2조 제1호). 이에 따라 정부는 국가공간정보체계의 효율적인 구축과 종합적 활용 및 관리에 관한 사항을 규정함으로써 국토 및 자원을 합리적으로 이용하여 국민경제의 발전에 이바지함을 목적(국가공간정보기본법 제1조)으로 “국가공간정보 기본법”을 제정함은 물론 “공간정보의 구축 및 관리에 관리등에 관한 법률”, “공간정보산업진흥법”을 제정하여 국가공간정보의 환경변화에 대한 대비를 하였다.
하지만 위의 공간 관련 3개의 법의 상호관계의 모호함으로 인한 중복이라든가, 공간정보의 유통에 따른 개인정보의 보호 문제 등의 보완의 필요성이 제기되고 있다.

영어초록

A space is the base of living for everyone and a person’s sense is based on the space inevitably. Since the space is the place where all phenomena are revealed along with time, various academic theories start from the space inevitably. Whether the space is natural or artificial, it is the fundamental base of living for people. The interest in this fundamental base of living is leading to the demand for new information about the space. In other words, the space is faced with various factors that threaten humanity’s survival and national security such as increasing environmental contamination in the air, soil, and water including fine dust and the destruction of ozone layer in addition to various disasters and calamities and the insufficiency of food and resources. It is necessary to make accurate decisions based on the objective data of the space in order to resolve such problems. Also, a new area involving spatial data such as the creation of new added values in combination with various data on humanities, economics, and social phenomena along with such data is emerging.
Spatial data refers to the location information of natural or artificial object that exist on the ground, under the ground, on the water, or under the water and the information required for spatial recognition and decision making related with the object (Article 2.1 of the National Spatial Data Infrastructure Act). The government established the “Framework Act on National Spatial Data Infrastructure”, the “Act on the Establishment, Management, Etc. of Spatial Data”, and the “Spatial Data Industry Promotion Act” in order to stipulate matters relating to the efficient development and comprehensive use and management of a national spatial data system to contribute to the advancement of national economy through the rational use of national land and resources (Article 1 of the National Spatial Data Infrastructure Act) in preparation for environmental changes in national spatial data.
However, the redundancy caused by the planned systems of the said three space related laws and the ambiguity in the interrelation between them as well as the issue of protecting personal information in relation to the distribution of spatial data shall be resolved.
