포괄적 국제테러리즘협약 논의점분석 및 검토 (Analysis and Examination of Discussion Point to Enact Comprehensive Convention on International Terrorism)

초록

현재 테러를 포함한 무력에 대한 합법적인 대응방식은 해당 국가가 가입한 국제협약과 국내 법률에 의해 규율되고 있다. 최근 UN에서는 기존의 협약들을 보완하는 포괄적 국제테러리즘협약의 제정, 채택, 발효를 의도하고 있다. 이것은 테러대응에 있어 기존 협약들이 가지고 있는 흠결을 보완한다는 의미도 있고, 현시점에서 국제사회가 가지는 테러에 대한 공동의 대응의지를 표명하고자 하는 의미도 있다.
본 논문에서는 포괄적 국제테러리즘협약(comprehensive convention on international terrorism)이 필요한 이유와 동 협약 초안 작성과정에서의 논의점을 검토, 분석하였다.
초안의 작성에 있어 첫 번째 논의점인 테러의 정의에 대해 포괄적 협약은 기존의 협약에서 나아가 행위의 성격이 공중의 안전에 중대한 위험이 되는 경우에는 그 자체로 특정의도가 있는 것으로 판단하였다. 또한 ‘개인재산에 대한 심각한 손해’와 ‘환경에 대한 심각한 손해’를 테러의 정의에 포함시킴으로 그 범위를 확대시켰다.
두 번째 논의점인 예외사항에 대해 민족해방과정에서의 무력사용을 둘러싸고 UN 협약초안자가 만든 것과 이슬람회의기구에서 만든 두 가지 제안서가 논의되는 가운데 이슬람회의기구의 제안서에 의하면 국가군대의 임원뿐만 아니라 군대의 조직적인 형태에 미치지 못하는 일정조직을 갖춘 그룹(group)이나 개인을 포함한 비국가주체(non-state actors)가 무력충돌상황이나 외국의 점령 하에서 한 행위에 대해서는 포괄적으로 테러규정의 적용을 배제함으로써 오히려 기존의 협약에서 후퇴하는 법안이 될 것이라고 판단하였다. 세 번째 논의점인 공무로 행해진 국가군대의 활동에 대한 두 제안서 중에서는 UN 초안작성자의 제안서가 오히려 더 포괄적으로 적용을 배제할 수 있다고 판단하였다.
UN은 포괄적 국제테러리즘협약을 14번째 테러관련협약이자 완결편으로 의도하고 있다. 포괄적 국제테러리즘협약은 테러와 관련된 기존협약을 보충하고, 법률의 흠결로 인한 규제불능상태를 좁히기 위한 노력의 일환으로 의도되었으며, 동일한 이유로 다수의 국가에 의한 채택이 또한 필요하다. 아직 초안에의 최종합의과정이 남았으므로 협약의 제정초기에 의도한 바대로 테러에 대응할 수 있는 포괄적 기준을 제시할 수 있는 규정을 갖추고, 실제 적용에 있어서도 효과적으로 운용될 수 있는 협약으로의 완결편으로 제정, 채택되기를 바란다.

영어초록

Legal approach to fight against terrorism allowed under international regime is to use international convention that state is party to it and domestic law. Recently, UN has focused on the enactment, adoption and ratification of a comprehensive convention on international terrorism. This treaty has intended to supplement existing treaties dealing with terrorism and also to express a joint resolution to cooperate against terrorism.
This paper covers first, the necessity of the comprehensive convention and second, main issues surrounding the convention.
Comprehensive convention recognized the acts by their very nature constitute such a grave danger to public security to be per se terrorist act with specific intent. Also expanded the material element to include serious damage to private property of and kind.
The main issue concerns on the exclusionary clause. The two version of this article are under consideration: a working draft prepared by the group of “Friends of the Chairman” and an alternative proposed by the member states of the Organization of the Islamic Conference(OIC). The draft prepared by the Friends of the Chairman would exclude such acts “the activities of armed forces during an armed conflict”, whereas the draft proposed by the member states of the OIC would exclude them “the activities of the parties during an armed conflict, including in situations of foreign occupation”. The scope of acts excluded in OIC draft is not limited to acts committed by the military forces but also non-state parties during armed conflict including in situations of foreign occupations thus putting comprehensive convention far beyond expectation.
Comprehensive convention is 14th convention related to the terrorism UN has worked on. The comprehensive convention is intended to supplement existing standards, not replace them. Also to make an appropriate way of ensuring the complementary of these breaches of international law.
Endeavor to generalize a comprehensive agreement on international terrorism seems to be near end. It is hoped that comprehensive convention contains clauses that are compatible with international law to present effective standard to fight against terrorism.
