전자공증의 문제점과 개선방안 (The Problems and Improvement measures of Electronic Notarization)

초록

미국, 독일 및 일본의 전자공증제도에서 살펴보았듯이 모두 전자공증의 도입에 이어 이름은 미국의 경우 RON, 독일의 경우 화상회의를 통한 온라인 공증, 일본의 경우 화상통화(テレビ電話)에 의한 인증 등 각각 다르지만 최근에 이르러 COVID19의 영향으로 원격 온라인 공증까지 도입한 것을 알 수 있었다. 특히 일본은 화상공증의 경우 우리보다 조금 뒤에 도입하였지만, 우리한테는 없는 전자확정일자제도를 갖고 있고, 나아가 2025년까지 전자공정증서의 도입까지 추진하고 있다.
우리나라는 전자공증제도의 도입에 이어 엄격한 대면요건을 완화한 화상공증제도를 도입하여 시행하고 있지만, 종이공증이라는 낡은 패러다임에서 완전히 탈각하지 못한 채로 그 대상영역이 제한되어 종이공증의 일부밖에 서비스를 제공하지 못하는 제도상의 한계 외에도 전자공증이 아직 기대한 만큼 활성화되지 못하고 있는 운영상의 문제점 등 앞으로 개선하여야 할 적지 않은 과제를 안고 있다.
공증인법 제1조(목적)에 ‘공증사무의 적절성과 공정성’을 확보함을 목적으로 한다고 규정되어 있는바, 자연의 빛이나 음파를 통해 시공간의 제약 하에 눈으로 보고 귀로 듣는 것이나 과학기술의 발달에 따라 첨단기술장비를 통하여 시공간을 초월하여 눈으로 보고 귀로 듣는 것이나 본질적인 차이는 없고, 오히려 더 잘 보고 더 잘 듣게 되었다고 할 수 있을 것이므로, 공증사무의 적절성과 공정성을 확보하는 것이 본질이지 온라인 세상인 현재 구시대적인 공증사무소 출석이나 공증인과의 물리적 대면요건을 고집할 것은 아니라고 본다.
종이문서를 대체하는 전자문서라는 정보기술혁명이 이미 대세로 자리 잡고, COVID19 사태로 인하여 비대면 전자공증의 수요가 폭발적으로 급증하여 전자공증의 활성화 기반이 마련된 현재, 새로운 패러다임의 관점에 입각하여 종이공증에서 제공하는 모든 서비스를 전자공증에서도 구현할 수 있도록 전자공증시스템에서 하나의 완결된 체계, 이른바 원스톱 서비스(One Stop Service)를 제공할 수 있는 제도를 설계하고 구축할 필요가 있다.
이에 전자공정증서 서비스, 전자확정일자 서비스 등 전자공증의 대상 영역을 확대하고, 전자공증시스템의 안전성과 편리성의 증대, 전자공증시스템의 운영주체의 변경과 지정공증인의 증원, 공증인의 교시의무의 강조, 공증법령의 정비, 전자공증의 홍보 강화 등을 통해 전자공증의 활성화를 꾀할 것을 제안하였다.
다만, 제도 개선만으로 모든 것이 해결되지는 않으므로, 우선 전자공증에 임하는 공증인의 자세와 의식의 변화가 필요하고, 공증실무의 근간인 공증인의 교시의무의 이행에 공증인이 진력해야 할 것이다.

영어초록

As we have seen in the Electronic Notarization Systems in the United States, Germany and Japan, they all have introduced Electronic Notarization, but recently, it was found that Remote Online Notarization was also introduced under the influence of COVID-19. In particular, in the case of Remote Online Notarization, Japan introduced it a little later than Korea, but it has an Electronic Fixed Date system that we do not have, and furthermore, the introduction of Electronic Notarial Deed as Execution Title is promoted by 2025.
Following the introduction of the Electronic Notarization System, Korea introduced and implemented a Remote Online Notarization system that relaxed strict face-to-face requirements. However, the subject area is limited without completely breaking away from the old paradigm of paper notarization. Therefore, there is a limitation in the system that only a part of the paper notarization service can be provided. In addition, Electronic Notarization has a number of challenges to be improved in the future, such as operational problems that are not yet active as expected.
Article 1 (Purpose) of the Korea Notary Public Act stipulates that the purpose is to secure ‘appropriateness and fairness of notary affairs’. There is no essential difference between seeing and hearing with the eyes and ears under the constraints of space and time through natural light or sound waves, or seeing and hearing with the eyes and ears through the use of advanced technology equipment according to the development of science and technology. It could be said that We saw better and heard better by the latter. Therefore, I believe that securing the appropriateness and fairness of the notary service is essential, and we need to insist on the outdated requirements of attending a notary office in the online world.
The Information Technology Revolution called Electronic Documents replacing Paper Documents has already become a trend, and the demand for non-face-to-face Electronic Notarization has exploded due to the COVID-19 crisis. Now, the foundation for the activation of Electronic Notarization has been laid. So, based on the new paradigm, we need to design and build a system that can provide a complete system, the so-called One Stop Service, in the Electronic Notarization system so that all the services provided by the Paper Notarization can be implemented in the Electronic Notarization as well.
Accordingly, I proposed to promote the electronic notarization by expanding the subject area of Electronic Notarization such as Electronic Notarial Deed(as Execution Title) Service and Electronic Fixed Date Service, increasing the safety and convenience of the Electronic Notarization system, changing the operating entity of the Electronic Notarization system, increasing the number of designated notaries, reforming the Notary Act and strengthening the publicity of Electronic Notarization, etc.
However, since system improvement alone does not solve everything, it is necessary to first change the attitude and consciousness of notaries working on Electronic Notarization, and the notary public should make an effort to fulfill the duty of teaching, which is the basis of notary practice.
