대만민법의 이행거절(拒絶給付) (Anticipatory Breach in Taiwan Civil Law)

초록

본 논문은 채무불이행의 새로운 유형으로서 이행거절에 관한 대만의 입법례와 우리나라의 논의를 기초로 하여 그 독립적 유형을 인정하고 그에 따른 요건과 효과를 살펴본 것이다.
대만의 학설과 판례에서는 전통적인 채무불이행의 유형으로 이행지체, 이행불능과 불완전이행의 3가지 유형 이외에 이행거절을 채무불이행의 유형으로 인정한다. 다만 그 근거는 1999년 민법개정 전에는 제227조의 ‘급부하지 아니하거나’(不爲給付)에 의하였으나 현재에는 그 문구가 삭제되어 학설에서는 입법적 흠결로 파악하고 있지만 여전히 채무불이행의 유형으로서 이행거절은 인정하고 있다. 판례는 이를 독립한 유형으로 인정하는 것도 있고 인정하지 않는 것도 있다.
대만에서는 이행거절은 이행기 전의 이행거절과 이행기 후의 이행거절로 나누어 그 요건과 효과를 각각 다루고 있다. 특히 효과에서는 손해배상과 계약의 해제 외에도 이행기 전 소제기(민사소송법 제316조), 수령거절, 과실상계 등을 들고 있다. 이러한 대만의 논의는 종래 우리 법에서 소홀히 하던 것으로 우리 법의 논의에서도 중요한 시사점을 제공한다. 이외에 이후의 비교법적 논의를 위하여 특히 우리 법의 이행거절의 논의에 대하여도 간략하게 제시하였다.

영어초록

This article is about anticipatory breach in Taiwan Civil Law. It examines the significance of anticipatory breach as an new type of breach of contract and its requirement and the effects. An anticipatory breach occurs where, before the time comes for one party to perform his part of the contract, he declares that he is not going to do so.
In Taiwan contract law，on the event of a repudiatory breach of contract the innocent party was entitled to choose to either accept the repudiation (within a reasonable time) or to affirm the contract. In Taiwan law, non-performance covers cases of impossibility, delay in performance, positive breach of contract, and an anticipatory breach is included in it.
The article 227 of the Taiwan civil Code as a legal basis was admitted before the Civil code Reform in 1999. But the article was amended as follows : If a debtor incompletely performs his obligation by reason of a circumstance to which the debtor is imputed, the creditor may execute his right according to the provisions of the default or the impossibility of the performance(article 227，subsection 1). In addition to the injury arising from the incomplete performance in the preceding paragraph, the creditor may claim compensation for other injuries arising therefrom, if any(article 227，subsection 2). So，now the anticipatory breach is regarded as legislative shortcomings, yet is admitted as a type of Non-performanc by analogical application.
The anticipatory breach can be divided between before and after the period of performance. In particular, a party which is entitled to withhold its performance and to terminate the contract. He can also pursue the damages by non-performance. Above this，an action demanding future performance may not be initiated unless it is necessary to make such demand in advance(article 246), so it is also admitted as its effect. Moreover，comparative negligence is also regarded by scholars.
Based on this comparative study of two countries, we also intends to give a preliminary suggestion to the anticipatory breach. For this analysis, after admitting its speciality as a new type of breach of contract, we analyse the requirements and the effects of an anticipatory breach in Korea in brief. Finally, this study surveys the drafts of Korean civil Code(2004, 2013).
