연명의료결정법의 문제점과 개선방안 (A Study on the Problems and Solutions of the Law of Determination of Medical Care for Life Prolongation)

초록

임종과정에 있는 환자의 자기결정권과 인간의 존엄성을 존중하여 연명의료를 중단시킴으로써 품위 있는 죽음을 맞이하도록 하자는 「연명의료결정법」이 지난2016년 2월 3일 제정되어 2017년 8월 4일부터 시행을 앞두고 있는 시점에서 본고는 이법이 안고 있는 문제점을 분석하고 다음과 같이 개선방안을 제시하였다.
첫째, 현행법은 환자의 연명의료중단결정을 의사의 판단에만 전적으로 의존하고 있어서생명권 침해의 위험이 있으므로, 해당 의료기관에 ‘연명의료판정위원회’와 같은 기구를 별도로 설치하여 연명의료중단 여부를 결정하도록 하는 방안이 고려되어야 한다.
둘째, 의사의 연명의료중단 결정에 법정대리인의 대리와 가족의 동의를 요건으로 하고있는 현행법은 환자의 자기결정권을 침해하는 것이므로, 이에 대하여 법원의 허가를 받아결정을 할 수 있도록 하는 청구권을 환자의 법정대리인에게 부여하여야 한다.
셋째, 연명중단결정 대상이 미성년자일 경우 그의 친권자의 의사표시와 의사의 확인만으로 연명의료중단을 할 수 있도록 하고 있는 현행법은 미성년자의 생명에 대한 자기결정권을 지나치게 침해하고 있으므로 이를 적용할 수 있는 대상을 10세 미만으로 낮추는 것이 바람직하다.
넷째, 이 법의 벌칙조항에 정한 법정형이 너무나 경하므로 벌칙 규정을 보다 엄격한 내용으로 개선하여야 한다.
마지막으로 국가연명의료관리기관, 의료기관윤리위원회, 위에서 주장한 연명의료판정위원회, 연명의료중단환자 등에게 소요되는 비용을 정부차원에서 체계적으로 지원하고 건강의료보험제도 등 사회복지제도의 확충이 절실히 필요하다.

영어초록

The Law of Determination of Medical Care for Life Prolongation was enacted on February 3, 2016 and will be implemented from August 4, 2017. The law aims at providing dying patients with dignified death by discontinuing ‘the medical care for life prolongation’(hereafter, MCLP) to respect their self-determination and human dignity. This paper analyzes the problems of this law and suggests the solutions as follows.
First, the current law depends entirely on doctors’ decision for the determination of MCLP, giving the danger of the violation of rights to life. Therefore, they should consider the way of setting up a separate organization such as the committee for judging MCLP and letting it decide whether or not it will stop the service.
Second, the current law infringes on patients’ rights of self-decision because it gives doctors’ decision of stopping MCLP the same effect of agreement as the patients’ legal representatives and family have. As to this situation, they should authorize the patients’ legal representatives to ask for the decision of stopping MCLP by permission of the court.
Third, the current law regulates that if the object of the choice of ending MCLP is a minor, his or her person with their parental rights can enable the activity merely by letting their will declared and confirmed. This provision violates the minor’s self-determination rights of his or her life too much, and so the age range should rightfully be lowered to less than 10.
Fourth, the legal punishment that the penalty clause of this law has is too light, and so they should improve the penal provisions with stricter contents.
Finally, it is necessary that the government should, together with the expansion of social welfare system such as health insurance program, systematically support the cost spent on the National Management Agency of Medical Care for Life Prolongation, the Ethics Commission of Medical Organization, the Committee for Judging Medical Care for Life Prolongation stated above, the patients whose MCLP will be stopped, and so forth.
