공개수배제도의 문제점 및 해결방안 (Raised issues and Solution of Wanted Notice System)

초록

수배제도는 도주하는 범죄피의자를 조기에 효율적으로 체포하기 위하여 운영되는 수사기법이다. 우리나라에서 운영되고 있는 수배제도는 경찰청 훈령인 범죄수사규칙과 예규인 지명수배규칙 등에 근거하여 지명수배, 지명통보, 공개수배 등이 행사되고 있다. 수사기관은 도주하는 범죄피의자(수배자)를 조기에 체포하지 못할 경우 또는 사회적 관심과 이목을 집중시키는 강력사건일 경우에 보충적 수단으로 수배자의 범죄사실, 성명 등을 매스컴 등에 공개한다. 수사기관에서 수배자를 공개하는 주된 목적은 범죄피의자를 조기에 체포하여 2차적인 동일한 또는 유사한 범죄피해를 방지하기 위함이다. 또한 부족한 범죄관련 정보를 시민들에게 구하여 어떠한 범죄라도 강력하게 대응하겠다는 의지를 보여주기 위함이다.
문제는 수사기관에서 수배자의 신상정보를 공개할 때에 형사소송법상 근거법률의 부재로 인하여 무죄추정의 법리를 포함하여 피의사실공표죄에 해당할 가능성이 있다. 또한 유죄로 확정판결이 되기도 전에 범죄피의자 자신의 이름과 사진뿐만 아니라 그의 전과사실 같은 과거 경력이나 가족관계 또는 이성 관계 같은 사생활을 공개함으로써 법원의 최종적인 유죄의 확정판결을 받기도 전에 범죄자라는 낙인이 찍히게 된다. 따라서 공개수배자는 구속이나 형벌보다도 더 중대한 수배자의 인권을 침해당하게 될 가능성이 있다.
그러므로 위와 같은 문제를 해결할 수 있는 가장 좋은 대안은 수배제도에 대한 근거 법률을 입법화하는 것이다.

영어초록

Most wanted system for the criminal suspects operating by police is a way of investigating used in order to arrest them effectively at an early stage. The kind of most wanted persons divide into most wanted criminal suspects, most wanted criminal suspects reported to the public, and wanted criminal suspects reported to the policemen based on criminal investigation rule as an instruction and wanted criminal rule as an established rule enacted respectively by Police Authority. Investigating authority can open valuable information on the most wanted person such as name, facts constituting an offence to the public through mass media if he/she is not arrested by police at an early state. In particular, in case of committing grave crimes focused on big social interests, investigating authority shall open the case to the public through mass media in order to catch the fugitive criminal as soon as possible. There are two main objects of opening the criminal suspects to the public through mass media. One is to protect innocent people from the damage of same or similar crimes. The other is not only to show strong will of investigating authority for arresting the fugitive criminal suspects to the public but also to request ordinary people of the valuable information related to the crime.
A big issue raised is that it is possible for investigating authority to violate the right of most wanted person legally protected such as a crime of publication of facts of suspected crime including violating the principle of innocent presumption. It is also possible for wanted person to be stigmatized the criminal suspects as well as to open his/her name, picture, family relations, privacy, and so on to the public through mass media before taking final judgement as a guilty. It is therefore possible for most wanted person to violate his/her human rights much more valuable than detention or any kind of criminal penalty. In order to solve this issue raised, the best alternative plan makes an legislation on most wanted system.
