초록

최근 식품안전에 관한 사건ㆍ사고 소식은 국민들의 불안감을 가중시키고 식품으로부터 야기되는 위험이 점증되고 있는 상황에서 우리나라를 비롯한 세계 각국에서는 식품안전을 확보하기 위한 수단으로서의 규제시스템을 정비하고 있는 상황이다. 지금까지는 식품안전상의 문제를 해결하기 위해 산발적인 규제방식이 채택되어 왔던 것이 현실이다. 하지만 오늘날 식품안전에 대한 규제시스템은 새로운 국면에서 바라볼 필요가 있다. 유럽에서는 일찍이 EU 통합과정에서 통일적인 식품안전 규제시스템을 구축하고자 하는 노력이 지속적으로 이루어져 왔다는 점을 주목할 필요가 있다. 법공동체로서의 EU가 식품안전에 대한 규제를 어떻게 하고 있는지를 살펴보는 것은 우리에게도 시사하는 바가 크다고 할 것이다. 이를 통해 우리도 식품안전의 확보와 식품산업의 발달을 위한 새로운 규제시스템의 구축을 시도할 수 있을 것이다. 지금까지 각국의 식품안전을 확보하기 위한 규제수단들이 효과적이지 못하였음에도 불구하고, EU 차원에서 총합적인 규제시스템을 구축하려는 시도에 대하여는 긍정적인 시각과 비판적인 시각 모두가 존재하고 있다. 그러나 법치주의를 표방하는 28개 EU 회원국들에 통용되는 원리를 바탕으로 한 현재의 EU 식품안전 규제수단들을 분석하는 것은 우리의 식품안전 규제시스템의 모델을 구축하는 데에도 시사점을 제공할 수 있을 것이다. 본고에서는 EU 식품안전규제에 대한 전반적인 내용을 검토함으로써 장차 이 분야의 규제시스템이 어떠한 방향으로 나아갈 것인지를 살펴보았다. 오늘날 유럽연합의 식품안전 규제시스템은 회원국들의 효율적인 식품안전 규제시스템의 구축을 위해 통합의 방향으로 나아가고 있다. 이러한 통합은 정치적, 경제적, 사회적 요인들로 인해 달성하기 어려운 측면이 있는 것이 사실이다. 그러나 유럽 식품안전법상 규제개혁의 방향은 규제기준의 통합을 위한 단계를 점진적으로 밟아 나아가고 있다.
오늘날의 28개국의 회원국을 보유하게 된 유럽연합이 하나의 공동체를 형성해 나아가는 길은 험하고도 먼 과정이 될 수 있다. 역사적으로 각 회원국의 식품문화와 농업정책은 매우 다양한 방식으로 전개되어 왔기 때문에 이를 통합적으로 규율하는 합의점을 찾는 것이 쉽지 않은 일이기도 하다. 유럽 각국의 문화적 다양성은 정치, 경제상황과도 연계되어 있기 때문에 EU 통합의 측면에서는 장애물이 될 수도 있다. 하지만 식품안전 분야에서 통합된 규제기준을 정립함으로써 유럽연합의 회원국들은 보다 안정적인 식품유통을 통해 식품산업분야의 발전을 이룰 수 있을 것이다. 왜냐하면, 소비자들은 EU가 제정한 높은 수준의 규제기준을 신뢰하고 식품을 선택할 수 있기 때문이다.
유럽에서의 식품안전 규제기준의 통합의 방향은 높은 수준으로 소비자의 건강을 보호하는 것을 목적으로 하기 때문에 우리에게도 시사하는 바가 크다. EU 차원에서 식품안전의 확보를 위한 규제통합의 문제는 오늘날 국제화시대에 있어 모든 국가들이 관련된 문제이기도 하기 때문이다.
특히 최근에 제정된 우리의 식품안전기본법은 식품안전분야에 있어서 기본법으로서의 역할을 수행하게 되었다. 동법은 앞으로 지속적인 보완이 필요하다는 점에서 EU에서 시도되는 통합적 규제시스템의 구축은 참고가 될 수 있을 것이다. EU의 회원국들 사이에서의 식품문화가 다양하듯이 유럽연합에서의 상황과 우리의 상황이 같지 않기 때문에, 여기서 우리가 참고할 수 있는 것은 EU 차원 큰 틀에서의 행해지고 있는 식품안전규제의 기본 원칙과 방향이 될 것이다. 이러한 기본 원칙과 방향은 국제화시대에서 국민의 건강을 보호하고 식품산업의 발달을 도모할 수 있는 우리의 규제기준을 정립하는 데에도 참고가 될 수 있을 것이다.

Recent Incidents and accidents news about food safety increase the anxiety of the people. By arising risks caused from food, Korea and other countries are now going to set up new regulatory system to ensure food safety. Until now, in fact we've been adopted sporadic regulatory approach to solve the problem of food safety. But for the development of food safety regulatory system, we need to solve the problem in different way. The effort to establish a unified food safety regulatory system in the EU is worthwhile, because the regulatory system of EU has been constantly reformed. EU community law shows, how the regulations on food safety going on. It could give us greater implications for our new regulatory system. Through this we will be able to make a reconstruction of regulatory system for ensuring food safety and the development of the food industry. Despite today’s regulatory measures in world including Korea did not ensure food safety, there are positive and negative perspective with respect to all attempts of EU level to establish the unified regulatory system for food safety. However, through the analysis of the current EU food safety regulations, we can find, that it is based on the consistent principle that prevailed in the 28 EU Member States to advocate the rule of law. So it will offer us some suggestions to build a new model of food safety regulatory system. This paper examined the regulatory system in this area. By examining the overall information on EU food safety regulation, we can find the way of regulation in the area of food safety. Today, regulatory system for food safety in the European Union is moving towards integration to build an efficient unified regulatory system. It is true that this integration is difficult to achieve because of the political, economic and social factors. However, the direction of the European regulatory reform of Food Safety is going for the integration of regulatory standards.
Today the European Union would go long and winding road to reach a unified community because of its 28 Member States. Historically, it is also not easy to reach a compromise between Member States, because the Member States have respectively different agricultural policy and food culture. Since the cultural diversity of Europe is also linked with the political and economic situation, it could be more difficult to reach the integration of EU. However, by establishing an integrated regulatory standards in the field of food safety in the EU, Member States will be able to achieve the development of the food industry with a more stable food distribution. The consumers can select the safe foods based on the high level regulation, which EU enacted.
The regulatory standards in Europe intend to protect health of consumers at a high level. So european regulatory issues of integration is helpful for us to ensure food safety. This issue can be also applied to us, because today all the countries are involved in globalization.
Especially our Basic Food Safety Act, which was enacted in recent years, will play a role as the Basic Law in the field of food safety. This Act needs to be amended and developed. In this context, the unified regulatory system in the EU could be a reference for us. As food cultures among the EU Member States are diverse, so ours is different from that of EU countries. So we can refer merely to the basic principles and directions of food safety regulation that is carried out in the framework of EU level. These basic principles and directions could be used as a reference to establish our regulatory standards to promote the protection of public health and the development of the food industry in the era of globalization.
