공공 오픈데이터 EU Directive 개정 동향과 시사점 (Recent Trends of the Amendment of the Public Sector Information Directive in EU and Its Implications to the Republic of Korea)

초록

전자정부 정책 추진을 기반으로 우리나라는 방대한 ‘공공 분야 정보’를 축적하였고, 이러한 ‘공공 분야 정보’는 4차 산업혁명과 함께 대두되는 인공지능, 빅데이터 등의 신기술 활용의 핵심적인 수단이라고 할 수 있다. 국가가 보유하고 있는 ‘공공 분야 정보’를 민간으로 최대한 개방하여 다양한 데이터 혁신을 통한 부가가치 창출이 필요하다.
그러나 ‘공공 분야 정보’의 개방 및 활용을 위한 적극적인 정책 추진에도 불구하고 국내 관련 법제인 「공공데이터의 제공 및 이용 활성화에 관한 법률」(이하 “공공데이터법”이라 한다)에는 여전히 ‘활용’에 있어 법제도적 한계가 존재하고 이와 관련하여 개선이 필요하다. 최근 EU에서는 ‘공공 분야 정보’의 법적 기준이 되는 ‘오픈데이터 및 공공 분야 정보의 재사용에 관한 지침’이 2019년 개정을 통하여 정립되었다.
주목할 점은 ‘공공 분야 정보’의 적극적인 활용을 위하여 ‘적용범위 확대’, ‘수수료 무료 원칙 선언’, ‘고 부가가치 데이터셋’ 선정 등과 함께 지침의 명칭 변화까지 혁신적인 개정으로 적극적인 ‘공공 분야 정보’의 재사용을 추진하고자 하였다는 점이다. 따라서 본 지침과의 비교법적 검토를 통해 국내 관련 법제인 「공공데이터법」상 법제도적 개선 사항을 도출하는 것이 중요할 것으로 사료된다.
본고에서는 2003년 EU 공공 분야 정보의 재사용에 관한 지침을 살펴보고 2019년 개정된 지침의 주요 내용을 살펴보았다. 그리고 개정 주요사항과 관련하여 국내 법제인 「공공데이터법」과 비교를 통해 법적 한계를 도출하고 법제도 개선 방안을 제안하였다. ‘대상 기관의 확대’, ‘고 부가가치 데이터셋 선정’, ‘수수료 무료 원칙 선언’ 등 규정을 중심으로 ‘공공 분야 정보’ 활용 활성화의 기반 조성을 위하여 국내 법제인 「공공데이터법」의 개선 방안을 제안하였다.

영어초록

Korea has accumulated vast amounts of “public sector information” through the e-government policy. In addition, 'public sector information' is a key means of representative new technologies of the fourth industrial revolution such as artificial intelligence and big data. It is necessary to open up 'public sector information', a large amount of information held by the state, to the private sector as much as possible to create various data innovations.
Despite the active policy for the opening and utilization of “public sector information,” there is still a legal system limitation in the related ‘act on promotion of the provision and use of public data’ in Korea, which requires the improvement of ‘public sector data’.
Recently, in the EU, the Directive on the Reuse of the Public Sector Information Directive, which is the legal standard for Public Sector Information, was amended in 2019. The key point is that there have been innovative amendments to the change of the naming of directive, along with enlarge the scope of the Directive, the declaration of free charges, and the selection of high-value data sets for the active use of public sector information.
Through these innovative amendments, the government actively promoted the reuse of public sector information. Therefore, it is important to derive the legal systemic improvement under the act on promotion of the provision and use of public data, which is a related domestic law in Korea, through comparative legal review.
This study examines existing directives on the reuse of EU public sector information and highlights the main points of the recently revised directive. In relation to the major amendments, the legal limits were drawn through the comparison with the act on promotion of the provision and use of public data, which is a related domestic law in Korea In conclusion, this study proposed the improvement of the public data law in Korea which focuses on main regulations such as 'selection of high-value data sets' and 'declaration of free charge principle' in order to lay the groundwork for vitalizing the utilization of public sector information.
