기본권으로서 교권에 대한 논의 -교권보호의 출발점- (A discourse on teacher’s rights as fundamental human rights -the starting point for protection of teachers' rights-)

초록

현재 우리 사회에서 교사는 안정적인 직업으로서 선호되고 있지만, 실제 교육현장에서는 존경받지 못하고 있고 교권침해도 심각하게 일어나고 있다. 본 연구는 그 이유로 공교육과 교권 개념에서 인권 요소가 배제된 점을 주목하였다. 헌법은 ‘교육을 받을 권리’를 국민의 기본권으로 규정하고, 국가의 교육기본권 보장 의무를 명시하였다. 교육기본권이란 교육을 통해 개인의 성장과 발달을 보장받을 권리를 말하며, 교권보장을 전제로 한다. 교육기본권 실현을 위해 교사는 국가 권력으로부터 ‘교육의 자유’와 시민으로서의 ‘정치적 자유’를 기본권으로 보장받아야 한다. 그러나 학생의 성장과 발달할 권리는 간과되고 있으며, 교사는 공무원이며 가르치는 대상이 미성숙하다는 이유로 기본권을 제한받고 있다. 기본권 제한은 현행 법률을 통해 뒷받침되고 있으며, 정부의 교육지배를 관철시키려는 의도와 맞물리면서 교권침해가 일어나고 있다. 1980년대 이후 교사의 기본권을 법제화하려는 시도가 교사들을 중심으로 전개되었으며 일정 부분 성과를 거두었다. 최근 학생인권조례와 교권조례 제정은 교사와 학생의 기본권을 제도화하려는 시도로서, 교사․지자체․시민사회가 연대해 이루어지고 있다. 교육을 인권 관점에서 해석하고 교육주체 스스로 기본권을 확보하려는 시도는 교육패러다임의 전환에 버금간다고 할 수 있다. 반면, 학생인권과 교권은 대립한다는 교권침해담론과 그에 기초한 정부의 교권보호정책은 학생과 교사의 기본권 제약을 전제하고 있다는 점에서 한계가 있으며, 교육기본권 보장과는 배치되는 교육통제적 관점을 고수하려는 노력으로 볼 수 있다.

영어초록

Teachers in our society are preferred as a stable job. However, in fact, teachers are not getting respect and their rights are seriously threatened. This study focused on the fact that the concept of human rights are excluded in public education and teachers' rights is the one reason. The Constitution defines “right to education” as the people's fundamental right and specifies the nation's obligation to ensure their fundamental right to education. Fundamental right to education means the right to personal growth and development through education. To ensure teachers' rights is a prerequisite for guaranteeing fundamental right to education. Teachers' ‘freedom of education’ and ‘political freedom’ as a citizen from the government power should be guaranteed by the constitution to realize students' fundamental rights to education. However the right to personal growth and development of student has been overlooked. And teacher's fundamental rights are being constrained for teachers are public servants and teach immature students. The limits of fundamental rights are supported through the current law and it is combined with the intention of government to control education. It infringes teachers' rights. Since the 1980s, attempts to legislate teacher's fundamental rights have been deployed around the teachers and there were some achievements. Recently the regulations of ‘Students’ human rights ordinance’ and ‘Teachers’ rights ordinance' is attempts to institutionalize fundamental rights. It have been made through solidarity with the teachers, local government and the civil society. Interpreting education in terms of human rights and subject of education's attempting to secure basic rights by themselves may be closer to an education paradigm shift. On the other hand, a discourse on infringement of teachers' rights that students' human rights are opposed to teachers' rights and government's policy to protect teachers' rights based on this discourse is limited in that it assumes restriction to fundamental rights of students and teachers. And it is an effort to adhere the view of education control which is opposed to guaranteeing fundamental right to education.
