중국의 징벌적 손해배상제도와 그 시사점 (China’s legislation practices with punitive damages and their implications for Korea)

초록

현대 대량소비사회에서는 가해자의 행위가 악의적이고 반사회적일 경우 전통적인塡補적손해배상만으로는 효과적인 규율이 어렵다. 이에 따라 종래의 민사상 불법행위책임에 형벌적 성격의 벌금을 혼합한 징벌적 손해배상의 도입 및 확장 필요성이 주장된다. 영미법에서 유래한 징벌적 배상제도가 대륙법계인 우리나라에서도 2011년<하도급거래 공정화에 관한 법률>에 그리고 2015년에는 <개인정보보호법>에 각각도입되었으며 그 도입의 확장을 둘러싼 찬반논의가 있다. 징벌적 손해배상제도가 발달한 영미법과는 달리 대륙법계에서는 아직 입법례가 많지 않으나 중국은 실용적인관점에서 이미 수 개의 개별법에 의해 동 제도를 운용하고 있다. 우리나라 보다 이른1993년에 <소비자권익보호법>을 시작으로 <계약법>, <식품안전법>, <불법행위법>, <관광법>, <상표법>등에 규정되었고 2015년에는 <식품안전법>을 개정하여 징벌적배상책임을 강화한 바 있다. 앞으로도 징벌적 배상제도를 도입하는 개별법규가 점차확대될 추세에 있고 심지어는 입법이 추진 중인 민법전에 일반규정으로 도입하는 방안도 거론되는 상황이다. 우리나라에서는 아직 징벌적 손해배상제도가 입법상 도입초기단계이나 앞으로 소비자보호⋅공정거래⋅식품위생⋅제조물책임⋅환경침해⋅언론구제등 당사자간의 관계가 대등하지 않은 사회영역에서 유용한 법정책적 수단이될 것이다. 이러한 관점에서 볼 때 같은 대륙법계인 중국의 입법사례는 그 장단점의연구를 통하여 우리나라의 입법논의에 있어서 중요한 참고가 될 것이다.

영어초록

In today’s mass consumption society, the traditional compensatory damages alone would not have a sufficient disciplinary effect when the offender’s misconduct is in bad faith and antisocial. For this reason, there is a demand for punitive damages – a combination of civil liability for tort actions and penal fine – to be introduced and enforced on a broad basis.
Korea is one of the countries that primarily practice civil law. However, it has incorporated in <Fair Transactions in Subcontracting Act> and <Personal Information Protection Act> in 2011 and 2015, respectively, the punitive damages which are based upon common law. In contrast to common law-based laws where punitive damages are an established practice, civil law-based laws have incorporated the provisions only in a limited basis. Meanwhile, China has taken a practical approach and is already implementing punitive damages in individual laws. The country has taken an early move to introduce punitive damages in <Law of the PRC on the Protection of the Rights and Interests of Consumers> in 1993, followed by <Contract Law of the PRC>, <Food Safety Law of the PRC>, <Tort Law of the PRC>, <Tourism Law of the PRC>, and <Trademark Law of the PRC>. Taking a step further, introduction of punitive damages as a general provision in Chinese Civil Code is under discussion. Korea is still in its early stage in introducing punitive damages by legislation. Apart from the two laws that currently provide the provisions, punitive damages will provide an effective legal means in many areas such as consumer protection, fair transaction, food sanitation, product liability, environment pollution, and press arbitration and remedy where the parties involved are not equal in their relations. In the aforementioned areas, punitive damages are expected to be more broadly applied given its functions of punishment, prevention and deterrence of unlawful acts. In this context, China’s legislation practices with punitive damages will provide a useful reference for legislation in Korea as Chinese laws are also based on continental-law principles
