Incoterms 2020의 적용상 문제점과 실무적 시사점에 관한 고찰: 일반, 운송, 보험 관련 이슈를 중심으로 (A Study on the Problems and Practical Implications of the Application of Incoterms 2020: Focusing on General, Transportation, and Insurance Related Issues)

초록

국제 무역거래에서 매도인과 매수인의 국제물품매매계약 체결 시 널리 사용되는 FOB 조건, CIF 조건과 같은 정형거래조건의 해석을 위한 국제상업회의소(ICC) 제정의 인코텀즈 2020이 제정되어 2020년 1월 1일부터 시행되고 있다. 현재 인코텀즈 2020의 시행 3년을 경과하면서 인코텀즈 2020의 적용과 관련하여 여러 가지 쟁점들이 발생하고 있다. 따라서 본고는 인코텀즈 2020의 적용 관련 문제(인코텀즈 2020의 국내 거래 적용의 문제, D 그룹 조건 적용의 문제), 운송 관련 문제(컨테이너선 선적조건과 재래선 선적조건의 융합 문제, FCA 조건의 새로운 역할과 그 운용의 문제), 보험 관련 문제(FOB 조건 부보의 문제, CIF 조건과 CIP 조건 담보범위 차이의 문제)를 중심으로 고찰함으로써 실무계에 인코텀즈 2020의 적용에 따른 실무상의 유의점을 제시하여 원활한 무역거래의 수행에 도움을 주고자 한다. 연구방법은 인코텀즈 2020과 관련한 일본의 문헌들을 중심으로 한 문헌연구 방법을 채택한다.

영어초록

In international trade, Incoterms 2020 enacted by the International Chamber of Commerce(ICC) for the interpretation of standard transaction terms such as FOB term and CIF term, which are widely used when concluding an international sales contract between a seller and a buyer, were enacted on January 1, 2020. Currently, three years after the implementation of Incoterms 2020, various issues are arising in relation to the operation of Incoterms 2020. Therefore, this paper deals with the issues of application of Incoterms 2020 (the issues of application of Incoterms 2020 to domestic transactions, the issue of application of Group D terms), transportation-related issues(convergence of container ship shipping terms and conventional ship shipping terms, FCA term’s new role and its operation), insurance-related issues(issue of coverage under FOB term, issue of difference between coverage under CIF term and CIP term), suggesting practical considerations according to the application of Incoterms 2020.
In a situation where cross-border transactions are increasing in recent years and the use of EXW term and DDP term is expanding according to the expansion of global trade, the decision that Incoterms 2020 is applicable to both domestic and international transactions is considered a desirable decision. As for the issue of FOB term insurance, after the seller delivers the goods in CY or CFS, the carrier fulfills the obligation to load the goods on board. Therefore, there is a problem that the seller must insure export FOB insurance for that section.It is worth noting that the conventional seller's minimum insurance principle in Incoterms 2020 recognizes the minimum insurance obligation in the case of the CIF term using a conventional ship, but has been changed to the maximum insurance obligation in the CIP term using a container ship.
