주택법상 지역주택조합의 문제점과 개선방안 (A Study on the Problems and Improvement Plan of Housing Cooperatives in Housing Law)

초록

현재 지역주택조합은 조합 설립인가를 위한 조합원 모집 시 관할 행정청의 관리 및 감독 없이 자율적으로 이뤄지고 있는 실정이고 관할 행정청은 피해 및 민원 발생 이전에는 조합 설립인가 전의 임의단체가 조합원을 모집하는 행위에 대한 실태파악이 불가능하며, 조합에 가입하려는 자 또한 객관적이고 정확한 정보를 사전에 파악하기 어려워 이를 악용한 피해가 증가하고 있다.
이에 조합원의 모집과정의 투명성을 제고하기 위하여 조합원 모집 신고 및 공개모집을 의무화하고, 관할 시장․군수․구청장이 신고서를 수리한 경우 신고 받은 내용 중 토지확보(토지사용승낙 포함) 현황, 토지이용계획에 따른 사업계획 타당성 등의 검토자료를 사업현장 사무실과 인터넷에 게재하도록 하고 조합원 자격 상실 등으로 조합 구성원 등이 조합을 탈퇴한 경우 해당 조합원이 납부한 납입금에 대한 원활한 환급을 지원하기 위하여 환급금액 및 환급시기를 명확화하고, 이를 위반한 경우 처벌토록 하여야 한다.
한편 지역주택조합은 주택건설대지의 95퍼센트 이상의 소유권을 확보하도록 하고 있어, 오히려 토지소유권 확보를 위한 자금조달 어려움과 사업지연에 따른 금융비용 증가 등으로 조합원 부담 가중 및 사업 좌초의 원인이 되고 있는 실정이므로 조합의 주택건설 사업기간 단축 및 자금조달 부담을 완화하도록 주택건설대지면적의 95퍼센트 이상의 소유권 확보가 아니라 사용권원을 확보하면 사업계획승인을 신청할 수 있도록 인가요건을 완화하여야 할 것이다.
그리고 우리나라 국민의 약 70%가 공동주택에 거주하고, 2015년말 현재 15년 경과된 공동주택이 약 632만 호수(약 20만 주택단지)에 이르고 있어 공동주택 리모델링을 위한 지원은 부족한 실정이다.
이에 공동주택 리모델링사업의 원활한 수행을 위하여 시장․군수․구청장이 공동주택 리모델링기금을 설치하여 지역주택조합사업에도 지원범위를 확대함으로써 주택조합형 리모델링을 활성화하여야 한다.
그리고 현재 지역주택조합 사업 현장에는 과장 내지 허위로 광고를 함으로서 조합가입을 권유하고 있는 실정이다. 이에 사업주체가 주택에 대한 표시 또는 광고를 한 경우 그 사본을 시장ㆍ군수ㆍ구청장에게 제출하도록 하고, 주택공급계약을 체결할 때 입주예정자에게 그 사본에 관한 정보를 제공하도록 하며, 사본을 제출하지 아니하거나 거짓으로 제출한 경우 500만원 이하의 과태료를 부과하도록 하여 주택 공급과 관련한 허위ㆍ과장 광고의 조사를 용이하게 함으로써 그 통제를 강화하여야 한다.
또한, 비전문가인 입주자가 최종 사용검사 전에 품질 이상 여부를 확인하기에는 한계가 있어 입주자들이 주택 하자에 따른 피해를 입고 있는 실정이다. 이에 사업계획승인권자는 대통령령으로 정하는 호수 이상의 공동주택의 품질과 관련된 분쟁을 사전에 예방하고, 견고하고 내실있는 공동 주택 건설을 촉진하기 위하여 공동주택 품질 검수단을 설치하여 운영하도록 하여 견본주택과 입주주택과의 차이를 해소하여야 하겠다.
마지막으로, 재개발구역에서 지역주택조합으로 사업을 전환하는 경우에는 전환이 신속하게 이루어지도록 구역해제요건을 추진위원회 설립 내지 조합인가신청에 동의한 조합원 수 50% 이상의 해제 동의가 있으면 구역해제를 할 수 있는 것으로 개정하여야 할 것이다.
