공공후견인의 직무 분석과 그 시사점 (Analysis of the Workload and Performance of Public Guardians and its Implications)

이 연구는 성년후견제도가 시행된 지 3년차에 접어들면서 공공후견서비스를 제공하고 있는 후견인의 직무내용, 업무 만족도, 기타 후견서비스 실태를 분석함으로써 공공후견서비스에 대한 정책적⋅실천적 개선방안을 제시하기 위한 목적으로 수행되었다. 이를 위해 전국에서 후견서비스를 제공하고 있는 공공후견인 152명을 대상으로 설문조사를 진행하였다. 주요 조사결과는 다음과 같다. 후견서비스를 제공하는 피후견인의 인원은 일인당 1명이 54.6%로 가장 많았고, 후견인 일인당 피후견인 2명이 31.6%, 그리고 피후견인 3명 이상이 11.2 %, 피후견인 5명 이상도 2.6% 등으로, 3명 이상 다수의 피후견인에게 서비스를 하는 경우가 13 %로 나타났다. 공공후견서비스 제공 활동에 대한 만족도는 평균 3.08점으로 4점 만점인 척도에서 비교적 높은 점수로 나타났다. 그러나 ‘소요 노력, 시간, 비용 등을 고려하여 기대하였던 것보다 만족한다'는 질문에 대해서는 평균점수가 2.72점으로 낮게 파악되었다. 후견서비스를 재산관리와 신상보호로 나누어 보며, 재산관리는 35.9%, 신상보호 서비스는 53.9%, 재산관리와 신상보호 양 측면에 걸쳐 있는 분야가 10.2%였다. 저소득층을 대상으로 하는 공공후견서비스에서도 재산관리의 비중이 결코 낮지 않았다. 은행, 신탁, 보험사 등 금융기관에 대한 만족도는 평균 2.11점으로 매우 낮은 만족도를 나타냈고, 법원 등 법률기관 또한 평균 2.29점, 시청⋅구청⋅동 주민센터 등 관공서도 평균 2.33점으로 낮은 만족도 점수를 나타냈다. 관공서나 금융기관 등에서 후견활동 업무를 진행할 때 담당자들의 후견서비스에 대한 이해도가 매우 낮았음을 보여주는 것이다. 이런 결과 및 기타 여러 항목의 조사결과를 바탕으로 공공후견정책에 대한 개선방안을 제시하였다.

영어초록

The new adult guardianship system in Korea came into force as from 1st July 2013. Since then, many problems surrounding the legal status of guardians and quality of guardianship services have surfaced. This study describes the background, contents of guardianship services, and the satisfaction of public guardians who have been financially supported by government and local authorities. Thereby, this study aims finding the problems arising from public guardianship services and ways to improve those services. The research method of this study is based on a survey of public guardian providing actual services. For that purpose, this study conducted a survey from January 19, 2016 to February 29, 2016, whose final respondents of questionnaires were 152.
The main results of the survey are as follows: Services of public guardians were asset management related services (35%), personal and welfare related services (65%). Personal satisfaction of public guardian about their service providing activities was higher by 3.08 points in 4 points. Satisfaction about their work process was 2.56 points, lower than the former. Satisfaction about organizations that engage in providing public guardianship services was an average of 2.5 points.
Efforts of guardian attempting to communicate is related to listening to the story of the ward and discussing with the family(86%). The biggest problem, which public guardians felt during their providing guardianship services, is the lack of awareness of the general public on the needs of guardianship services(31.7%), difficulties of communication(29.0%), low guardian activity costs(25.3%).
Political and practical implications are as follows: First, public guardianship services should be expanded in order to facilitate the delivery of public assistance and social services for the poor with mental and intellectual disabilities. Second, the awareness of the public on the rights of mentally and intellectually disabled persons to self-determination should be raised. Third, to efficiently provide public guardianship services, guardianship cooperation should be located at the center of the said services.
