국민참여재판 배제제도의 문제점과 개선방안 (Problems and Improvement Measures of the Exclusion System for the Korean Jury Trials)

초록

2008년 처음 실시된 국민참여재판은 올해로 출범 14년째를 맞게 되었다. 출범초기에는 국민참여재판의 실시건수가 꾸준히 증가하여 일반국민의 사법참여를 통해 국민의 사법부 신뢰와 재판의 민주적 정당성을 제고하고자 했던 제도도입취지가 무난하게 달성되는 듯 보였다. 그러나 국민참여재판은 출범 초기 활성화 조짐과는 극명하게 대비되는 모습으로 현재 큰 위기를 맞고 있다. 본 연구에서는 국민참여재판의 위기에 맞서 이를 활성화하기 위한 학계에서의 논의와 국회의 입법활동의 검토를 통해 국민참여재판 활성화를 위한 입법적 개선의 단초를 모색해 보았다. 그리고 국민참여재판의 위기의 주요원인으로 높아진 국민참여재판 배제율 지적하고, 높은 배제율의 원인으로 지적되는 국민참여재판 배제제도의 개선방안을 검토하였다. 본 연구에서 제시한 배제제도 개선방안은 다음과 같다.
첫째, 국민참여재판법 제9조 제1항 제1호 배제사유의 경우 국민참여재판의 활성화를 위해서라면 일부 견해와 같이 제1호의 사유가 있을 경우 배제결정을 하여 국민참여재판을 실시하지 않는 것이 아니라 새로운 배심단을 구성하여 국민참여재판을 시행하는 것이 타당하므로 제1호의 규정을 삭제하여야 한다. 둘째, 국민참여재판법 제9조 제1항 제3호 배제사유의 경우 제3호의 존재 자체가 성폭력범죄 피해자의 불원의 의사가 있는 경우 법관들에게 재량행사를 통한 국민참여재판을 실시에 너무 큰 부담으로 작용하고, 실제로 대부분 배제결정이 이루어졌던 현실을 고려할 때, 성폭력사건

영어초록

This year marks the 14th anniversary of the first Korean Jury Trials held in 2008. The purpose, which is to engage in the judiciary and democratic legitimacy of the trial through the participation of the general public, seems to accomplish its goal smoothly. The Korean Jury Trials, however, confronts with crucial problems that are against the primary blueprint as initiating the system. This study presents the basis for legislative improvement to revitalize the Korean Jury Trials through academic discussions and reviews the legislative activities of the National Assembly to re-establish the system of the public participation trials. In addition, this study indicates the increased exclusion rate of the Korean Jury Trials as a major cause of the crisis of the Korean Jury Trials and analyses methods to improve the exclusion system of the Korean Jury Trials. The measures to enhance the exclusion system suggested in this study are as follows.
First, Article 9 (1) of the Act On Citizen Participation In Criminal Trials shall be removed. Second, in the case of exclusion under Article 9(1) 3 of the Act On Citizen Participation In Criminal Trials, the existence of Article 9 (1) 3 itself is extremely burdensome for judges to conduct the Korean Jury Trials through discretionary exercise, and it is obvious the validity to abolish subparagraph 3. Victims of sex offenses, moreover, should be relieved of the burden of carrying out the Korean Jury Trials through the proposed victim protection system. Third, in the case of Article 9 (1) 4 of the Act On Citizen Participation In Criminal Trials, it proposes to eliminate the general nature of subparagraph 4 and to list them in detail. Not only does this study argue for the deletion of subparagraph 4, but also it advances to add cases, in which additional prosecutions are expected concerning that the defendant’s right to a swift trial will be violated due to significant delays in procedures. The specific reasons for the enumeration, however, should be revised according to the circumstances of the Korean Jury Trials in the future. Forth, as a way to improve the exclusion system by applying objective and unified exclusion decision criteria, this study suggests a method of establishing separate exclusive decision panels where determine whether or not to be excluded, instead of the court of a lawsuit.
